1. Oh, I'm running late, oh.
Copy !req
2. Brooke, we're all
upset, but we need to move on.
Copy !req
3. Honey, you're a junior now.
Copy !req
4. It's your make-or-break year,
so there's no room for self pity.
Copy !req
5. Can you give Marlene and I
a ride to school today?
Copy !req
6. I'm sorry, honey, I don't have time.
Copy !req
7. I have an 8:30 with Marc Shelley
at White & Wolfe.
Copy !req
8. What? Richard, you didn't say anything!
Copy !req
9. How did you get the meeting?
Copy !req
10. It's just a meeting,
so don't get too excited.
Copy !req
11. But it could be huge.
Copy !req
12. I know!
Copy !req
13. Who's going to the meeting with you?
Copy !req
14. Hey, I got the meeting.
Copy !req
15. I know, I just think maybe you
should take Melinda or Janice.
Copy !req
16. Janice? You want me to take Janice?
Copy !req
17. - Yeah, why not?
- I'm not taking Janice.
Copy !req
18. - Rough morning?
- You know my parents.
Copy !req
19. Maybe they just need a little more time.
Copy !req
20. I don't know about that.
Copy !req
21. I'd say they're pretty over it.
Copy !req
22. My mom's making tacos tonight.
Copy !req
23. I'll let her know you're coming.
Copy !req
24. It's not like they'll miss me.
Copy !req
25. Brooke, I'm serious, honey.
Copy !req
26. You need to get focused or you could say,
Copy !req
27. "Good-bye Stanford,
hello Somewhere State."
Copy !req
28. Got it.
Copy !req
29. Yikes.
Copy !req
30. Good morning!
Copy !req
31. Morning, Grace.
Copy !req
32. I keep telling you, you
don't have to keep doing this.
Copy !req
33. Are you kidding?
Copy !req
34. This is the best part of my day, Gramps.
Copy !req
35. Pills first.
Copy !req
36. You're a good girl.
Copy !req
37. Ah, honey, you know I'm not
gonna be around here forever,
Copy !req
38. and you might wanna start
thinking about some other guy
Copy !req
39. you wanna have breakfast with.
Copy !req
40. I'll work on that.
Copy !req
41. Okay.
Copy !req
42. You know, I love the way you do
the oatmeal, but what do you say
Copy !req
43. I take you out for bacon and
eggs this morning, my treat.
Copy !req
44. Not after your last cholesterol test.
Copy !req
45. Besides, I have some papers I have
to grade before the staff meeting.
Copy !req
46. I'm 81 years old, and bacon
is not gonna be what kills me.
Copy !req
47. Nice try, you're 82.
Copy !req
48. Yeah.
Copy !req
49. Good morning.
Copy !req
50. Have a nice day.
Copy !req
51. Morning, ladies.
Copy !req
52. Morning.
Copy !req
53. Good morning.
Copy !req
54. Hey, what do you call
a teacher with no students?
Copy !req
55. Unemployed.
Copy !req
56. I got it, how about ecstatic?
Copy !req
57. You're both right. Retired!
Copy !req
58. Only 36 days to go!
Copy !req
59. You know you're gonna miss
the kids when you're gone, Rizzo.
Copy !req
60. No, Grace. That's sweet, but no, I won't.
Copy !req
61. The older I get, the more difficult
these kids are to deal with.
Copy !req
62. I totally agree.
Copy !req
63. Yesterday, I just about
snatched at Tim Webster.
Copy !req
64. That boy had me on my last nerve.
Copy !req
65. Well, I happen to think that difficult
students can be a blessing.
Copy !req
66. Grace, honey, when is this
optimism ever gonna wear off?
Copy !req
67. Bill. Bill.
Copy !req
68. Bill.
Copy !req
69. Junk mail.
Copy !req
70. Oh, man!
Copy !req
71. David, why are you always so sad?
Copy !req
72. Hey! You're back!
Copy !req
73. Why are you back?
Copy !req
74. My pastor gave me permission
to finish my doctorate at Hadleigh,
Copy !req
75. so if that's okay with you,
I'm gonna be here for awhile.
Copy !req
76. Oh, David, you are a mess.
Copy !req
77. What happened to you?
Copy !req
78. I woke up.
Copy !req
79. Okay, for 500 points,
for all the cheese, for the game.
Copy !req
80. This quote is from what document?
Copy !req
81. "We hold these truths to be self-evident,
that all men are created equal,
Copy !req
82. "that they are endowed by their Creator
Copy !req
83. with certain unalienable
rights, that among these..."
Copy !req
84. Boom, baby!
Copy !req
85. All right, Team 1, what's your answer?
Copy !req
86. Our answer is
the Declaration of Independence.
Copy !req
87. That's... correct!
Copy !req
88. Team 1 wins!
Copy !req
89. Yes!
Copy !req
90. Okay, you guys,
Copy !req
91. Monday we will examine the assertion of
individual rights through the last century.
Copy !req
92. Have a good weekend.
Copy !req
93. Brooke, are you okay?
Copy !req
94. I'm fine.
Copy !req
95. Are you sure?
Copy !req
96. Yeah, thanks.
Copy !req
97. Ms. Ryan?
Copy !req
98. I lied.
Copy !req
99. Are you sure you're being fair?
Copy !req
100. Trust me, they're over it,
and they expect me to be over it, too.
Copy !req
101. It's like to them, he never even existed.
Copy !req
102. The only thing that I know for sure is that
I'm never going to see my brother again.
Copy !req
103. Everybody's asked if there's
anything that they can do.
Copy !req
104. The truth is, no one can do anything
because the only thing that I really want
Copy !req
105. is 5 more minutes to tell my brother
how I really felt about him.
Copy !req
106. Did your brother believe
there was something more?
Copy !req
107. I don't know.
Copy !req
108. Do you?
Copy !req
109. Brooke, every person
reaches a point in their life
Copy !req
110. when they ask themselves this question.
Copy !req
111. There's nothing wrong
with you asking it, too.
Copy !req
112. You never let anything get to you.
Copy !req
113. How do you do that?
Copy !req
114. Jesus.
Copy !req
115. Hello?
Copy !req
116. How'd it go, Amy?
Copy !req
117. Michael.
Copy !req
118. It's gone.
Copy !req
119. My cancer's... it's gone.
Copy !req
120. Oh, my goodness!
Copy !req
121. That's incredible!
Copy !req
122. I know. I just... I can't believe it.
Copy !req
123. Isn't that what you prayed for?
Copy !req
124. Yes, of course. I just...
Copy !req
125. Prayer is a powerful thing,
Copy !req
126. and it turns out God has
much bigger plans for you.
Copy !req
127. You okay, Grace?
Copy !req
128. Yeah, I just can't
stop thinking about Brooke.
Copy !req
129. You know, she's searching.
Copy !req
130. She's hurting.
Copy !req
131. Yeah, that's the thing about atheism.
Copy !req
132. It doesn't take away the pain;
It just takes away the hope.
Copy !req
133. What'd you tell her?
Copy !req
134. The truth.
Copy !req
135. Now she's free to make her own choice.
Copy !req
136. Unfortunately, in this day and age,
Copy !req
137. people seem to forget that the
most basic human right of all
Copy !req
138. is a right to know Jesus.
Copy !req
139. Let's put her on the prayer list.
Copy !req
140. Prayer always seems to be
the last thing we do,
Copy !req
141. when it should be the first.
Copy !req
142. Now, how 'bout some more popcorn?
Copy !req
143. With a glycemic index
of 100, not a chance.
Copy !req
144. I swear, Grace, if you
don't start feeding me better,
Copy !req
145. I'm gonna leave you for a nursing home.
Copy !req
146. Well, that's it for me.
Copy !req
147. I'm going to bed.
Copy !req
148. Love ya.
Copy !req
149. I love you better.
Copy !req
150. Love you first.
Copy !req
151. That's unfair.
Copy !req
152. Gotcha!
Copy !req
153. Brooke, the people from
that charity place are here
Copy !req
154. to pick up your brother's things.
Copy !req
155. Can you make sure they get everything?
Copy !req
156. And don't forget to put the milk away!
Copy !req
157. - Well, that's the last of it.
- Thank you.
Copy !req
158. And, well, I was loading one
of the boxes onto the truck,
Copy !req
159. I noticed this and I thought
you might wanna keep it.
Copy !req
160. So sorry for your loss.
Copy !req
161. And so, peaceful nonviolence
comes first in India under Gandhi,
Copy !req
162. and then later, here in
the United States under Dr. King
Copy !req
163. and others as a means
of achieving civil rights.
Copy !req
164. But what makes nonviolence so radical
Copy !req
165. is its unwavering commitment
to a nonviolent approach,
Copy !req
166. not just initially, but in the
face of escalating persecution
Copy !req
167. by the opposing force.
Copy !req
168. Yes?
Copy !req
169. Isn't that sort of like what Jesus meant
Copy !req
170. when he said that we
should love our enemies?
Copy !req
171. Yes.
Copy !req
172. The writer of the Gospel of Matthew
Copy !req
173. records Jesus as saying,
"You have heard it said,
Copy !req
174. "love your neighbor and hate your enemy,
Copy !req
175. "but I tell you, love your enemies
Copy !req
176. "and pray for those who persecute you,
Copy !req
177. that you will be children
of your Father in heaven,"
Copy !req
178. which indicates a commitment
to nonviolence.
Copy !req
179. Dr. King confirmed the link,
describing his inspiration from Scripture,
Copy !req
180. saying Christ furnished
the spirit and motivation,
Copy !req
181. while Gandhi furnished the method.
Copy !req
182. Except that that didn't work.
Copy !req
183. Jesus got himself killed
and everybody knows that.
Copy !req
184. Well, so did Dr. King.
Copy !req
185. So, I guess it just depends
on how you measure success.
Copy !req
186. Both men created movements
that survive to this day,
Copy !req
187. even though both paid the ultimate price
for their commitment to their ideals.
Copy !req
188. I still wouldn't do it.
Copy !req
189. Well, not very many people
have that kind of courage.
Copy !req
190. But I, for one,
am grateful for those that do,
Copy !req
191. you know, those who stand up
for what they believe.
Copy !req
192. Have a good day.
Copy !req
193. Are you Pastor Dave?
Copy !req
194. I am.
Copy !req
195. - I'm Martin Yip.
- Nice to meet you.
Copy !req
196. My friend Josh Wheaton
said you might be able
Copy !req
197. to answer my questions about God.
Copy !req
198. Well, that definitely falls
within my job description.
Copy !req
199. How many questions have you got?
Copy !req
200. So far, 147.
Copy !req
201. Is something wrong?
Copy !req
202. No.
Copy !req
203. Josh encouraged me to write them down
and be as comprehensive as possible.
Copy !req
204. Of course he did.
Copy !req
205. Well, I'll have to thank him
next time I see him.
Copy !req
206. Come on.
Copy !req
207. So, what's your first question?
Copy !req
208. Grace, I just have to hear it from you.
Copy !req
209. Did this happen?
Copy !req
210. If you're asking whether I responded
to a student's question, yes.
Copy !req
211. If you're asking whether
her question and my answer
Copy !req
212. both referenced Jesus as it was
relevant to the history lesson
Copy !req
213. we were discussing,
again, I'd have to say yes.
Copy !req
214. Good afternoon, Ms. Wesley.
Copy !req
215. I've asked Bob Fessler to sit in,
he's the school's attorney,
Copy !req
216. to advise us on any legal issues
we might be brushing up against.
Copy !req
217. Should I have a lawyer, too?
Copy !req
218. No, I don't see the need for that.
Copy !req
219. Ms. Rizzo is present
as your union representation.
Copy !req
220. Okay.
Copy !req
221. We are here to hear
your side of the story.
Copy !req
222. Now, I understand a student in
your second period history class
Copy !req
223. asked a question about the parallels
between the teachings of Gandhi
Copy !req
224. and remarks allegedly made by Jesus.
Copy !req
225. Yes, that's correct.
Copy !req
226. And your answer incorporated
specific detailed reference
Copy !req
227. to those teachings that
included Scripture itself,
Copy !req
228. the words of Jesus.
Copy !req
229. Yes.
Copy !req
230. What were you thinking, Grace?
Copy !req
231. Do you believe your response
was in line with district policy?
Copy !req
232. Yes.
Copy !req
233. As well as in compliance
with state and federal guidelines?
Copy !req
234. Yes, sir.
Copy !req
235. Well, Ms. Wesley, unfortunately for you,
Copy !req
236. I'm fairly certain the
school board will disagree.
Copy !req
237. No, Coach, you're not hearing me.
Copy !req
238. No prayers.
Copy !req
239. No moments of silence. Nothing.
Copy !req
240. It's tradition on the field.
Copy !req
241. Not on the field, not in the locker room,
not in the parking lot for that matter.
Copy !req
242. Whatever you say.
Copy !req
243. Okay, thanks, Coach.
Copy !req
244. Come on in.
Copy !req
245. Hi, Brooke.
Copy !req
246. You wanted to see me?
Copy !req
247. Ms. Wesley is currently
under disciplinary review.
Copy !req
248. All of her classes have been
reassigned until things are settled.
Copy !req
249. I don't want you to have
any contact with her.
Copy !req
250. None whatsoever, either
on or off school property.
Copy !req
251. Do I have any say in this?
Copy !req
252. No, I've already discussed things
with your father and he agrees.
Copy !req
253. Since when does my dad care?
Copy !req
254. Brooke, the important thing for you to
remember is you've done nothing wrong.
Copy !req
255. Neither did Ms. Wesley.
Copy !req
256. All she did was answer a question.
Copy !req
257. Ms. Wesley's answer was
not in line with school policy.
Copy !req
258. Really?
Copy !req
259. I mean, aren't we allowed
to say what we believe?
Copy !req
260. When did that change?
Copy !req
261. I'm not gonna argue with you,
Copy !req
262. and I don't want you discussing
the situation with anyone.
Copy !req
263. Do you understand?
Copy !req
264. Do you understand?
Copy !req
265. Yes.
Copy !req
266. Grace?
Copy !req
267. Are you...
Copy !req
268. Tom Endler, your union-appointed attorney.
Copy !req
269. You don't look like a lawyer.
Copy !req
270. Thank you.
Copy !req
271. I'm not sure I meant that as a compliment.
Copy !req
272. I'm determined to take it as one.
Copy !req
273. Shall we sit?
Copy !req
274. So, have you defended many teachers
in disciplinary matters?
Copy !req
275. Nope, you're my first.
Copy !req
276. Just hired on from
the public defender's office.
Copy !req
277. Criminal law?
Copy !req
278. No offense, but I'm not a criminal.
Copy !req
279. Don't be so sure of that.
Copy !req
280. Your kind of case makes
everybody uncomfortable.
Copy !req
281. School boards, teachers, parents.
Copy !req
282. It makes them feel... yucky.
Copy !req
283. Yucky?
Copy !req
284. Is that a technical legal term?
Copy !req
285. You got a better word for it?
Copy !req
286. Grace, I'm gonna level with you.
Copy !req
287. Nobody wants your case.
Copy !req
288. I drew it because
I'm low man on the totem pole
Copy !req
289. in a place where
seniority means everything.
Copy !req
290. If, for whatever reason,
you're not happy with me,
Copy !req
291. you're on your own.
Copy !req
292. You're free to hire your own
attorney out of your own pocket.
Copy !req
293. Educational law isn't
exactly a common specialty.
Copy !req
294. So, what's the good news?
Copy !req
295. I don't like to lose.
Copy !req
296. And I'm willing to fight for you.
Copy !req
297. Are you a believer?
Copy !req
298. You mean a Christian?
Copy !req
299. No, but I think that's an advantage.
Copy !req
300. Why?
Copy !req
301. You're passionate about what you believe.
Copy !req
302. I mean, let's face it, it's why
you're in trouble in the first place.
Copy !req
303. But it blinds you to
the realities of procedure.
Copy !req
304. Okay.
Copy !req
305. Okay, what?
Copy !req
306. Okay, I agree to let you represent me.
Copy !req
307. - Good.
- Good.
Copy !req
308. David, are you okay?
Copy !req
309. Um, terrific.
Copy !req
310. There was a young man
in here, brilliant kid,
Copy !req
311. with no exposure to Scripture
until a few months ago.
Copy !req
312. He came in with some questions.
Copy !req
313. 147 of 'em to be exact.
Copy !req
314. I feel like I've been hit
by a truck loaded with Bibles.
Copy !req
315. Big heavy ones with those thick covers.
Copy !req
316. Always be ready to give
answer as to why you believe
Copy !req
317. and the reason for your hope.
Copy !req
318. 1 Peter chapter 3, verse 15.
Copy !req
319. Yes.
Copy !req
320. And where were you 4 hours ago?
Copy !req
321. "Trust in the Lord with all your heart
Copy !req
322. "and lean not on your own understanding.
Copy !req
323. "In all your ways, acknowledge him
Copy !req
324. and he will make your paths straight."
Copy !req
325. Father, I need you.
Copy !req
326. I can't do this alone.
Copy !req
327. I know that you're in control.
Copy !req
328. Please, give me the courage.
Copy !req
329. In Jesus' name, amen.
Copy !req
330. Call to order.
Copy !req
331. I assume Ms. Wesley understands
that this board has the power
Copy !req
332. to recommend any number
of disciplinary actions,
Copy !req
333. up to and including termination.
Copy !req
334. She does.
Copy !req
335. And this board should be aware
that in the event of such termination,
Copy !req
336. which we would view as both
wrongful and without cause,
Copy !req
337. she reserves all rights of redress.
Copy !req
338. I may have a solution.
Copy !req
339. There might be a way around
all of this unpleasantness
Copy !req
340. that would satisfy all parties.
Copy !req
341. A disciplinary notice in Ms. Wesley's file
Copy !req
342. stating the school board's
objections to her behavior,
Copy !req
343. a response from Ms. Wesley
Copy !req
344. confessing the inappropriateness of
Copy !req
345. and apologizing for her actions,
Copy !req
346. along with a pledge not to engage
Copy !req
347. in similar discussion
of Jesus in the future.
Copy !req
348. I'm confident that we can
move forward on that basis.
Copy !req
349. No.
Copy !req
350. Grace...
Copy !req
351. I can't.
Copy !req
352. I'd like to request a brief recess
to have a word with my client.
Copy !req
353. Excuse me.
Copy !req
354. Grace, this is exactly
what we were hoping for.
Copy !req
355. I mean, this is the part where you
say you're sorry, thank your lawyer,
Copy !req
356. go back to your classroom,
pick up your life, and move on.
Copy !req
357. - I can't do that.
- Why?
Copy !req
358. I gave an honest answer to a student's
legitimate question in history.
Copy !req
359. Grace.
Copy !req
360. Grace, you don't wanna do this.
Copy !req
361. It's the wrong decision.
Copy !req
362. Is it?
Copy !req
363. I mean, I would rather stand with God
Copy !req
364. and be judged by the world
Copy !req
365. than stand with the world
and be judged by God.
Copy !req
366. I am not gonna be afraid
to say the name "Jesus."
Copy !req
367. I know her. She's not gonna go for it.
Copy !req
368. How do we make this go away
and not get blood on our hands?
Copy !req
369. That's the easy part.
Copy !req
370. We let the ACLU do it.
Copy !req
371. They'll file suit against Ms. Wesley
Copy !req
372. and if she is found liable,
which she will be,
Copy !req
373. then we fire her for cause.
Copy !req
374. But the school district will certainly
be named as a codefendant.
Copy !req
375. We don't have the financial
wherewithal to fight that.
Copy !req
376. They've already been in touch.
Copy !req
377. They aren't interested
in punishing the school.
Copy !req
378. They want her.
Copy !req
379. Are you sure?
Copy !req
380. Trust me.
Copy !req
381. They've been dreaming of a case like this.
Copy !req
382. While Ms. Wesley apologizes
for any inconvenience
Copy !req
383. her actions may have caused,
Copy !req
384. Ms. Wesley stands by her statements,
and she does not retract or recant them,
Copy !req
385. either in full or in part.
Copy !req
386. So noted.
Copy !req
387. Having little choice, this board
recommends continued suspension,
Copy !req
388. henceforth without pay,
Copy !req
389. pending review by a court
of competent jurisdiction
Copy !req
390. to determine whether or not
Ms. Wesley violated
Copy !req
391. local, state, or federal guidelines.
Copy !req
392. This proceeding is adjourned.
Copy !req
393. The last thing we need
is a bunch of religious fanatics
Copy !req
394. protesting outside of our house.
Copy !req
395. We'll work to keep it
out of the media for now.
Copy !req
396. But next year, when you're
applying to all the colleges,
Copy !req
397. you'll be able to tell the story
Copy !req
398. of how Brooke was part of
a landmark constitutional case
Copy !req
399. concerning the separation
of church and state.
Copy !req
400. And believe me, there is not
an Ivy League admissions board
Copy !req
401. that could resist that.
Copy !req
402. And think of the other children out there,
Copy !req
403. innocent children who are subjected
to their repressive belief system.
Copy !req
404. And not forgetting
the financial opportunities.
Copy !req
405. Yes.
Copy !req
406. Ms. Wesley is an employee
of the school board.
Copy !req
407. We win in court and we
establish her misconduct
Copy !req
408. as said paid employee, well, there's
nothing that changes policy faster
Copy !req
409. than a big, expensive settlement.
Copy !req
410. We're going to prove once
and for all that God is dead.
Copy !req
411. Brooke is a minor.
Copy !req
412. As far as the court is
concerned, she has no rights.
Copy !req
413. That simply means I won't be
asking her to be a witness.
Copy !req
414. I feel supremely confident about this.
Copy !req
415. Okay.
Copy !req
416. Injunctive relief?
Copy !req
417. They're asking that you be fired,
Copy !req
418. plus revocation of your
teaching certificate.
Copy !req
419. What? How am I supposed to...
Copy !req
420. Plus attorney's fees.
Copy !req
421. Essentially, you'll lose everything.
Copy !req
422. Why are they doing this?
Copy !req
423. They want to make an example of you.
Copy !req
424. To them, your beliefs are like a disease
whose time has come and gone,
Copy !req
425. sort of like smallpox,
or polio, or the plague.
Copy !req
426. So, what do we do?
Copy !req
427. We win.
Copy !req
428. Hey, what's going on?
Copy !req
429. Brooke is exercising her right to protest.
Copy !req
430. Idiot.
Copy !req
431. Hey, shut up, loser.
Copy !req
432. At least she's standing for something.
Copy !req
433. Give me that.
Copy !req
434. Brooke, you need to stop this immediately.
Copy !req
435. Brooke, this is the last
time I'm gonna tell you.
Copy !req
436. If you don't stop this right now,
there are gonna be some consequences.
Copy !req
437. Actually, I don't think that there will,
Copy !req
438. because this is a sidewalk,
which is public property.
Copy !req
439. My dad's a lawyer.
Copy !req
440. Well, actually, this sidewalk
is on school property.
Copy !req
441. I suggest you girls aren't late for class.
Copy !req
442. Yes, ma'am.
Copy !req
443. Hey, what are you doing?
Copy !req
444. I'm just, you know, reading the paper
Copy !req
445. while my laptop goes through
my online jury orientation.
Copy !req
446. Well, shouldn't you be paying attention?
Copy !req
447. Please remember, consumption
of alcoholic beverages,
Copy !req
448. nonprescription drugs, and weapons
are prohibited in the courtroom.
Copy !req
449. Still, isn't it your civic duty?
Copy !req
450. Theoretically, yeah, but Matthew 22:14.
Copy !req
451. Oh, "Many are called, few are chosen."
Copy !req
452. Exactly.
Copy !req
453. Three hundred people show up,
they sit around for 8 hours,
Copy !req
454. and at the end of the day, they all
go home, having not been selected.
Copy !req
455. Statistically, I have a better chance
of being hit by lightning.
Copy !req
456. Gotta get some coffee.
Copy !req
457. All right.
Copy !req
458. It's called "voir dire."
Copy !req
459. It means that we get a chance to
eliminate any potential jurors
Copy !req
460. that may have a bias against you.
Copy !req
461. - Sir.
- Oh!
Copy !req
462. Thank you, sir.
Copy !req
463. So, how are you feeling?
Copy !req
464. I'm good.
Copy !req
465. All right, well, this is
a bit of an arduous process.
Copy !req
466. They bring all these jurors in.
It's gonna take the whole day,
Copy !req
467. but I think this is where
we can win the case.
Copy !req
468. All rise for the
Honorable Judge Robert Stennis.
Copy !req
469. On the order of the matter
of Thawley vs. Wesley, you may be seated.
Copy !req
470. So, it says here... what does it say?
Copy !req
471. It says you're a psychic.
Copy !req
472. Yes.
Copy !req
473. Oh, do you know who's gonna win this case?
Copy !req
474. No, don't answer that.
Copy !req
475. We're going to challenge
this juror, Your Honor.
Copy !req
476. Ms. Bailey, what's your favorite TV show?
Copy !req
477. "Pretty Little Liars."
Copy !req
478. Peremptory challenge, Your Honor.
Copy !req
479. What is your favorite TV show?
Copy !req
480. "Duck Dynasty."
Copy !req
481. Peremptory challenge, Your Honor.
Copy !req
482. "Duck Dynasty."
Copy !req
483. Ms. Smith, are you involved in any
community or charitable organizations?
Copy !req
484. Yes, the Salvation Army.
Copy !req
485. We'll accept this juror, Your Honor.
Copy !req
486. Juror number nine, you're a teacher.
Copy !req
487. I'm a retired teacher.
Copy !req
488. Ever have any disciplinary
run-ins with the administration?
Copy !req
489. Never.
Copy !req
490. Acceptable to the plaintiff, Your Honor.
Copy !req
491. Acceptable, Your Honor.
Copy !req
492. Peremptory challenge, Your Honor.
Copy !req
493. We'll take her, Your Honor.
Copy !req
494. Thank you, Mr. Cherry.
Copy !req
495. Preemptive challenge, Your Honor.
Copy !req
496. Number two just screams Marine.
Copy !req
497. I don't want him.
Copy !req
498. That would mean
blowing our last challenge.
Copy !req
499. Well, we have no choice.
Copy !req
500. I mean, what part of "God, Country,
and Corps" do you wanna put on that jury?
Copy !req
501. What was your last paid position?
Copy !req
502. Artillery Forward Observer,
United States Marine Corps.
Copy !req
503. Peremptory challenge, Your Honor.
Copy !req
504. Thank you.
Copy !req
505. Your Honor, we'd like
to challenge for cause.
Copy !req
506. Why is that?
Copy !req
507. Oh, Your Honor, the man's
an ordained minister.
Copy !req
508. Need I say more?
Copy !req
509. The juror is excused.
Copy !req
510. Objection, Your Honor.
Copy !req
511. Basis, Mr. Endler?
Copy !req
512. Discriminatory, Your Honor.
Copy !req
513. Peremptory challenges can not
be used to discriminate
Copy !req
514. against a certain class
of juror based on race,
Copy !req
515. ethnic background, religion, or gender.
Copy !req
516. And the fact that religious belief is
tangential to this case doesn't change that.
Copy !req
517. Upon further reflection, I find
the respondent's assertion is correct.
Copy !req
518. Sustained.
Copy !req
519. You're not her pastor, are you?
Copy !req
520. No, Your Honor.
Copy !req
521. Your Honor, I must protest here.
Copy !req
522. Mr. Kane, now, you had
a set number of peremptory challenges,
Copy !req
523. all of which you have used.
Copy !req
524. Therefore, it's up to opposing counsel.
Copy !req
525. We accept him, Your Honor.
Copy !req
526. Welcome to the jury, sir.
Copy !req
527. Henceforth, juror number twelve.
Copy !req
528. I hope you enjoy your
service to the community.
Copy !req
529. Better chance of
being struck by lightning.
Copy !req
530. It amazes me how we,
as human beings, think.
Copy !req
531. When I was battling for my life,
Copy !req
532. I was willing to hold onto
anything, including God,
Copy !req
533. even though I really didn't believe
in him until that moment.
Copy !req
534. I was convinced that I felt him,
Copy !req
535. but now that I'm officially in remission,
Copy !req
536. I find myself questioning everything.
Copy !req
537. So, effective immediately,
this blog is the personal diary
Copy !req
538. of one woman's exploration of faith
Copy !req
539. on her own terms, cancer-free.
Copy !req
540. Hey, Martin. How's it going?
Copy !req
541. Very good, Pastor Dave.
Copy !req
542. Oh, please.
Copy !req
543. You sure?
Copy !req
544. Well, it seems that for
every question you answered,
Copy !req
545. three or four more questions spring up.
Copy !req
546. Yeah, but that's a good thing, right?
Copy !req
547. It's like what Einstein
said about science.
Copy !req
548. Picture what you know
like the light of a candle.
Copy !req
549. As the circle of knowledge expands,
Copy !req
550. so does the circumference
of darkness around it.
Copy !req
551. So, I'm actually learning,
even though I might not feel like it.
Copy !req
552. Yes, exactly.
Copy !req
553. Well, I've been studying the Beatitudes.
Copy !req
554. They're very hard, one might say
impossible, to follow completely.
Copy !req
555. Here in Luke's account, Jesus says,
Copy !req
556. "Do unto others as you
have them do unto you."
Copy !req
557. But how is that possible?
Copy !req
558. How can I react to
the needs of everyone else
Copy !req
559. the same as my own, even for one day,
Copy !req
560. let alone my whole life?
Copy !req
561. And how can I reconcile my inability
to do so with Scripture?
Copy !req
562. Yeah, those are good questions.
Copy !req
563. Okay, scoot over.
Copy !req
564. What is that, Luke?
Copy !req
565. Yes, 6:20.
Copy !req
566. "And Jesus said to his disciples,
'You who are poor are blessed
Copy !req
567. "'because the kingdom of God is yours.
Copy !req
568. "'You who are now hungry are blessed
'because you will be filled.
Copy !req
569. "'You who now weep are blessed
because you will laugh.
Copy !req
570. "'You are blessed when people
hate you, when they exclude you,
Copy !req
571. "'insult you,
and slander your name as evil
Copy !req
572. because of the Son of Man."'
Copy !req
573. You can't win.
Copy !req
574. Thanks.
Copy !req
575. I'll take that under advisement.
Copy !req
576. Oh, come on, you know I'm right.
Copy !req
577. I mean, why do it?
Copy !req
578. Why go through this whole exercise, huh?
Copy !req
579. Here, thanks.
Copy !req
580. You know, I looked up your history.
Copy !req
581. You're better than this.
Copy !req
582. You were third in your
class at Stanford Law.
Copy !req
583. You clerked for a judge
on the Ninth Circuit.
Copy !req
584. Why you slumming like this?
Copy !req
585. Maybe I believe that people
that don't do anything wrong
Copy !req
586. shouldn't suffer at the hands of the law.
Copy !req
587. You know what hate is, Tom?
Copy !req
588. I'm not talking about the fairy tale
stuff, I mean real hate.
Copy !req
589. I hate what people
like your client stand for
Copy !req
590. and what they're doing to our society,
Copy !req
591. and Stennis does, too,
even if he doesn't admit it.
Copy !req
592. Well, the jury doesn't hate her.
Copy !req
593. Ah, but that's the secret, Tommy.
Copy !req
594. They don't need to hate her.
Copy !req
595. They just need to see a tiny
flaw in her, a half truth,
Copy !req
596. a small inconsistency,
just a little bit of doubt,
Copy !req
597. and they'll find against her.
Copy !req
598. Nice shoes.
Copy !req
599. You ready?
Copy !req
600. Come on.
Copy !req
601. Congress shall make
no law respecting an establishment
Copy !req
602. of religion or prohibiting
the free exercise thereof.
Copy !req
603. The first half of this passage
is known as the establishment clause.
Copy !req
604. The second half is known as
the free exercise clause.
Copy !req
605. Now, there has been an ongoing debate
Copy !req
606. about what the role
of government should be,
Copy !req
607. because in practice, these two provisions
Copy !req
608. are often in conflict,
Copy !req
609. which is what brings us here today.
Copy !req
610. In the matter of Thawley vs. Wesley,
Copy !req
611. is the plaintiff prepared to
make its opening statement?
Copy !req
612. We are, Your Honor.
Copy !req
613. Then proceed.
Copy !req
614. Ladies and gentlemen,
in a jury of this size,
Copy !req
615. I'm imagining that there are,
probably among your ranks,
Copy !req
616. a few Christians.
Copy !req
617. Hopefully practicing ones,
Copy !req
618. and that's a good thing, that's fine,
Copy !req
619. because Christianity is not on trial here,
Copy !req
620. even though my opponent will
try to convince you that it is.
Copy !req
621. Nor is faith on trial.
Copy !req
622. Only Ms. Wesley is on trial here today.
Copy !req
623. Now, ask any 4th grader
Copy !req
624. and they're probably
familiar with the phrase,
Copy !req
625. "Separation of church and state,"
Copy !req
626. and that is guaranteed
to us under our laws.
Copy !req
627. The plaintiffs
are the parents of a student
Copy !req
628. in Ms. Wesley's class
who was subjected to hearing
Copy !req
629. the teachings of Jesus Christ
being favorably compared
Copy !req
630. to the teachings of Mahatma Gandhi.
Copy !req
631. We all know that Jesus is part
Copy !req
632. of a particular religious tradition.
Copy !req
633. These parents, who are trying to raise
their daughter to be a free thinker,
Copy !req
634. free of any religious dogma,
Copy !req
635. are wholly offended by what
went on in that classroom.
Copy !req
636. And she, reciting the words
Copy !req
637. that were allegedly attributed to Jesus,
Copy !req
638. who allegedly lived 2,000 years ago,
Copy !req
639. gave a clear and compelling indication
Copy !req
640. of what she believes, what she supports,
Copy !req
641. what she endorses.
Copy !req
642. Now, let me put it this way.
Copy !req
643. I don't mean to offend anyone
who may be a Muslim here,
Copy !req
644. and I do not want to slight
the prophet of Islam,
Copy !req
645. but if you were to ask me a
question concerning the Quran,
Copy !req
646. the sacred text of Islam,
Copy !req
647. and I could come up with the answer
with great speed and accuracy,
Copy !req
648. and I could quote
the proper surah, or chapter,
Copy !req
649. then it would be reasonable
for you to infer
Copy !req
650. that I was not only a follower of Islam,
Copy !req
651. but that I considered it to be superior
Copy !req
652. to all other forms of religion.
Copy !req
653. If I did this in a house of
worship, that would be fine.
Copy !req
654. But if I did it in an 11th grade
classroom in a public school,
Copy !req
655. that would be preaching, not teaching.
Copy !req
656. So, why? Why in the world
are we here today?
Copy !req
657. Why? Because Ms. Wesley
refused to apologize,
Copy !req
658. and that means that her true motivation
in that moment in her classroom
Copy !req
659. was to take an innocent question
Copy !req
660. and turn it into an opportunity
to preach, not teach.
Copy !req
661. If we grant Ms. Wesley
the right to do that,
Copy !req
662. and by extension, everyone else,
Copy !req
663. to violate the law based solely
on our own private beliefs,
Copy !req
664. then our society will crumble.
Copy !req
665. I believe that.
Copy !req
666. So, I implore you, please
do not set this precedent.
Copy !req
667. Do not.
Copy !req
668. The future of our republic depends on it.
Copy !req
669. What's going on?
Copy !req
670. Brooke is exercising her right to protest.
Copy !req
671. Brooke, I need you
to stop this immediately.
Copy !req
672. Brooke, this is the last time
I'm gonna tell you.
Copy !req
673. If you don't stop right now,
there are gonna be consequences.
Copy !req
674. Hey, Aunt Amy.
Copy !req
675. Hey, Marlene.
Copy !req
676. Yeah, I just saw the video,
what's going on?
Copy !req
677. So, you remember my friend, Brooke?
Copy !req
678. Yeah.
Copy !req
679. Well, she got a teacher in trouble
for asking her about Jesus.
Copy !req
680. What?
Copy !req
681. Now she's not even
supposed to talk about it
Copy !req
682. and we can't even cover it
in our school paper.
Copy !req
683. Is there any way that
I could meet with her?
Copy !req
684. - The teacher?
- No, Brooke.
Copy !req
685. Mr. Endler, your opening statement.
Copy !req
686. Ladies and gentlemen of the jury,
I have here a copy of the Constitution
Copy !req
687. of the United States of America
and its Bill of Rights,
Copy !req
688. arguably the two most important documents
in the history of our great nation.
Copy !req
689. But despite Mr. Kane's
impassioned rhetoric,
Copy !req
690. you know what you won't find in there
no matter how hard you look?
Copy !req
691. The phrase "Separation
of church and state."
Copy !req
692. That's right.
Copy !req
693. It's not in there, never has been,
because that phrase comes from a letter
Copy !req
694. written by Thomas Jefferson.
Copy !req
695. Now, ironically, Jefferson was writing
to a Baptist congregation, ensuring them
Copy !req
696. that they would always have the right
Copy !req
697. to believe as they wished,
free of government interference.
Copy !req
698. But lately, that phrase has
been taken out of context
Copy !req
699. and twisted and contorted
to mean the exact opposite.
Copy !req
700. And one morning early this year,
my client, Ms. Wesley,
Copy !req
701. she woke up as usual, she drove
to work at her job as a teacher
Copy !req
702. at Martin Luther King High School,
Copy !req
703. a place where she was Teacher of the Year.
Copy !req
704. Her lesson plan
for second period A.P. history
Copy !req
705. that morning, it didn't include
any mention of God or Jesus.
Copy !req
706. She didn't have a Bible sitting
on her desk in plain view.
Copy !req
707. She didn't start her class
with a blessing.
Copy !req
708. She didn't lead her students in prayer.
Copy !req
709. No, all she did was answer a question,
Copy !req
710. because that is what she gets paid to do.
Copy !req
711. Now, Mr. Kane will insist loudly and often
Copy !req
712. that faith isn't on trial here,
Copy !req
713. but that is exactly what is on trial,
Copy !req
714. the most basic human right
of all, the right to believe.
Copy !req
715. Mr. Kane's afraid.
Copy !req
716. He's afraid that you, the jury,
the touchstone of common sense,
Copy !req
717. might not agree with
his tortured interpretation
Copy !req
718. of the Constitution,
Copy !req
719. that you might understand
that my client has rights,
Copy !req
720. rights that trump his agenda,
and that in realizing that
Copy !req
721. you will hold as I do
Copy !req
722. that my client is guilty of no wrongdoing
Copy !req
723. and innocent of any
and all claims against her.
Copy !req
724. Thank you very much.
Copy !req
725. And now it's become this huge deal,
Copy !req
726. and all she did was answer my question.
Copy !req
727. Why do you think your
parents are doing this?
Copy !req
728. Because my mom thinks
it'll help me get into Stanford
Copy !req
729. or one of the Ivys, and my dad
thinks it'll help pay for it.
Copy !req
730. And nobody's asked you what you think?
Copy !req
731. No.
Copy !req
732. So, are you gonna help her?
Copy !req
733. I don't know.
Copy !req
734. I would at least like to talk to her.
Copy !req
735. Maybe I could help get
her story out there.
Copy !req
736. Great, because everyone's
telling me to stay out of it.
Copy !req
737. Do you always do what you're told?
Copy !req
738. What is your heart telling you to do?
Copy !req
739. Mr. Thawley, how did
you feel when you found out
Copy !req
740. that your daughter had been exposed
Copy !req
741. to faith-based teachings in class?
Copy !req
742. Well, it felt like we had been violated.
Copy !req
743. I mean, this was supposed to be
a history class, not Sunday school.
Copy !req
744. My wife and I are free thinkers.
Copy !req
745. We're rationalists.
Copy !req
746. We believe in a non-theistic world view,
Copy !req
747. and that's how we were trying
to raise our daughter.
Copy !req
748. And did you discuss this
incident with your daughter?
Copy !req
749. Well, I tried, but it's hard discussing
anything with kids that age.
Copy !req
750. She's 16.
Copy !req
751. Some of you know what that's like.
Copy !req
752. It's hard enough trying to
maintain credibility as a parent
Copy !req
753. without a teacher jumping in
and arguing against your position.
Copy !req
754. Now, we trust the school
not to overstep its bounds
Copy !req
755. in terms of what is
and what isn't appropriate.
Copy !req
756. Is that too much to ask?
Copy !req
757. No. Thank you, Mr. Thawley.
Copy !req
758. That's all, Your Honor.
Copy !req
759. Your witness, Mr. Endler.
Copy !req
760. No questions, Your Honor.
Copy !req
761. Next witness, Mr. Kane.
Copy !req
762. Mrs. Rizzo, did Ms. Wesley
talk about faith issues
Copy !req
763. on the school campus?
Copy !req
764. All the time.
Copy !req
765. Everybody knows she's a Christian.
Copy !req
766. I don't think she'd chew a stick
of gum without praying first.
Copy !req
767. It makes everyone feel awkward.
Copy !req
768. Thank you.
Copy !req
769. No further questions, Your Honor.
Copy !req
770. Your witness, Mr. Endler.
Copy !req
771. Mrs. Rizzo, you stated that Ms. Wesley
talks about her faith all the time.
Copy !req
772. I'm curious, can you
give me a specific instance?
Copy !req
773. Well, not off the top of my head.
Copy !req
774. Well, has she, as far as you're aware,
ever started her class with a prayer?
Copy !req
775. No.
Copy !req
776. Has she ever asked anyone
in the teacher's lounge to pray with her?
Copy !req
777. No.
Copy !req
778. Has she ever asked you
personally to pray with her?
Copy !req
779. Objection, Your Honor.
Copy !req
780. - No.
- Cumulative.
Copy !req
781. The question has effectively
been asked and answered.
Copy !req
782. Your Honor, Mrs. Rizzo's
sworn testimony states
Copy !req
783. that Ms. Wesley talked
about her faith all the time,
Copy !req
784. yet she's failed to cite
a single instance.
Copy !req
785. I'm merely trying to discover
some basis for her opinion.
Copy !req
786. Sustained.
Copy !req
787. Mr. Endler, we're done with
this line of questioning.
Copy !req
788. Mrs. Rizzo,
in the school's initial inquiry
Copy !req
789. into this matter, you were
Ms. Wesley's representative
Copy !req
790. on behalf of the teacher's
union, were you not?
Copy !req
791. Yes.
Copy !req
792. And did you ever consider
that your disapproval
Copy !req
793. of her faith might taint your ability
Copy !req
794. to represent her properly?
Copy !req
795. Objection, speculative.
Copy !req
796. Sustained.
Copy !req
797. God bless you.
Copy !req
798. Careful, or you might end up on trial.
Copy !req
799. Mr. Endler!
Copy !req
800. No further questions, Your Honor.
Copy !req
801. So, when are these religious zealots
Copy !req
802. going to realize it's not only disrespectful
of them to push their beliefs on others,
Copy !req
803. in this case, it's actually illegal?
Copy !req
804. This woman, this fundamentalist,
used her position of influence
Copy !req
805. as a teacher to fill the minds
of our children with nonsense.
Copy !req
806. If you ask me, the religious extremists
Copy !req
807. we need to worry about
are the hard-core Christians.
Copy !req
808. How about we show up in force
and show Ms. Wesley just exactly
Copy !req
809. what we think of her proselytizing?
Copy !req
810. Principal Kinney, what was
the school district's final determination?
Copy !req
811. Well, Grace has been suspended without pay
Copy !req
812. pending the result of this trial.
Copy !req
813. Isn't it rather unusual,
leaving it up to a third party
Copy !req
814. to determine whether Ms. Wesley is fired?
Copy !req
815. We've decided to accept
Copy !req
816. the court's interpretation
of wrongdoing either way.
Copy !req
817. No questions, Your Honor.
Copy !req
818. Your witness, Mr. Endler.
Copy !req
819. Ms. Kinney, can you tell me
the full name of the high school
Copy !req
820. over which you preside?
Copy !req
821. Doctor Martin Luther King Junior
Memorial High School.
Copy !req
822. I noticed that the name fails to mention
Copy !req
823. Dr. King's title as Reverend Doctor.
Copy !req
824. It's his work in the field of civil rights
that we prefer to highlight.
Copy !req
825. But that's the whole point.
Copy !req
826. You consider his faith and politics
to be separate things,
Copy !req
827. but I don't,
and he certainly wouldn't have.
Copy !req
828. Objection, Your Honor.
Copy !req
829. Counsel is testifying.
Copy !req
830. Sustained.
Copy !req
831. Jury's instructed to ignore
Mr. Endler's preceding remarks.
Copy !req
832. Ms. Kinney, are you familiar with
Dr. King's letter from the Birmingham Jail?
Copy !req
833. Yes, it's a seminal
piece of civil rights history.
Copy !req
834. In that letter Dr. King makes numerous
faith-based references, does he not?
Copy !req
835. Offhand, I don't recall.
Copy !req
836. Allow me to refresh your memory.
Copy !req
837. He cites the example of the three youths
Copy !req
838. from the book of Daniel who were
tossed into the fiery furnace
Copy !req
839. by King Nebuchadnezzar because
they refused to worship him.
Copy !req
840. Elsewhere, he urges action with Jesus,
and here I quote, "Extremist love."
Copy !req
841. And in his speech,
"I've Been to the Mountaintop,"
Copy !req
842. he stated that he just wanted
to do God's will.
Copy !req
843. Is this coming back to you now?
Copy !req
844. Yes.
Copy !req
845. In your opinion, would Ms. Wesley,
Copy !req
846. had she chosen to do so,
have been allowed to present
Copy !req
847. the examples that I just
mentioned in her class?
Copy !req
848. Objection, speculative.
Copy !req
849. I'm going to allow it.
Copy !req
850. Overruled.
Copy !req
851. Witness may answer.
Copy !req
852. No.
Copy !req
853. If it were up to me, she would
not have been allowed.
Copy !req
854. Why not?
Copy !req
855. Because those examples
are too closely associated with faith.
Copy !req
856. In other words, they're facts,
Copy !req
857. but they're just facts that are
too dangerous for discussion?
Copy !req
858. The word I would use would be
"controversial."
Copy !req
859. But aren't facts just facts?
Copy !req
860. I mean, there's nothing controversial
Copy !req
861. about 2 plus 2 equaling 4,
or E equals MC squared,
Copy !req
862. or the date man landed on the moon.
Copy !req
863. So, why the controversy about these facts?
Copy !req
864. I think the fact that we're all
here today speaks for itself.
Copy !req
865. Thank you for your honesty.
Copy !req
866. One last question.
Copy !req
867. In your orientation
at the beginning of the semester,
Copy !req
868. your memo to the staff stressed
diversity and tolerance, did it not?
Copy !req
869. Yes.
Copy !req
870. Well, would it be fair to say
that except for Christianity,
Copy !req
871. all other forms of diversity are welcome?
Copy !req
872. Objection!
Copy !req
873. Your Honor!
Copy !req
874. I will withdraw the question.
Copy !req
875. Mr. Endler, you seem to have a penchant
Copy !req
876. for injecting commentary
where it doesn't belong.
Copy !req
877. You would do well to avoid
further provocation of this court.
Copy !req
878. I apologize, Your Honor.
Copy !req
879. I'll look to curtail it in the future.
Copy !req
880. Redirect, Your Honor?
Copy !req
881. Ms. Kinney, I understand
that you attended a service
Copy !req
882. at Ms. Wesley's church a short while ago.
Copy !req
883. Is that correct?
Copy !req
884. Yes, that's correct.
Copy !req
885. It was an event honoring several
students who attend that church
Copy !req
886. for their community service.
Copy !req
887. Mm-hmm.
Copy !req
888. And who was it that
invited you to that service?
Copy !req
889. Grace Wesley.
Copy !req
890. I see.
Copy !req
891. And where were you when
this invitation was extended?
Copy !req
892. At my office.
Copy !req
893. On school grounds?
Copy !req
894. Yes.
Copy !req
895. During work hours?
Copy !req
896. Yes.
Copy !req
897. Thank you.
Copy !req
898. Oh, one last question.
Copy !req
899. Is it true that Ms. Wesley
accepts donations
Copy !req
900. for a faith-based charity, Convoy of Hope,
Copy !req
901. right there in the classroom?
Copy !req
902. Yes, she does.
Copy !req
903. Thank you again.
Copy !req
904. No further questions, Your Honor.
Copy !req
905. You may step down, Mrs. Kinney.
Copy !req
906. Court's adjourned.
Copy !req
907. Grace, can I ask you a question,
Copy !req
908. off the record?
Copy !req
909. Sure.
Copy !req
910. These people, they're
looking to destroy you,
Copy !req
911. and I don't just mean financially.
Copy !req
912. Do you think it's worth it?
Copy !req
913. I hope so.
Copy !req
914. So do I.
Copy !req
915. Fishy and cheesy at the same time.
Copy !req
916. David, this tuna melt is exquisite.
Copy !req
917. Oh, yeah, exquisite.
Copy !req
918. It's the provolone.
Copy !req
919. That was my idea.
Copy !req
920. I love what it does
to the flavor of the fish.
Copy !req
921. Don't I know you?
Copy !req
922. You're from Blaze's Car Rental, right?
Copy !req
923. Oh, yeah.
Copy !req
924. Yeah, that gig didn't
really work out for me.
Copy !req
925. I don't think customer
service is my forte.
Copy !req
926. So, you decided to become a waiter?
Copy !req
927. Well, this is where
I do my dinner theatre.
Copy !req
928. In the mornings I serve up croissants.
Copy !req
929. In the evenings I serve up Chekhov.
Copy !req
930. Oh.
Copy !req
931. Hey, listen, sorry about
the whole car not working thing.
Copy !req
932. It's okay.
Copy !req
933. I learned my lesson.
Copy !req
934. He bought a Prius.
Copy !req
935. Starts every time.
Copy !req
936. Oh!
Copy !req
937. - Same guy.
- Same guy.
Copy !req
938. Amazing.
Copy !req
939. Gentlemen, I don't wanna
spoil your brunch,
Copy !req
940. but I'm hearing from a friend of mine
Copy !req
941. in the prosecutor's office
about a subpoena
Copy !req
942. that just came down
demanding that we submit
Copy !req
943. copies of our sermons for
the last 3 months for review.
Copy !req
944. Can they do that?
Copy !req
945. They tried it in Houston.
Copy !req
946. So, now the government can determine what
we can and can't preach at our churches?
Copy !req
947. Let's not overreact.
Copy !req
948. I'm sure there's no ill intent here.
Copy !req
949. Unfortunately, I think
this is just the beginning.
Copy !req
950. We've been ignoring it, and now
we're paying the price for it.
Copy !req
951. Well, don't forget the silent majority.
Copy !req
952. They're out there.
Copy !req
953. They just need something to stand for.
Copy !req
954. Well I'll admit there's pressure, but I
think with time this will correct itself.
Copy !req
955. Forgive me, but I think you're wrong.
Copy !req
956. I'm serving on a jury in a case right
now that touches on these issues.
Copy !req
957. And of course, I'm not allowed
to talk about it,
Copy !req
958. but I mean, the one thing
that it's convinced me of
Copy !req
959. is that if we stand by and do nothing,
Copy !req
960. pressure that we're feeling today
is gonna mean persecution tomorrow.
Copy !req
961. What makes you so sure?
Copy !req
962. Speed of change,
viciousness of the opposition.
Copy !req
963. The message of the gospel
has us standing in the way
Copy !req
964. of a lot of things
that powerful people want,
Copy !req
965. and our resistance to change that message
Copy !req
966. because it's not ours to change
has made us a lot of enemies.
Copy !req
967. Whether we admit it or not, we're at war,
Copy !req
968. the war of Ephesians 6,
not against flesh and blood,
Copy !req
969. but against the powers of this world,
Copy !req
970. against the spiritual forces
in the heavenly realms.
Copy !req
971. And if we insist on denying that,
Copy !req
972. then we've already lost.
Copy !req
973. I brought a giant bag of Chinese food
and a briefcase full of files.
Copy !req
974. I say we eat first.
Copy !req
975. I say you're a genius.
Copy !req
976. Does Walter want to join us?
Copy !req
977. Oh, no. He's hiding in his room.
Copy !req
978. How come?
Copy !req
979. He's treating this like it's a date,
Copy !req
980. which should give you some indication
of what my social life is like.
Copy !req
981. Don't worry, I won't tell.
Copy !req
982. Falls under attorney-client privilege.
Copy !req
983. So, is this what you always saw
yourself doing, the lawyer thing?
Copy !req
984. No, um...
Copy !req
985. I wanted to be Batman.
Copy !req
986. How 'bout you?
Copy !req
987. Your parents have you all set
to go to the convent?
Copy !req
988. Actually, there were no bedtime
prayers in my childhood.
Copy !req
989. I was raised in a house
without much faith.
Copy !req
990. When did you decide to become a Christian?
Copy !req
991. I was walking home from class.
Copy !req
992. It was dark, and I was
struggling with a lot of things.
Copy !req
993. And I turned the corner, and right
there in front of me was this church.
Copy !req
994. It had this old sign out front,
Copy !req
995. but it just stopped me in my tracks.
Copy !req
996. And the sign... the sign said,
Copy !req
997. "Who do you say that I am?"
Copy !req
998. And as I read it, I could hear
the Lord speak to me.
Copy !req
999. You know, I couldn't get that question
out of my head for days,
Copy !req
1000. so that was the start
of a journey that didn't end
Copy !req
1001. until I found the answer.
Copy !req
1002. That was beautiful.
Copy !req
1003. Forgive me, but I did
not know anyone was here.
Copy !req
1004. Oh, no. Please don't apologize.
Copy !req
1005. I didn't mean to interrupt.
Copy !req
1006. I just didn't know where else to go.
Copy !req
1007. I'm Martin.
Copy !req
1008. I'm Brooke.
Copy !req
1009. Do you think I could
ask you a few questions?
Copy !req
1010. That would be fine.
Copy !req
1011. Good, 'cause I have a lot.
Copy !req
1012. He doesn't make mistakes.
Copy !req
1013. But I thought you proved bias.
Copy !req
1014. I mean, Principal Kinney and Mrs. Rizzo?
Copy !req
1015. Those were just jabs.
Copy !req
1016. We need a knockout punch.
Copy !req
1017. Why did you feel compelled
Copy !req
1018. to bring Jesus up in history class?
Copy !req
1019. Why shouldn't I have?
Copy !req
1020. Grace, I'm not here to debate with you
what you think your rights were as...
Copy !req
1021. No, Tom, listen.
Copy !req
1022. This isn't about faith.
Copy !req
1023. This is about history.
Copy !req
1024. Okay, maybe I'm wrong here.
Copy !req
1025. I'm not the law expert,
Copy !req
1026. but I think they've missed the point.
Copy !req
1027. I'm not sure I follow.
Copy !req
1028. Their whole attack,
it's about me preaching in class,
Copy !req
1029. but I didn't do that.
Copy !req
1030. They're saying you did.
Copy !req
1031. You cited Scripture.
Copy !req
1032. You talked about Jesus'
teachings just like
Copy !req
1033. they were any other verifiable fact.
Copy !req
1034. But what if they're just that?
Copy !req
1035. I mean, just because certain
facts happen to be recorded
Copy !req
1036. in the Bible doesn't mean
they stop being facts.
Copy !req
1037. We can separate the history-based elements
Copy !req
1038. of Jesus' life from
the faith-based element.
Copy !req
1039. I mean, in my classroom,
I didn't talk about Jesus
Copy !req
1040. as my Lord and Savior.
Copy !req
1041. You know, all I did was
comment on quotations
Copy !req
1042. attributed to Jesus, the man,
and I did it in A.P. History.
Copy !req
1043. There was nothing wrong with the context.
Copy !req
1044. And any rule saying that you can talk about
any historic figure that ever existed
Copy !req
1045. except Jesus is discriminatory.
Copy !req
1046. They can't institute that.
Copy !req
1047. And every credible historian
admits that Jesus existed.
Copy !req
1048. I mean, there's just too much evidence.
Copy !req
1049. Grace, I love it.
Copy !req
1050. This is our defense.
Copy !req
1051. Jesus as a historic figure,
just like everyone else.
Copy !req
1052. And you know what?
Copy !req
1053. Kane will never see it coming.
Copy !req
1054. You got some reading to do.
Copy !req
1055. He just had so many notes
written in the margins
Copy !req
1056. that for the first time I felt like I was
Copy !req
1057. truly getting to know my brother.
Copy !req
1058. Like God gave me the extra 5 minutes
Copy !req
1059. that I so desperately needed with him.
Copy !req
1060. I just don't understand why he
never told me about his faith.
Copy !req
1061. Sharing one's faith with family,
Copy !req
1062. especially not knowing
how they will react,
Copy !req
1063. can be difficult.
Copy !req
1064. Count our struggles as blessings, right?
Copy !req
1065. That is exactly right.
Copy !req
1066. There are more than 5 minutes
awaiting you and your brother.
Copy !req
1067. John chapter 11, verse 25 to 26 says,
Copy !req
1068. "I am the resurrection and the life.
Copy !req
1069. "He who believes in me
will live even if he dies.
Copy !req
1070. "And whoever lives and believes in me
Copy !req
1071. will never die."
Copy !req
1072. Do you believe this?
Copy !req
1073. I do.
Copy !req
1074. Then invite him into your heart
Copy !req
1075. and make him the Lord of your life.
Copy !req
1076. Dear Lord, I'm not quite sure what to say,
Copy !req
1077. but thank you for dying
on the cross for me.
Copy !req
1078. Please forgive me of my sin.
Copy !req
1079. Jesus, please come into my life,
Copy !req
1080. and I will follow you
as my Lord and Savior.
Copy !req
1081. Amen.
Copy !req
1082. Thank you.
Copy !req
1083. Can you state your name
and occupation for the court?
Copy !req
1084. My name is Lee Strobel.
Copy !req
1085. I'm a professor of Christian thought
at Houston Baptist University
Copy !req
1086. and the author of more than
20 books about Christianity,
Copy !req
1087. including "The Case for Christ."
Copy !req
1088. Can you help me prove
the existence of Jesus Christ?
Copy !req
1089. Absolutely, beyond any reasonable doubt.
Copy !req
1090. How so?
Copy !req
1091. Actually, this court already affirmed it
Copy !req
1092. when we were called into session
and the date was given.
Copy !req
1093. Our calendar has been split
between B.C. and A.D.
Copy !req
1094. based on the birth of Jesus,
which is quite a feat if he never existed.
Copy !req
1095. Beyond that, historian Gary Habermas
Copy !req
1096. lists 39 ancient sources for Jesus,
Copy !req
1097. from which he enumerates
more than 100 reported facts
Copy !req
1098. about his life, teachings,
crucifixion, and resurrection.
Copy !req
1099. In fact, the historical evidence
for Jesus' execution
Copy !req
1100. is so strong that one of the most famous
New Testament scholars in the world,
Copy !req
1101. Gerd Ludemann of Germany,
said, "Jesus' death
Copy !req
1102. as a consequence of crucifixion
is indisputable."
Copy !req
1103. Now, there are very few facts
in ancient history
Copy !req
1104. that a critical historian
like Gerd Ludemann
Copy !req
1105. will say is indisputable.
Copy !req
1106. One of them is the execution
of Jesus Christ.
Copy !req
1107. Forgive me, but you're
a believer, are you not?
Copy !req
1108. A Bible-believing Christian?
Copy !req
1109. Guilty as charged.
Copy !req
1110. So, wouldn't this tend
to inflate your estimate
Copy !req
1111. of the probability that Jesus existed.
Copy !req
1112. No, because we don't need to inflate it.
Copy !req
1113. We can reconstruct
the basic facts about Jesus
Copy !req
1114. just from non-Christian sources
outside the Bible.
Copy !req
1115. And Gerd Ludemann is an atheist.
Copy !req
1116. In other words, we can prove
the existence of Jesus
Copy !req
1117. solely by using sources
that have absolutely
Copy !req
1118. no sympathy toward Christianity.
Copy !req
1119. As the agnostic historian,
Bart Ehrman, says,
Copy !req
1120. "Jesus did exist,
whether we like it or not."
Copy !req
1121. I put it this way:
Copy !req
1122. Denying the existence of Jesus
doesn't make him go away.
Copy !req
1123. It merely proves that no amount
of evidence will convince you.
Copy !req
1124. Thank you.
Copy !req
1125. No further questions, Your Honor.
Copy !req
1126. Mr. Kane, your witness.
Copy !req
1127. No questions, Your Honor.
Copy !req
1128. That's lunch.
Copy !req
1129. We'll recess until 2 p.m.
Copy !req
1130. Can I help you with something?
Copy !req
1131. Oh, hi.
Copy !req
1132. I was looking for Pastor Dave.
Copy !req
1133. My friend, Mina, she said
I should come see him.
Copy !req
1134. She said he's real easy to talk to.
Copy !req
1135. He won't be back until after next week.
Copy !req
1136. Oh, okay. Thanks.
Copy !req
1137. Sweeping is something I only do part-time.
Copy !req
1138. I enjoy it because it helps me think.
Copy !req
1139. But if you need to talk,
I'm actually a pastor.
Copy !req
1140. It's been 3 weeks since my doctors told me
Copy !req
1141. I was in remission.
Copy !req
1142. Oh, Amy, that's wonderful.
Copy !req
1143. It is.
Copy !req
1144. Yes.
Copy !req
1145. But even though I've been given this gift,
Copy !req
1146. I've been questioning my faith.
Copy !req
1147. I know Jesus existed,
but I'm struggling to believe.
Copy !req
1148. Actually, I think you already do believe,
Copy !req
1149. and the proof is you're
not willing to put God
Copy !req
1150. back on the shelf
now that your cancer is gone.
Copy !req
1151. He won't let you dismiss
the thought of him.
Copy !req
1152. Part of you senses Jesus' presence
Copy !req
1153. and wishes that he would just
go away and leave you alone.
Copy !req
1154. Actually, now that you mention it,
I had thought of that.
Copy !req
1155. Look, he delights in using us
in ways we never dreamed of
Copy !req
1156. and giving us things that we
never even knew we wanted.
Copy !req
1157. We just have to give him a chance.
Copy !req
1158. Will you?
Copy !req
1159. Thank you.
Copy !req
1160. Hi, I'm Reverend David Hill.
Copy !req
1161. Sermon transcripts, right?
Copy !req
1162. - Yes.
- Just put it right there.
Copy !req
1163. They've been coming in all morning.
Copy !req
1164. I'm sure they did what
they thought was best.
Copy !req
1165. That's it?
Copy !req
1166. Those are your entire sermons
for the past 120 days?
Copy !req
1167. No, that's a letter that I wrote explaining
why I'm not going to hand them in.
Copy !req
1168. Excuse me?
Copy !req
1169. I know it's unusual for a Christian pastor
to willfully resist a subpoena
Copy !req
1170. issued by a lawful government authority,
Copy !req
1171. and it's even more unusual
that he should feel compelled to do so.
Copy !req
1172. Are you sure you wanna do that?
Copy !req
1173. It's something that I have to do.
Copy !req
1174. You know the old saying, "The squeaky
wheel gets the grease," don't you?
Copy !req
1175. I have another saying:
Copy !req
1176. "A nail that sticks up
gets hammered down."
Copy !req
1177. Susan, what I'm seeing
is a teacher who answered
Copy !req
1178. a student's question
to the best of her ability.
Copy !req
1179. Amy, it sounds like you're taking
the side of Grace Wesley here.
Copy !req
1180. Surely, you see that she used
the student's question
Copy !req
1181. to promote her Christian agenda.
Copy !req
1182. Actually, Susan, that's not how I see it.
Copy !req
1183. I believe Ms. Wesley's entitled
to her own opinions,
Copy !req
1184. and that includes in the classroom.
Copy !req
1185. She didn't try to convert these
students, in fact...
Copy !req
1186. Amy, I must say,
I'm shocked at what seems to be
Copy !req
1187. a complete 180 from the typical
stance of your plot.
Copy !req
1188. Just look at the facts
of this case for a minute.
Copy !req
1189. She clearly infringed on
the rights of her students.
Copy !req
1190. Marlene?
Copy !req
1191. I have an idea.
Copy !req
1192. Come over as soon as you can, okay?
Copy !req
1193. You look terrible.
Copy !req
1194. You really ought to ask to be excused.
Copy !req
1195. No, no, I'm fine.
Copy !req
1196. I really need to be here.
Copy !req
1197. All rise.
Copy !req
1198. You may be seated.
Copy !req
1199. Juror number 12, is there
something you'd like to say?
Copy !req
1200. I'm sorry, Your Honor, I gotta...
Copy !req
1201. Bailiff, call paramedics.
Copy !req
1202. Sir.
Copy !req
1203. Well, I guess that proves there is no God,
Copy !req
1204. 'cause they just lost the only juror
they could count on.
Copy !req
1205. Any dizziness?
Copy !req
1206. - Yeah.
- Vomiting?
Copy !req
1207. About a half hour ago.
Copy !req
1208. Does this hurt? How 'bout this?
Copy !req
1209. I hope you're not
too attached to your appendix.
Copy !req
1210. Brooke! Marlene.
Copy !req
1211. It's not looking good in there.
Copy !req
1212. Ms. Marshall, are you prepared to fulfill
Copy !req
1213. your duties as an alternate?
Copy !req
1214. Yes, I am, Your Honor.
Copy !req
1215. Mr. Endler, next witness.
Copy !req
1216. Would you state your name
and experience for the record?
Copy !req
1217. My name is James Warner Wallace.
Copy !req
1218. I'm a retired homicide detective
from Los Angeles County.
Copy !req
1219. And are you the author of the
book, "Cold Case Christianity"?
Copy !req
1220. Yes, I am.
Copy !req
1221. "A Homicide Detective
Copy !req
1222. Investigates the Claims of the Gospels."
Copy !req
1223. Would I be correct in saying
that your duties as a homicide detective
Copy !req
1224. include investigating cold case homicides?
Copy !req
1225. Yes, that is and was my expertise.
Copy !req
1226. Don't most of those cases
get solved with DNA evidence?
Copy !req
1227. Objection, leading.
Copy !req
1228. And counsel is
testifying again, Your Honor.
Copy !req
1229. I'll rephrase.
Copy !req
1230. How many of your cold cases were solved
through the use of DNA evidence?
Copy !req
1231. None. Not one.
Copy !req
1232. That's often popular on TV, but our
departments never had the good fortune
Copy !req
1233. of solving a cold case with DNA.
Copy !req
1234. Well, how do most
of these cases get solved?
Copy !req
1235. Often by examining eyewitness claims,
Copy !req
1236. witness claims that were
made many years earlier,
Copy !req
1237. even though often our
witnesses are now deceased.
Copy !req
1238. Forgive my ignorance, Mr. Wallace,
but how is that possible?
Copy !req
1239. Well, we have a number
of techniques we can use
Copy !req
1240. to test the reliability of an eyewitness,
Copy !req
1241. including something called
forensic statement analysis.
Copy !req
1242. That's a discipline where we scrutinize
the statements of eyewitnesses
Copy !req
1243. and looking at what
they choose to minimize,
Copy !req
1244. what they choose to emphasize,
what they omit altogether,
Copy !req
1245. how they expand time or contract time.
Copy !req
1246. And when we examine these
kinds of eyewitness accounts,
Copy !req
1247. we can usually tell who's lying,
and who's telling the truth,
Copy !req
1248. and even who the guilty party is.
Copy !req
1249. And did you apply this skill set anytime
outside of your official capacity?
Copy !req
1250. Yes, I applied my expertise
to the death of Jesus
Copy !req
1251. at the hands of the Romans,
and I actually looked at the gospels
Copy !req
1252. as I would any other set
of forensic statements.
Copy !req
1253. Within a matter of months,
I determined that the four gospels,
Copy !req
1254. written from different perspectives,
Copy !req
1255. contained the eyewitness
accounts about the life,
Copy !req
1256. ministry, death,
and resurrection of Jesus.
Copy !req
1257. And did you consider that the four
accounts might be part of a conspiracy,
Copy !req
1258. designed to promote belief
in a fledgling faith?
Copy !req
1259. Yeah, you have to consider conspiracies
when assessing eyewitness accounts,
Copy !req
1260. but successful conspiracies typically
involve the fewest number of people.
Copy !req
1261. It's a lot easier for 2 people to lie
and keep a secret than it is for 20.
Copy !req
1262. And that's really the problem
with the conspiracy theories
Copy !req
1263. related to the apostles
in the 1st century.
Copy !req
1264. There are just far too many of them
trying to hold this conspiracy
Copy !req
1265. for far too long a period of time.
Copy !req
1266. And far worse, they're experiencing
pressure like no other,
Copy !req
1267. unimaginable pressure.
Copy !req
1268. Every one of these folks
was tortured and died
Copy !req
1269. for what they claimed to see, and none
of them ever recanted their story.
Copy !req
1270. So, the idea that this is a
conspiracy in the 1 st century
Copy !req
1271. is just really unreasonable.
Copy !req
1272. Instead, what I see in the gospels
Copy !req
1273. is something I call unintended
eyewitness support statement.
Copy !req
1274. What's an unintended
eyewitness support statement?
Copy !req
1275. If I can borrow your Bible?
Copy !req
1276. Let me go to the Gospel of Matthew
Copy !req
1277. for an example of this.
Copy !req
1278. I'll start with a passage
Copy !req
1279. in which Jesus is in front
of Caiaphas at a hearing.
Copy !req
1280. It says here, "Then they spit in his face
Copy !req
1281. "and struck him with their fists.
Copy !req
1282. "Others slapped him and said,
Copy !req
1283. 'Prophesy to us, Christ. Who hit you?"'
Copy !req
1284. Now, that seems like
a very simple request,
Copy !req
1285. given that the people who hit him
are standing right in front of him.
Copy !req
1286. This makes no sense.
Copy !req
1287. Why would it be prophecy to be
able to tell you who hit you?
Copy !req
1288. But it's not until you read Luke
that you get an answer to this.
Copy !req
1289. He says, "The men who were guarding Jesus
Copy !req
1290. "began mocking and beating him.
Copy !req
1291. "They blindfolded him and demanded,
Copy !req
1292. 'Prophesy, who hit you?"'
Copy !req
1293. So, now we know why this was a challenge,
Copy !req
1294. 'cause Luke tells us the
thing that Matthew left out,
Copy !req
1295. that he was actually blindfolded
at the time this took place.
Copy !req
1296. This is very common, this kind of
unintentional eyewitness support
Copy !req
1297. that fills in a detail
that the first witness left out.
Copy !req
1298. After years of scrutinizing
these gospels using the template
Copy !req
1299. that I use to determine
if an eyewitness is reliable,
Copy !req
1300. I concluded that the
four gospels in this book
Copy !req
1301. contained the reliable accounts
of the actual words of Jesus.
Copy !req
1302. And that's to include the statements
quoted by Ms. Wesley in her class?
Copy !req
1303. Absolutely.
Copy !req
1304. Thank you, Detective.
Copy !req
1305. Your witness.
Copy !req
1306. Detective Wallace,
Copy !req
1307. I'm not gonna try to match
biblical knowledge with you.
Copy !req
1308. But isn't it true that these
gospel accounts vary widely
Copy !req
1309. in what they say, that there are numerous
discrepancies between these accounts?
Copy !req
1310. Absolutely, but that's
exactly what we should expect.
Copy !req
1311. I don't quite understand that.
Copy !req
1312. Well, reliable eyewitness
accounts always differ slightly
Copy !req
1313. in the way they recall the story.
Copy !req
1314. They're coming to it from different
geographic perspectives, their history,
Copy !req
1315. even where they are located in the room.
Copy !req
1316. When I examined the gospels,
I was trying to determine
Copy !req
1317. if these were accurate, reliable accounts,
Copy !req
1318. in spite of any differences
there might be between the accounts.
Copy !req
1319. Ah, and as a devout Christian,
you feel you succeeded?
Copy !req
1320. Ah, Mr. Kane.
Copy !req
1321. I think you misunderstand me.
Copy !req
1322. When I began this study,
I was a devout atheist.
Copy !req
1323. I began examining the gospels
as a committed skeptic,
Copy !req
1324. not as a believer.
Copy !req
1325. You see, I wasn't raised
in a Christian environment,
Copy !req
1326. although I do think I have an unusually
high regard for the value of evidence.
Copy !req
1327. I'm not a Christian
because I was raised that way
Copy !req
1328. or because I hoped it would satisfy
some need or accomplish some goal.
Copy !req
1329. I'm simply a Christian
because it's evidentially true.
Copy !req
1330. Motion to strike, Your Honor.
Copy !req
1331. Granted.
Copy !req
1332. Jury's instructed to ignore
Detective Wallace's last remark.
Copy !req
1333. No further questions.
Copy !req
1334. Witness is excused.
Copy !req
1335. Thank you, Your Honor.
Copy !req
1336. Mr. Endler, your next witness.
Copy !req
1337. We don't have one, Your Honor.
Copy !req
1338. She didn't do anything wrong;
She was just trying to help me!
Copy !req
1339. Brooke!
Copy !req
1340. Order! I'll have order!
Copy !req
1341. Young lady, your youth is no excuse
for disturbing the sanctity of this court.
Copy !req
1342. But this case is supposed to be about me.
Copy !req
1343. I'm almost 17 years old;
It's not like I can't think for myself.
Copy !req
1344. I just don't have the right to speak.
Copy !req
1345. - Brooke, what are you doing?
- Not unless you are called
Copy !req
1346. as a witness, young lady.
Copy !req
1347. If I put her on the stand,
what am I gonna hear?
Copy !req
1348. That she asked a question
and I answered it.
Copy !req
1349. Your Honor, we'd like to call
Ms. Brooke Thawley to the stand.
Copy !req
1350. Objection, Your Honor!
Copy !req
1351. Ms. Thawley is a minor.
Copy !req
1352. Her parents do not want her subjected
to the emotional pressure
Copy !req
1353. of testifying against her own teacher.
Copy !req
1354. Ms. Thawley, are you willing
to testify on your own behalf?
Copy !req
1355. Yes, Your Honor.
Copy !req
1356. And do you understand
that you will have to answer
Copy !req
1357. all the questions truthfully,
regardless of your feelings,
Copy !req
1358. and that failure to do so
is punishable by law?
Copy !req
1359. Yes, Your Honor.
Copy !req
1360. I'm not afraid of telling the truth.
Copy !req
1361. I'm only afraid
of not being able to tell it.
Copy !req
1362. I will allow this witness.
Copy !req
1363. Objection overruled.
Copy !req
1364. Brooke, in class, who first
brought up the name "Jesus,"
Copy !req
1365. you or Ms. Wesley?
Copy !req
1366. I did.
Copy !req
1367. As part of a question?
Copy !req
1368. Yes.
Copy !req
1369. And at that time, did you feel like you
were asking a faith-based question?
Copy !req
1370. No, not really.
Copy !req
1371. It just seemed like
Martin Luther King and Jesus
Copy !req
1372. were saying similar things,
so I brought it up.
Copy !req
1373. And did you consider Ms. Wesley's response
Copy !req
1374. to be a reasonable answer
to your question?
Copy !req
1375. Yes.
Copy !req
1376. So, if I'm hearing you correctly,
Copy !req
1377. you asked a question in history
class about a historical figure,
Copy !req
1378. and your history teacher answered it
in a sensible manner?
Copy !req
1379. Yes.
Copy !req
1380. Thank you.
Copy !req
1381. Your witness.
Copy !req
1382. Ms. Thawley, do you like Ms. Wesley?
Copy !req
1383. Yes.
Copy !req
1384. Would you say she's your favorite teacher?
Copy !req
1385. Yes, absolutely.
Copy !req
1386. Do you think Ms. Wesley likes you?
Copy !req
1387. Objection, speculative.
Copy !req
1388. Your Honor, speaks to the state of mind
of the witness, if not Ms. Wesley herself.
Copy !req
1389. I'm gonna allow it. Overruled.
Copy !req
1390. You may answer the question.
Copy !req
1391. Yes, I think she likes me.
Copy !req
1392. Uh-huh.
Copy !req
1393. Do you think there's any possibility
that in answering your question,
Copy !req
1394. she may have tried to share
some of the ideas of her faith,
Copy !req
1395. a faith that she holds most dear?
Copy !req
1396. No, uh, no, not at that moment.
Copy !req
1397. Not at that moment.
Copy !req
1398. You mean to say that
there were other moments
Copy !req
1399. in which she talked to you
about her faith?
Copy !req
1400. Hmm? Ms. Thawley, please?
Copy !req
1401. You must answer the question, Ms. Thawley.
Copy !req
1402. Yes, but it was outside of school
and it was only one time.
Copy !req
1403. Move to strike.
Your Honor, this is irrelevant.
Copy !req
1404. No actions off the school
campus are at issue here.
Copy !req
1405. Denied.
Copy !req
1406. Mr. Kane seems to have
found a loose thread.
Copy !req
1407. I'm inclined to let him pull it.
Copy !req
1408. See what unravels.
Copy !req
1409. Thank you, Your Honor.
Copy !req
1410. Why didn't you tell me about this?
Copy !req
1411. You didn't ask,
and I didn't think it mattered.
Copy !req
1412. Brooke, you realize that
you have to tell the truth here.
Copy !req
1413. You understand that, correct?
Copy !req
1414. Yes.
Copy !req
1415. So, what did you mean when you said
Copy !req
1416. that you had talks
about faith outside of school?
Copy !req
1417. My brother died in an accident
Copy !req
1418. Ms. Wesley noticed that
I wasn't doing so well,
Copy !req
1419. so she asked me if everything
was all right after class.
Copy !req
1420. Mm-hmm.
Copy !req
1421. I told her I was fine, but I went
and found her later on at the coffee shop.
Copy !req
1422. And did Ms. Wesley refer you
Copy !req
1423. to any kind of psychological counseling?
Copy !req
1424. No.
Copy !req
1425. Did she suggest that perhaps
Copy !req
1426. she wasn't the right person
to be discussing this with you?
Copy !req
1427. No.
Copy !req
1428. Well, then what did Ms. Wesley do?
Copy !req
1429. She was really nice.
Copy !req
1430. We talked for a long time
and I could tell that she really cared.
Copy !req
1431. Mm.
Copy !req
1432. I asked her how she kept it all together
so well, and she said, "Jesus."
Copy !req
1433. So, she's the one who brought up Jesus?
Copy !req
1434. Did her endorsement of Jesus
move you to explore Christianity?
Copy !req
1435. Yes, at first.
Copy !req
1436. But when the Salvation Army came
to pick up my brother's things,
Copy !req
1437. one of the ladies found his
Bible, and she gave it to me.
Copy !req
1438. I didn't even know that he had one.
Copy !req
1439. Mm.
Copy !req
1440. So, I started reading it,
and once I started,
Copy !req
1441. I realized that I didn't wanna stop.
Copy !req
1442. That's why.
Copy !req
1443. That's why I came up with the
question that I asked in class.
Copy !req
1444. Now, if I understand you correctly,
Copy !req
1445. without Ms. Wesley's direct involvement,
Copy !req
1446. you never would've asked that question
in the first place, would you?
Copy !req
1447. I don't know.
Copy !req
1448. After all of your Bible readings,
Copy !req
1449. do you feel now that you're a believer?
Copy !req
1450. Yes.
Copy !req
1451. Maybe even a Christian?
Copy !req
1452. Yes.
Copy !req
1453. At the risk of seeming redundant,
Copy !req
1454. do you think any of this,
the Bible readings,
Copy !req
1455. the question about Jesus in class,
Copy !req
1456. the newfound commitment to Christianity,
Copy !req
1457. is it likely that any of that
would've occurred
Copy !req
1458. without Ms. Wesley's direct involvement?
Copy !req
1459. No, it wouldn't.
Copy !req
1460. I thank you for your honesty.
Copy !req
1461. No further questions, Your Honor.
Copy !req
1462. Mr. Endler, do you wish to redirect?
Copy !req
1463. No, Your Honor.
Copy !req
1464. You may step down, Ms. Thawley.
Copy !req
1465. Why do they look so angry?
Copy !req
1466. Because they think we lied to them.
Copy !req
1467. But we didn't.
Copy !req
1468. It doesn't matter.
Copy !req
1469. This court is adjourned.
Copy !req
1470. I have to prepare you, Grace.
Copy !req
1471. We're gonna lose this case.
Copy !req
1472. I know.
Copy !req
1473. You were right.
Copy !req
1474. I'm gonna lose everything.
Copy !req
1475. We saw a very large crowd
out here at the courthouse yesterday,
Copy !req
1476. both in protest and
support of teacher Grace Wesley,
Copy !req
1477. who is on trial for allegedly
proselytizing at the classroom.
Copy !req
1478. Now, in an unexpected move yesterday,
we saw some of Wesley's former students
Copy !req
1479. come out to silently demonstrate
their support for their teacher.
Copy !req
1480. Oh Father, please take this from me.
Copy !req
1481. I don't know what to do.
Copy !req
1482. Please don't forsake me.
Copy !req
1483. Please.
Copy !req
1484. Hey, Brooke.
Copy !req
1485. I ruined everything, didn't I?
Copy !req
1486. It's okay, you don't have to answer.
Copy !req
1487. I know that I did.
Copy !req
1488. I'm not even allowed to talk to her.
Copy !req
1489. How do I let her know that I'm sorry
without making things worse?
Copy !req
1490. I can't tell you what to do,
Copy !req
1491. but whatever you do,
just let her know you care.
Copy !req
1492. Recently, when I've been praying,
Copy !req
1493. it's like Jesus isn't letting me
feel his presence.
Copy !req
1494. Usually I can almost
reach out and touch him,
Copy !req
1495. but right now it's like
he's a million miles away.
Copy !req
1496. Honey, you of all people should realize
Copy !req
1497. when you're going through
something really hard,
Copy !req
1498. the teacher is always quiet
during the test.
Copy !req
1499. First of all,
this trial took an unexpected turn
Copy !req
1500. when Wesley's counsel decided they'd
try to prove the existence of Jesus.
Copy !req
1501. Gary, this is kind of
your area of expertise.
Copy !req
1502. How do you convince the skeptics?
Copy !req
1503. Well, Governor, I employ what
I call the minimal facts method,
Copy !req
1504. which uses only the historical events
Copy !req
1505. that are so well evidenced
that they're accepted across the board,
Copy !req
1506. even by skeptical
and non-Christian scholars.
Copy !req
1507. As a result, we...
Copy !req
1508. Now I understand what it is
you weren't allowed to talk about.
Copy !req
1509. I wish I still wasn't
allowed to talk about it.
Copy !req
1510. She needs me on that jury.
Copy !req
1511. Have faith, David.
Copy !req
1512. God's plan is at work.
Copy !req
1513. How'd you get here anyway?
Copy !req
1514. I borrowed your Prius. It's very nice.
Copy !req
1515. Don't get too comfortable.
I'm planning a full recovery.
Copy !req
1516. So, Rice, do you believe that she
was proselytizing to her students?
Copy !req
1517. Governor, not at all.
Copy !req
1518. Jesus Christ was the most
influential person who ever lived.
Copy !req
1519. How could you ignore
that fact and teach history?
Copy !req
1520. I think the real problem is...
Copy !req
1521. Hey, Martin!
Copy !req
1522. More questions?
Copy !req
1523. I wanted to make sure that you were okay.
Copy !req
1524. Yeah, I'm fine.
Copy !req
1525. They're just holding me
over for a little observation.
Copy !req
1526. I'll be released soon.
Copy !req
1527. Something different about you.
Copy !req
1528. Are you okay?
Copy !req
1529. I should say so.
Copy !req
1530. Yes.
Copy !req
1531. I believe God wants me to be a minister,
Copy !req
1532. to return to my country
and become a pastor,
Copy !req
1533. just like you.
Copy !req
1534. That's great.
Copy !req
1535. There'll be challenges in your country.
Copy !req
1536. Are you prepared for them?
Copy !req
1537. I am.
Copy !req
1538. I'm proud of you.
Copy !req
1539. Come here.
Copy !req
1540. That's awesome.
Copy !req
1541. It's a shocking reality
that Christians are soon gonna be forced
Copy !req
1542. to choose between obeying the law
of man or following the Word of God.
Copy !req
1543. I'm Mike Huckabee.
Copy !req
1544. We'll see you next time
on "Point of View."
Copy !req
1545. Hey, Brooke, why don't you
go be with Ms. Wesley.
Copy !req
1546. I think we can handle this.
Copy !req
1547. Yeah, seriously, we've got backup coming.
Copy !req
1548. You're covered.
Copy !req
1549. Go get 'em.
Copy !req
1550. God's got this.
Copy !req
1551. Where's Tom?
Copy !req
1552. All rise.
Copy !req
1553. Be seated.
Copy !req
1554. Are we missing someone?
Copy !req
1555. Sorry, Your Honor.
Copy !req
1556. My apologies to the court.
Copy !req
1557. That's unexpected.
Copy !req
1558. He almost looks like a lawyer.
Copy !req
1559. Your Honor, I have
one final witness to call.
Copy !req
1560. Grace Wesley.
Copy !req
1561. Ms. Wesley,
please approach the witness stand.
Copy !req
1562. Do I have to?
Copy !req
1563. I'm afraid so.
Copy !req
1564. Your Honor, given the
witness's reluctance to testify,
Copy !req
1565. can I have the court's permission
to treat her as a hostile witness?
Copy !req
1566. You may. Proceed at your own peril.
Copy !req
1567. Do you swear to tell the truth,
the whole truth, and nothing but the truth?
Copy !req
1568. I do.
Copy !req
1569. Please be seated.
Copy !req
1570. Grace, I want you to do something for me,
Copy !req
1571. something for everyone in this courtroom.
Copy !req
1572. I want you to apologize.
Copy !req
1573. I want you to say you're sorry
and that you made a mistake.
Copy !req
1574. Your Honor, what's going on here?
Copy !req
1575. Do it, Grace.
Copy !req
1576. I can't do that.
Copy !req
1577. Why? Why can't you do that, Grace?
Copy !req
1578. Because I don't believe
I did anything wrong.
Copy !req
1579. Well, as your attorney, I'm
advising you to do it anyway.
Copy !req
1580. To at least pretend that you're sorry and
throw yourself on the mercy of the court.
Copy !req
1581. What?
Copy !req
1582. That would be a lie.
Copy !req
1583. So what?
Copy !req
1584. Everyone lies.
Copy !req
1585. Not everyone.
Copy !req
1586. Are you looking to become a martyr?
Copy !req
1587. What in the world is he doing?
Copy !req
1588. I have no idea.
Copy !req
1589. No.
Copy !req
1590. Tommy...
Copy !req
1591. Then what is it that you want, Grace?
Copy !req
1592. Tell me. Tell us.
Copy !req
1593. I want...
Copy !req
1594. I want to be able to tell the truth.
Copy !req
1595. The truth?
Copy !req
1596. Whose truth?
Copy !req
1597. And what truth are you referring to?
Copy !req
1598. Grace, is there some truth that
you know that no one else knows?
Copy !req
1599. Oh, that's right.
Copy !req
1600. The other night, didn't you tell me
that Jesus spoke to you personally?
Copy !req
1601. Why are you doing this?
Copy !req
1602. I'm the one asking
the questions, Ms. Wesley.
Copy !req
1603. Did you or did you not tell me
Copy !req
1604. that Jesus spoke to you personally?
Copy !req
1605. Yes.
Copy !req
1606. And what did he say?
Copy !req
1607. I'll make it easier for you.
Copy !req
1608. Didn't you say that he
asked you a question?
Copy !req
1609. That was personal.
You weren't supposed to...
Copy !req
1610. I don't care.
Copy !req
1611. The other night, you told me
that Jesus asked you something.
Copy !req
1612. What did he ask you, Grace?
Copy !req
1613. Tell all of us.
Copy !req
1614. I think we deserve to know.
Copy !req
1615. Why are you doing this to me?
Copy !req
1616. Answer the question.
Copy !req
1617. They won't believe me.
Copy !req
1618. Doesn't matter.
Copy !req
1619. All that matters is that you believe it.
Copy !req
1620. Tell us, Grace, under penalty of perjury,
Copy !req
1621. what was the question that God
presented to you personally
Copy !req
1622. that night on campus?
Copy !req
1623. Answer the question.
Copy !req
1624. Answer the question!
Copy !req
1625. He asked, "Who do you say that I am?"
Copy !req
1626. And what did you answer?
Copy !req
1627. You are the Christ,
the Son of the living God.
Copy !req
1628. Well, there you have it.
Copy !req
1629. Your Honor, I think we've
all heard quite enough.
Copy !req
1630. Mr. Endler, are you
looking to change your client's plea?
Copy !req
1631. No, Your Honor.
Copy !req
1632. I say she's innocent of all wrongdoing.
Copy !req
1633. But I'm asking the jury
to find against her anyway.
Copy !req
1634. I mean, let's, let's face it.
Copy !req
1635. She has the audacity to believe
not only that there is a God,
Copy !req
1636. but that she has a personal
relationship with Him,
Copy !req
1637. which colors everything
that she says and does.
Copy !req
1638. I think it's time that we stop pretending
that we can trust a person like this
Copy !req
1639. to serve in a public capacity.
Copy !req
1640. In the name of tolerance
and diversity, I say we destroy her.
Copy !req
1641. That's enough, Mr. Endler.
Copy !req
1642. Then we can all go to our graves content,
Copy !req
1643. knowing that we stomped out
the last spark of faith
Copy !req
1644. that was ever exhibited
in the public square.
Copy !req
1645. That's enough, Mr. Endler.
Copy !req
1646. I say we make an example of her.
Copy !req
1647. Mr. Endler, that's enough.
Copy !req
1648. Let's set a new precedent, that employment
by our federal government mandates
Copy !req
1649. that you must first denounce
any belief system you have.
Copy !req
1650. Mr. Endler that is enough!
You are out of order.
Copy !req
1651. And if someone slips through the cracks
Copy !req
1652. and hides their beliefs,
then we arrest them and fine them.
Copy !req
1653. And if they don't pay,
then we seize their property.
Copy !req
1654. And if they resist...
Copy !req
1655. Well, let's not kid ourselves.
Copy !req
1656. Enforcement is always at the end of a gun.
Copy !req
1657. Mr. Endler, you are out of order.
Copy !req
1658. I charge you with contempt!
Copy !req
1659. I accept the charge, because I have
nothing but contempt for these proceedings.
Copy !req
1660. If we're going to insist that
a Christian's right to believe
Copy !req
1661. is subordinate to all other rights,
then it's not a right.
Copy !req
1662. Somebody is always going to be offended.
Copy !req
1663. Two thousand years of
human history proves that.
Copy !req
1664. So, I say we get on with it.
Copy !req
1665. Cite the law, charge the jury,
and send them off to deliberate.
Copy !req
1666. So be it!
Copy !req
1667. Now, we are gonna bypass
the usual closing arguments,
Copy !req
1668. unless Mr. Kane finds the need
to further address the jury.
Copy !req
1669. No, Your Honor.
Copy !req
1670. We can ask nothing more.
Copy !req
1671. My instructions to you are simple.
Copy !req
1672. Uphold the law without unfairly
prejudicing your decision
Copy !req
1673. or risking a mistrial on appeal.
Copy !req
1674. Now, I believe I can safely say
that the respondent's counsel
Copy !req
1675. has dared you to convict his own client.
Copy !req
1676. The jury will now be
dismissed for deliberation.
Copy !req
1677. We are adjourned.
Copy !req
1678. She hasn't got a prayer.
Copy !req
1679. Let's go.
Copy !req
1680. Remind me to send him a thank-you note.
Copy !req
1681. Thank you so much. Thank you, guys.
Copy !req
1682. Thanks for coming out.
Copy !req
1683. Hey, right now on the phone,
a friend of mine named Amy is on the line,
Copy !req
1684. and she's calling about a woman
who's on trial for her faith.
Copy !req
1685. This woman has risked
everything for Jesus.
Copy !req
1686. Amy's asked me to pray for this woman.
Copy !req
1687. Will you guys join me?
Copy !req
1688. Lord, we know that
to risk anything for you
Copy !req
1689. is a complete honor with eternal rewards.
Copy !req
1690. But if it's within your will,
Copy !req
1691. can you please restore this woman's hope
Copy !req
1692. and make her faith
an example to all of us?
Copy !req
1693. Lord, show your power to a fallen world.
Copy !req
1694. We know you have the power to do anything.
Copy !req
1695. So, we ask you right now, crying
out as the body of Christ,
Copy !req
1696. move those hearts of those people,
both the judge and the jury,
Copy !req
1697. to let them know the
beauty of your majesty.
Copy !req
1698. And we all said amen.
Copy !req
1699. Amen.
Copy !req
1700. Ladies and gentlemen
of the jury, have you reached a decision?
Copy !req
1701. We have, Your Honor.
Copy !req
1702. And how do you find?
Copy !req
1703. We, the jury, find in favor
of Grace Wesley.
Copy !req
1704. We are adjourned.
Copy !req
1705. Nice shoes.
Copy !req
1706. Grace, I'm sorry.
Copy !req
1707. I couldn't tell you.
Copy !req
1708. It had to come as a surprise,
Copy !req
1709. otherwise the jury wouldn't have
been swayed by your reactions.
Copy !req
1710. So, you did have a plan.
Copy !req
1711. No, you did.
Copy !req
1712. You stood up for what you believed in
and you held on to your faith.
Copy !req
1713. I don't know anybody
that would have done that.
Copy !req
1714. They were hoping to
make an example of you,
Copy !req
1715. but instead you became an inspiration.
Copy !req
1716. We did it!
Copy !req
1717. Hey, you've kept quiet long enough.
Copy !req
1718. Why don't you go share the good news?
Copy !req
1719. Hey, thank you.
Copy !req
1720. Yeah.
Copy !req
1721. God's not dead!
Copy !req
1722. A case that was turning for the worse
Copy !req
1723. was concluded with a powerful
happy ending for Ms. Grace Wesley.
Copy !req
1724. Live outside the courthouse
here in Hope Springs.
Copy !req
1725. Father. You did it!
Copy !req
1726. Ha ha ha ha ha!
Copy !req
1727. God is good.
Copy !req
1728. The verdict is in.
Copy !req
1729. Whoa, whoa, whoa, wait.
I want to hear this.
Copy !req
1730. In the case of Thawley v. Wesley,
they have ruled in favor of Grace Wesley.
Copy !req
1731. The crowd is in full celebration
here in Hope Springs.
Copy !req
1732. So are you gonna say it, or should I?
Copy !req
1733. Say what?
Copy !req
1734. God is good.
Copy !req
1735. All the time.
Copy !req
1736. And all the time.
Copy !req
1737. God is good.
Copy !req
1738. Amen, brother.
Copy !req
1739. I'll get to work on the appeal.
Copy !req
1740. Don't bother.
Copy !req
1741. If we appeal and lose,
it'll set a precedent.
Copy !req
1742. I don't want that.
Copy !req
1743. I don't understand how we lost this.
Copy !req
1744. He outsmarted us.
Copy !req
1745. He played our role in attacking Wesley.
Copy !req
1746. He made the jury hate everyone, but her.
Copy !req
1747. Not to mention he proved
the existence of Jesus Christ.
Copy !req
1748. God's not dead! He's surely alive!
Copy !req
1749. God's not dead! He's surely alive!
Copy !req
1750. God's not dead! He's surely alive!
Copy !req
1751. God's not dead! He's surely alive!
Copy !req
1752. God's not dead! He's surely alive!
Copy !req
1753. God's not dead! He's surely alive!
Copy !req
1754. God's not dead! He's surely alive!
Copy !req
1755. You know I'm gonna need my keys back.
Copy !req
1756. I know.
Copy !req
1757. Two days of ice chips. I'm starving.
Copy !req
1758. I'm hungry as well, David.
Copy !req
1759. How about I take you for a nice tuna melt?
Copy !req
1760. David Hill?
Copy !req
1761. Yes?
Copy !req
1762. You're under arrest.
Copy !req
1763. For what?
Copy !req
1764. Contempt of court.
Copy !req
1765. You failed to produce your
sermons upon court order.
Copy !req
1766. Please put your hands behind your back.
Copy !req
1767. Please be gentle.
Copy !req
1768. He has just been released
from the hospital.
Copy !req
1769. I don't understand.
Copy !req
1770. What is he being accused of?
Copy !req
1771. You have the right to remain silent.
Copy !req
1772. Anything you say can and will
be used against you
Copy !req
1773. in a court of law.
You have a right to an attorney.
Copy !req
1774. If you cannot afford an attorney,
one will be provided for you.
Copy !req
1775. Do you understand the rights
I have just read to you?
Copy !req
1776. Yes.
Copy !req
1777. Sorry about this, Pastor.
Copy !req
1778. It's okay.
Copy !req
1779. Looks like I'm gonna need you to fill
in for me a little while longer.
Copy !req
1780. Of course, David, anything you need.
Copy !req
1781. What do we do now?
Copy !req
1782. Same as always, Martin.
Copy !req
1783. We pray, in faith.
Copy !req
