71. If his date killed him

119. Bouncer handles that.Copy !req
120. Hey, Tony?Copy !req
121. Police.Copy !req
122. He come in here last night?Copy !req
123. Never seen him here,
but I know that face.Copy !req
124. I think he's a model
or something.Copy !req
125. Like in a magazine?Copy !req
126. No, posters.Copy !req
127. You know, the kindCopy !req
128. they plaster all over
those construction site fences?Copy !req
129. Lawbreakers.Copy !req
130. He said the poster
was advertisingCopy !req
131. some dating service.Copy !req
132. Sure it wasn't
Captain Zippy's Rave,Copy !req
133. or fantastic, potent,
herbal Viagra?Copy !req
134. This might
be something.Copy !req
135. "We chose the
path to love."Copy !req
136. That's him.Copy !req
137. Looking pretty heterosexual.Copy !req
138. ReGenesis.Copy !req
139. Doesn't sound like
a dating service.Copy !req
140. It's a Christian Ministry,Copy !req
141. advocating freedom
from homosexualityCopy !req
142. through prayer
and counseling.Copy !req
143. It started in the '80sCopy !req
144. as the so-called
"ex-gay" movement.Copy !req
145. Here we go, "ReGenesis."Copy !req
146. "A second chance
at a new beginning."Copy !req
147. Started by Kelly
and Derek Singer,Copy !req
148. both ex-gays themselves.Copy !req
149. So, former gays
turn gay bashers?Copy !req
150. Not quite.Copy !req
151. ReGenesis doesn't condemn
homosexuality outright,Copy !req
152. but it does believe
that it's a sin,Copy !req
153. and like all sins,
one has to resist itCopy !req
154. in order to enterCopy !req
155. the kingdom of God.Copy !req
156. Meaning, if I pray hard enough,
I'll be straight.Copy !req
157. Or celibate.Copy !req
158. Most ex-gays consider
themselves successfulCopy !req
159. if they resist
same-sex behavior.Copy !req
160. The movement's
still controversial.Copy !req
161. Yeah, but if somebody
really believesCopy !req
162. that being gay
is a sin,Copy !req
163. what's wrong with
trying to change?Copy !req
164. The assumption
that one can change.Copy !req
165. ReGenesis claims that members
of its ministry have actuallyCopy !req
166. become heterosexual,
but offer little proof.Copy !req
167. Most psychiatrists believe
it doesn't work.Copy !req
168. So, the poster boy for the
ex-gay movementCopy !req
169. is still sleeping with guys.Copy !req
170. I mean, that's going
to piss a few people off.Copy !req
171. Find out how much.Copy !req
172. And let's put a name
to this face.Copy !req
173. James Reed. I can't believe it.Copy !req
174. James Reed.Copy !req
175. When was the last
time you saw him?Copy !req
176. Over six months ago.Copy !req
177. I tried contacting him by phone.Copy !req
178. I-I sent letters,
and he never answered.Copy !req
179. Did you guys have
a falling out or something?Copy !req
180. He thought we
were judging him,Copy !req
181. but we loved James.Copy !req
182. As long as he was straight.Copy !req
183. No. That would make us
hypocrites.Copy !req
184. But your straight
now, right?Copy !req
185. So, you're following God's law,
but he wasn't.Copy !req
186. You think that we're just these
bunch of religious fanaticsCopy !req
187. who think God turned us
straight?Copy !req
188. It's a struggle, Detective.Copy !req
189. And Kelly and I fight it
together, every day.Copy !req
190. So, how was it that JamesCopy !req
191. wound up on the poster?Copy !req
192. It was his idea.Copy !req
193. He felt that people should knowCopy !req
194. you can be accountable to God
and have joy in your life.Copy !req
195. Homosexuality doesn't have
to control you.Copy !req
196. But he changed his
tune six months ago.Copy !req
197. He had doubts.Copy !req
198. I told him,
we all have crises of faith.Copy !req
199. In other words,
he had a boyfriend?Copy !req
200. Now, that doesn't look good
for ReGenesis.Copy !req
201. Are you suggesting
that we killed James?Copy !req
202. Someone may have felt betrayed.Copy !req
203. You have this ad campaign.Copy !req
204. Must have cost you a lot
of money.Copy !req
205. There's James Reed,
your poster boy for success,Copy !req
206. until he starts sleeping
with a bunch of guys again.Copy !req
207. It makes your organization look
like a sham.Copy !req
208. I wouldn't have cared
if James hadCopy !req
209. 100 boyfriends,
if it made him happy.Copy !req
210. I knew it didn't.Copy !req
211. Look, we were just hoping
James would come back.Copy !req
212. We would have welcomed him.Copy !req
213. Yeah, you wrote him, uh,
those letters?Copy !req
214. Yeah. We'll need that address.Copy !req
215. There's no blood.Copy !req
216. Doesn't look like James Reed
was killed in his apartment.Copy !req
217. A syllabus
for a clinical psych class,Copy !req
218. Hudson University.Copy !req
219. Looks like he was going
for his masters.Copy !req
220. "Me and Phil,
Thousand Islands, June '03."Copy !req
221. They're happy.Copy !req
222. Unless Phil's the one
he spent his last night with.Copy !req
223. Look at this.Copy !req
224. Four letters from Derek Singer,
all unopened.Copy !req
225. I guess
he was telling the truth.Copy !req
226. Those two were depressing.Copy !req
227. Trying to convince themselvesCopy !req
228. and everybody else
that they're happy.Copy !req
229. Maybe they are.Copy !req
230. Elliot, you can't tell meCopy !req
231. that repressing
your sexual desiresCopy !req
232. makes a gay person
a good Christian.Copy !req
233. I don't know.Copy !req
234. Maybe some people choose
to be gay,Copy !req
235. others choose to be straight.Copy !req
236. Oh, so you chose
to be heterosexual?Copy !req
237. Me? No.Copy !req
238. Check this out.Copy !req
239. "All queersCopy !req
240. "will burn in the eternal fireCopy !req
241. of hell, so sayeth the Lord."Copy !req
242. Somehow I don't think
that's a direct quote.Copy !req
243. Hate mail.Copy !req
244. Yeah, about 20,
30 pieces of it,Copy !req
245. all coming
from Nebraska.Copy !req
246. No return address.Copy !req
247. I guess word
of Reed's defection slipped out.Copy !req
248. Let's see if the boyfriendCopy !req
249. in the picture knows
who sent them.Copy !req
250. Phone number for Phil Sona.Copy !req
251. I read about James' deathCopy !req
252. in the paper.Copy !req
253. I'm just
sick about it.Copy !req
254. I find it odd you didn't report
your boyfriend missing,Copy !req
255. though, Doctor Phil.Copy !req
256. Ex-boyfriend.Copy !req
257. We broke up
three months ago,Copy !req
258. but James doesn't
have any family,Copy !req
259. so I'm taking careCopy !req
260. of the funeral
arrangements.Copy !req
261. Look, I know
you guys have
a job to do,Copy !req
262. but I didn't
kill James.Copy !req
263. I was at a seminar
in DetroitCopy !req
264. the night he died.Copy !req
265. Why the breakup?Copy !req
266. Just wasn't the
love of my life.Copy !req
267. I wasn't his, either.Copy !req
268. We both got what we
needed at the time.Copy !req
269. A reason to leave ReGenesis.Copy !req
270. That is where we met.Copy !req
271. Taking the reorientation
therapy, support groups,Copy !req
272. prayer groups.Copy !req
273. Then we turned to each other.Copy !req
274. We're, like, "What the hell are
we doing here?"Copy !req
275. You thought the whole
thing was a crock?Copy !req
276. No. For a long time,Copy !req
277. I thought things would be easierCopy !req
278. if I was straight.Copy !req
279. Now, I can't imagine wanting
to be anybodyCopy !req
280. other than who I am.Copy !req
281. And that is the one good thingCopy !req
282. that I learned at ReGenesis.Copy !req
283. Do you thinkCopy !req
284. that any ReGenesis member
would be angry enoughCopy !req
285. to go after James?Copy !req
286. I doubt it. They're
basically good people.Copy !req
287. They just believeCopy !req
288. that God has given them
a road map for how to live.Copy !req
289. And I don't think
it's that easy.Copy !req
290. These letters—Copy !req
291. you know who
wrote them?Copy !req
292. If that's more
hate mail,Copy !req
293. it could have been anybody.Copy !req
294. James had written some
angry articlesCopy !req
295. bashing ReGenesis.Copy !req
296. I said, "You're making a target
of yourself."Copy !req
297. Dr. Sona, James
may have beenCopy !req
298. with a man the night
he was murdered.Copy !req
299. Do you know
if he had a new boyfriend?Copy !req
300. He said he was seeing somebody.Copy !req
301. I don't know who.Copy !req
302. It didn't sound
like it was going to work out.Copy !req
303. The guy was way in the closet.Copy !req
304. Maybe he'll come outCopy !req
305. long enough to
attend the funeral.Copy !req
306. What the hell is this?Copy !req
307. Devoted members
from the Church of
Eternal Providence,Copy !req
308. visiting from beautiful
Danville, Nebraska.Copy !req
309. Found our hate mailers.Copy !req
310. They got permits
for the sidewalk.Copy !req
311. I'm waiting for one of them
to step over it,Copy !req
312. so I can shut 'em up.Copy !req
313. You get a
line on the
boyfriend?Copy !req
314. So far, nobody claims to be,Copy !req
315. or claims to know
who was dating Reed.Copy !req
316. God hates you,Copy !req
317. you hypocrites!
Get the hell out of here.Copy !req
318. The Lord saidCopy !req
319. all sodomites should be put
to death.Copy !req
320. Whoa, his might has been shown
to all those who believe...Copy !req
321. Are you just going
to stand here and
let them do this?Copy !req
322. Dr. Sona, just walk,
come on.Copy !req
323. The Reverend has a right
to free speech.Copy !req
324. The Lord Almighty
killed James ReedCopy !req
325. for being a disgusting faggot...Copy !req
326. Oh yeah, that's right.Copy !req
327. We're all fags,
and we're not
going anywhere.Copy !req
328. He's burning for all eternity
in the flames of hell.Copy !req
329. All you want,
we're going to
be sitting here,Copy !req
330. laughing our
asses off.Copy !req
331. Okay, the protest is over Rev.Copy !req
332. This is a legal demonstration.Copy !req
333. Well, not anymore.
Look down.Copy !req
334. You're trespassing.Copy !req
335. Reverend Mitchell Shaw.Copy !req
336. You really get around.Copy !req
337. Protesting in Vermont,
at the Supreme Court...Copy !req
338. cheering at the funeralCopy !req
339. of a six-year-old
who died of AIDS.Copy !req
340. Maybe you should switch
to a career in publicity.Copy !req
341. The Lord asked me
to do his work.Copy !req
342. Did he ask you to ignore
all that, uh...Copy !req
343. "Love thy neighbor" stuff?Copy !req
344. "If a man also lie with mankind,
as he lieth with a woman,Copy !req
345. "both of them have committed
an abomination.Copy !req
346. "They shall surely
be put to death.Copy !req
347. Their blood shall be upon them."Copy !req
348. Leviticus.Copy !req
349. The Bible also says
I can sell my daughtersCopy !req
350. into slavery and be put to death
if I work on Sundays.Copy !req
351. Twelve years of Catholic school.Copy !req
352. Anybody can memorize
the words, Reverend.Copy !req
353. Doesn't make them righteous.Copy !req
354. This city is full of sodomites,Copy !req
355. and you waste your time
protecting them...Copy !req
356. and yet you wonder why
so many other NYPD brothersCopy !req
357. were struck down
on September 11.Copy !req
358. Do you not seeCopy !req
359. the Lord's judgment upon you?Copy !req
360. I see a scared, shriveled
up piece of trashCopy !req
361. who uses God to
justify his bigotry.Copy !req
362. This guy doesn't
believe half of
what he says, Elliot.Copy !req
363. He's trying to get
his name in the papers.Copy !req
364. I speak the truth.Copy !req
365. Well, then, you won't deny
calling James Reed a fag...Copy !req
366. an AIDS-infested fag.Copy !req
367. You can't prosecute me
for writing letters.Copy !req
368. We can if you killed the guy.Copy !req
369. The Lord passed his own
judgment on James Reed.
You're just doingCopy !req
370. his work for him? Is that it?Copy !req
371. I wish I hadCopy !req
372. sent Reed to hell...Copy !req
373. but I was a thousand miles away.Copy !req
374. Go back in there and strangle
the son-of-a-bitch.Copy !req
375. I love the guy; I want to invite
him to the Christmas Party.Copy !req
376. The Lord spoke to him.Copy !req
377. The Lord sent an angel to talk
to the mother of his only son,Copy !req
378. but he spoke to Reverend Shaw.Copy !req
379. He's a very special guy.Copy !req
380. How's his alibi?Copy !req
381. Danville PD confirmed it.Copy !req
382. Had their hands full
with another picketCopy !req
383. organized by the reverend
the night of Reed's murder.Copy !req
384. Then he's nothing to us.Copy !req
385. Cut him and the rest
of his people loose.Copy !req
386. He targeted Reed.Copy !req
387. One of his followers
could've taken him seriously.Copy !req
388. You connect one of the members
of Shaw's congregationCopy !req
389. to the murder,
I might be able to get himCopy !req
390. on the fighting words doctrine.Copy !req
391. Till then, First Amendment saysCopy !req
392. he can enjoy his civil liberties
like everybody else.Copy !req
393. We'll check out his followers
anyway.Copy !req
394. In the meantime, if we're
thinking Reed's killerCopy !req
395. was the last person
he slept with,Copy !req
396. there's a real problem
with this theory.Copy !req
397. None of Shaw's people would ever
have had sex with Reed.Copy !req
398. They just would have killed him.Copy !req
399. Well, we've still got
the mystery boyfriend
out there somewhere.Copy !req
400. What'd you get from the people
at Reed's funeral?
Not much.Copy !req
401. After the fight broke out,
a bunchCopy !req
402. of people left
before we got their names.Copy !req
403. Yeah, but we got
their pictures.Copy !req
404. Where the hell's that from?
One of Reverend Shaw'sCopy !req
405. church members— he must
have left it behind.Copy !req
406. I didn't hear that.
Get it back to him, John.Copy !req
407. I'll be happy to—
I'd even develop
his film for free.Copy !req
408. Show the picturesCopy !req
409. to the people you talk
to at Reed's funeral.Copy !req
410. Maybe they can help ID
the ones that got away.Copy !req
411. I told you at the cemetery I...Copy !req
412. I really only knew James
as his advisor.Copy !req
413. I-I-I don't know
his friends.Copy !req
414. And he never mentioned
dating anyone, Dr. Waldman?Copy !req
415. All we talked about
was his research.Copy !req
416. A shame— it was shaping up
to be quite provocative.Copy !req
417. How so?
He was planning
a long-term studyCopy !req
418. on reparative therapy:Copy !req
419. the idea that same-sex
attraction is a formCopy !req
420. of arrested development
and can be cured.Copy !req
421. Don't most shrinks
think that's crap?Copy !req
422. They do. Reparative therapy
is experimentalCopy !req
423. and unproven at best.Copy !req
424. And at worst?Copy !req
425. Early research indicatesCopy !req
426. that patients can develop
anxiety, depression,Copy !req
427. and an increased risk
of suicide.Copy !req
428. Now, what's so provocative
about James' research?Copy !req
429. That reparative
therapists knowCopy !req
430. their treatment
doesn't work,Copy !req
431. yet they prey
on vulnerable patients,Copy !req
432. and take their money
for a snake oil cure.Copy !req
433. That could've ruined
a few careers.Copy !req
434. Might be a motive
for murder.Copy !req
435. I'd agree, except no one
outside the three professorsCopy !req
436. on the thesis committee
had read the proposal.Copy !req
437. We're going to
need their names.Copy !req
438. Of course.Copy !req
439. Actually, there was
a fourth professor,Copy !req
440. but he resigned.Copy !req
441. And who was that?Copy !req
442. Roger Tate.Copy !req
443. He's a proponent
of reparative therapy,Copy !req
444. which is why I wanted him
to sit on the committee,Copy !req
445. but he thought there wereCopy !req
446. methodological problems
with the study.Copy !req
447. We want to talk
to him first.Copy !req
448. Mr. Reed and I
had differences of opinion,Copy !req
449. but I liked and respected him.Copy !req
450. We've debated each other
over the past few monthsCopy !req
451. in several symposiums.Copy !req
452. These debates, um...Copy !req
453. he thought being gay was okay,
and you didn't?Copy !req
454. I personally
have nothingCopy !req
455. against homosexuals,Copy !req
456. but Mr. Reed believed
homosexualityCopy !req
457. was a natural occurring variant,Copy !req
458. like left-handedness.Copy !req
459. I believe it's
a complex pathology.Copy !req
460. And you can cure it?Copy !req
461. No,Copy !req
462. but by understanding
the root of their neurosis,Copy !req
463. they can begin to control
their neurotic tendencies.Copy !req
464. When homosexuals know
the causes of their condition,Copy !req
465. they're more able to change
their behaviorCopy !req
466. if they choose to do so.Copy !req
467. So, what causes that condition?Copy !req
468. My research has shown
that an over-bearing motherCopy !req
469. combined with a distant fatherCopy !req
470. often influences
psycho-sexual development.Copy !req
471. A boy longs for a relationship
with the father,Copy !req
472. and when he doesn't get it,
he seeks it out in other men.Copy !req
473. It must have
really burned youCopy !req
474. that Reed's research was going
to torpedo all your work...Copy !req
475. or at least torpedo your wallet.Copy !req
476. His methods
were shoddy.Copy !req
477. I doubt if his research
would ever have been published.Copy !req
478. I may have disagreed
with Mr. Reed,Copy !req
479. but I didn't hate him.Copy !req
480. If nothing else,
I felt sorry for him.Copy !req
481. I treat men every day
who are trying to fillCopy !req
482. their empty lives
with anonymous sexCopy !req
483. and loveless
relationships.Copy !req
484. Reed spent so much energy
trying to convince himselfCopy !req
485. that he was normal, happy...Copy !req
486. but how could he have been?Copy !req
487. If an over-bearing motherCopy !req
488. and a distant father
cause homosexuality,Copy !req
489. how come I'm not gay?Copy !req
490. Maybe you're in denial.Copy !req
491. That'd explain a lot.Copy !req
492. Excuse me, was
that Elliot Stabler?Copy !req
493. No, that's Ian,
Dr. Tate's son.Copy !req
494. My mistake.Copy !req
495. What was that?Copy !req
496. I recognized him
from his picture.Copy !req
497. Ian Tate at Reed's funeral,Copy !req
498. 20 years old, no record,Copy !req
499. enrolled in a university
upstate,Copy !req
500. dropped out halfway
through the first semester.Copy !req
501. Now he's at a community college.Copy !req
502. His mother died when
he was 12 years old.Copy !req
503. His father pays
for his apartment,Copy !req
504. which is half a block away
from where we found
James Reed's body.Copy !req
505. We dumped Ian and
Reed's phones.Copy !req
506. Past two months, there
were over 50 calls,Copy !req
507. including one
from Ian to ReedCopy !req
508. the night he
was killed.Copy !req
509. They knew each other
well enoughCopy !req
510. for Ian to go to his funeral.
So, we're sayingCopy !req
511. Dr. Homophobe's son is gay
and killed his boyfriend?Copy !req
512. Well, if he was ashamed
of his sexual identity,Copy !req
513. then he may have been drivenCopy !req
514. to destroy the man
who personified it.Copy !req
515. With a father
like Tate,Copy !req
516. no wonder he'd try
to hide it.Copy !req
517. "You're not gay, son,
you're just crazy."Copy !req
518. A lot of gay
people sufferCopy !req
519. from some kind
of internalized homophobia.Copy !req
520. They all grew up
in the same culture that we did,Copy !req
521. where being gay
was considered weird,Copy !req
522. or sick, or evil.Copy !req
523. Combine that with Dr. Tate
spending yearsCopy !req
524. promoting the idea
that homosexualityCopy !req
525. is unacceptable...
Son must hate himself.Copy !req
526. And he might do anything
to keep the illusionCopy !req
527. that he was straight.Copy !req
528. See if you can break it.Copy !req
529. Ian Tate!Copy !req
530. We need to talk to you.Copy !req
531. Why don't you come
on down to the
station with us?Copy !req
532. I can't. I've
got class.Copy !req
533. I'm already late.Copy !req
534. It's about
James Reed.Copy !req
535. Never heard of him.Copy !req
536. You've never heardCopy !req
537. of him— you've
been talkingCopy !req
538. to him for two months.Copy !req
539. We've got the phone
records to prove it.Copy !req
540. He's dead.Copy !req
541. I didn't do it.
Ian...Copy !req
542. there's lots of ways
this could have gone down.Copy !req
543. You guys were together,
you got into a fight,Copy !req
544. things got out of hand...
That's sick.Copy !req
545. He was harassing me.Copy !req
546. Why?Copy !req
547. Because of my father.Copy !req
548. I met him at one of Dad's talks.Copy !req
549. Guy just starts in on me.Copy !req
550. Freaking faggot.
Faggot?Copy !req
551. Boy, Ian, buddy, you're
a walking cliché.Copy !req
552. Most homophobes are
actually repressed
homosexuals,Copy !req
553. you know that?Copy !req
554. This is going to be a lot easier
if you're honest with us.Copy !req
555. I'm not gay...Copy !req
556. and I didn't kill him.Copy !req
557. You get it?
Need some help?Copy !req
558. Why don't you come
with us down to the station.Copy !req
559. Give us a DNA sample,Copy !req
560. we'll leave you alone.Copy !req
561. No.Copy !req
562. Don't have cause
to compel a swab.Copy !req
563. Why don't we collect ourselves
some evidence?Copy !req
564. Faulty dryer maybe?Copy !req
565. Public area, don't
need a warrant.Copy !req
566. This one looks
clean, too...Copy !req
567. but it's barely
giving off any heat.Copy !req
568. This one's on fire.Copy !req
569. Liv...Copy !req
570. That looks likeCopy !req
571. blue melted nylon to me.Copy !req
572. And that should
get us a warrantCopy !req
573. for Ian's apartment.Copy !req
574. Place has been cleaned.Copy !req
575. It smells like somebody painted
in here.Copy !req
576. Guy had drywall
in his hair.Copy !req
577. His walls aren't
even chipped.Copy !req
578. The mattress looks
like it's brand new.Copy !req
579. Luminol didn't pick up
any blood.Copy !req
580. He didn't bleed that much.Copy !req
581. Elliot...Copy !req
582. feel that.Copy !req
583. It's uneven.Copy !req
584. Like it's just been patched.Copy !req
585. Right at head level.Copy !req
586. Got a saw?
Yeah.Copy !req
587. Bring it.Copy !req
588. What the hell is this?Copy !req
589. Sorry, you're not allowed
in here.Copy !req
590. What are you doing?Copy !req
591. Where's your warrant?Copy !req
592. Enjoy.Copy !req
593. I'm calling
a lawyer.Copy !req
594. You can't destroy
private property.Copy !req
595. Ian, let's go.Copy !req
596. Let's see what we
find here first—
just relax.Copy !req
597. I got blood...
and hair.Copy !req
598. All that plastering
for nothing, huh?Copy !req
599. All right, Tate,
you're under arrestCopy !req
600. for the murder
of James Reed.Copy !req
601. Don't say anything.
I'm getting you a lawyer.Copy !req
602. Say nothing.Copy !req
603. Docket ending 247,Copy !req
604. the People vs. Ian
Alexander Tate.Copy !req
605. One count murder
in the second degree.Copy !req
606. Emma Dishell
for the defense.Copy !req
607. How does the
defendant plead?Copy !req
608. Not guilty.Copy !req
609. Your thoughts on bail,
Ms. Novak?Copy !req
610. The People request remand,
Your Honor.Copy !req
611. The defendant committed murder
because of his hatredCopy !req
612. for homosexuals.Copy !req
613. We consider him
a danger to the
community.Copy !req
614. My client was
defending himselfCopy !req
615. after being sexually
assaulted by the decedent.Copy !req
616. Your Honor, there was no
evidence or report of assault.Copy !req
617. In fact, this is the first time
anyone's mentioned it.Copy !req
618. And as the ADA
for Special Victims,Copy !req
619. you should know
that rape victimsCopy !req
620. often delay reporting
their attacks.Copy !req
621. The defendant's semen
was found at the scene.Copy !req
622. If a woman
has an orgasmCopy !req
623. when she's raped, does that mean
she really wanted it?Copy !req
624. Eh, that's beyond the scope
of these proceedings.Copy !req
625. Now, you say you have proof
of a rape,Copy !req
626. Ms. Dishell, uh, present
it to a trial judge.Copy !req
627. Until then,
the defendant's remanded.Copy !req
628. Next case.Copy !req
629. Ian Tate wasn't raped.Copy !req
630. It's just a lame attempt
at a gay panic defense.Copy !req
631. He came on to me
so I killed him.Copy !req
632. That defense
rarely works.Copy !req
633. You know the trial judge
in the Matthew Shepard caseCopy !req
634. didn't even allow that
theory to be presented.Copy !req
635. But in New York, gay panic fallsCopy !req
636. under extreme emotional
disturbance.Copy !req
637. And juries still don't buy it.Copy !req
638. Then why are you
so worried?Copy !req
639. Because you know this isn't
about the letter of the law.Copy !req
640. It's about the jury
and their prejudices.Copy !req
641. And if even one juror thinksCopy !req
642. that gays are predators
and sinners,Copy !req
643. then your murder conviction
gets knocked downCopy !req
644. to manslaughter.Copy !req
645. If not an acquittal.Copy !req
646. The Supreme Court
may have advancedCopy !req
647. gay rights in that
Texas case,Copy !req
648. but they also incited
a bit of backlash.Copy !req
649. All right, so what am I
supposed to do about that?Copy !req
650. Take the juice out
of the defense.Copy !req
651. Prove the defendant
himselfCopy !req
652. is a homosexual, and gay panic
goes out the window.Copy !req
653. You can't lose your mind
over a homosexual advanceCopy !req
654. if you're gay.Copy !req
655. Now, the tricky part is
not playing the politics.Copy !req
656. They want to make this about
straight versus gay.Copy !req
657. You make it about murder.Copy !req
658. Ian Tate is a loner.Copy !req
659. I mean, the only person
that he talks toCopy !req
660. on a regular basis
is his father.Copy !req
661. He's got no friends at school,
none in his building.Copy !req
662. What about financials—Copy !req
663. tab from a gay bar,
magazine subscriptions?Copy !req
664. Nothing. He probably
didn't want to leaveCopy !req
665. a paper trail
that could out him.Copy !req
666. And he's never dated
anyone else?Copy !req
667. I wouldn't
be surprisedCopy !req
668. if James Reed is the only
person that Ian ever dated.Copy !req
669. Hey, guys.Copy !req
670. You're late.Copy !req
671. I got a good reason.Copy !req
672. Bad news.Copy !req
673. What is it?Copy !req
674. My guess— Exhibit "A"
for the defense.Copy !req
675. The night of James
Reed's murder,Copy !req
676. the 2-9 received a call
from Stuyvesant's E.R.,Copy !req
677. patient reporting an assault.Copy !req
678. That's the 61.Copy !req
679. Victim's name, Ian Tate.Copy !req
680. Checked in at 11:05 that night.Copy !req
681. 14 centimeter lac
on his right arm,Copy !req
682. minor contusions to his torso.Copy !req
683. Said he got mugged.Copy !req
684. Well, the precinct wasn't called
until 7:30 the next morning.Copy !req
685. Welcome to Thursday night at the
Knife and Gun Club, detective.Copy !req
686. We were slammed,
and he had a long wait.Copy !req
687. Any sign of sexual assault?Copy !req
688. If I thought he had been,
I would have asked.Copy !req
689. Men underreport as it is.Copy !req
690. Okay, after
he checked in,Copy !req
691. could he have left
and come back?Copy !req
692. Nope. You leave,
you lose your spot.Copy !req
693. Thanks.Copy !req
694. 61 says the precinct copsCopy !req
695. got Ian's report
at 8:10 that morning;Copy !req
696. at 8:30, Reed's body is found
seven blocks from here.Copy !req
697. And the body wasn't
there at 11:00
the night beforeCopy !req
698. when Ian was already
on the way to the hospital
where he spent the night.Copy !req
699. So, when did he find the timeCopy !req
700. to get rid of the body
of a 165-pound man?Copy !req
701. Had to be the father.Copy !req
702. Nobody else in
Ian's life is going
to dump a body for him.Copy !req
703. We got to place Daddy
at that scene.Copy !req
704. You guys were right.Copy !req
705. What did you find?Copy !req
706. That's your victim's blood.Copy !req
707. We rushed labs
to get the matchCopy !req
708. once your suspect
was in custody.Copy !req
709. No more rush.Copy !req
710. Until now.Copy !req
711. Show and Tell time.Copy !req
712. The cheap and fast way
to fix a wall is to put a patchCopy !req
713. behind the hole,
hold it steady with a string,Copy !req
714. and plaster over it.Copy !req
715. I found another blood sample
after the patch was removed.Copy !req
716. When you chip away
all the plaster
used to fix it,Copy !req
717. you find the perimeter
of the initial damage.Copy !req
718. Now, if I take your head
and bash it through the wall?Copy !req
719. My hand is going to go through
as well.Copy !req
720. So, when I pull my hand out...Copy !req
721. That's the
killer's blood.Copy !req
722. And it's not Ian Tate.Copy !req
723. DNA came back matching
only his Y chromosome.Copy !req
724. The killer is
a close male relative.Copy !req
725. No one's closer then Dad.Copy !req
726. I'm listening.Copy !req
727. Unless the next words
out of your mouth are man two,Copy !req
728. we've got nothing to talk about.Copy !req
729. Well, I think I can do better
than that...Copy !req
730. if your client recants
his statement.Copy !req
731. My statement
is the truth.Copy !req
732. He forced himself on
me and I fought back.Copy !req
733. And you dumped
the bodyCopy !req
734. on the street
near your house.Copy !req
735. Yeah.Copy !req
736. When did you
do that?Copy !req
737. That night
or the next morning?Copy !req
738. I don't remember.Copy !req
739. What does this matter?Copy !req
740. I think your
client knowsCopy !req
741. exactly why this matters.Copy !req
742. He caught you, didn't he?Copy !req
743. Shut up.Copy !req
744. Ian, going to jail
isn't going to help.Copy !req
745. I did it.Copy !req
746. We found your father's blood
in your apartment.Copy !req
747. We know what happened.Copy !req
748. If you have evidence
implicating his father,Copy !req
749. you have an obligation to drop
the chargesCopy !req
750. and get my client out of here.Copy !req
751. If your client wants to avoid
accessory charges,Copy !req
752. you'll sit down now.Copy !req
753. You have no idea.Copy !req
754. No...Copy !req
755. but I can imagine
how you must feel.Copy !req
756. James knew what you were going
through, didn't he?Copy !req
757. He knew what it felt like
to hate yourself,Copy !req
758. to want to change
and know you can't.Copy !req
759. For the first time,
somebody understood you.Copy !req
760. Now, he's gone.Copy !req
761. You didn't go
to the hospitalCopy !req
762. because James
attacked you.Copy !req
763. Your father did.Copy !req
764. He didn't mean to.Copy !req
765. He was shocked
seeing me like that.Copy !req
766. Tell them that, okay?Copy !req
767. He wasn't himself.Copy !req
768. It wasn't his fault.Copy !req
769. What the hell?Copy !req
770. This is completely...Copy !req
771. Completely what?Copy !req
772. What is it, Doctor?
Sick? Unnatural?Copy !req
773. So is murder.Copy !req
774. Roger Tate,
you're under arrestCopy !req
775. for the murder of James Reed.Copy !req
776. You have the right
to remain silent.Copy !req
777. Anything you say can
and will be used against
you in a court of law.Copy !req
778. She rides her bike
to work—Copy !req
779. that is so
environmentally
conscious.Copy !req
780. Ms. Novak, right?Copy !req
781. Your office told me
you would be riding up.Copy !req
782. Dave Seaver,
representing
Roger Tate.Copy !req
783. Yeah, I remember your name—
state Senate elections.Copy !req
784. I didn't vote for you.Copy !req
785. Neither did most of New York,
but that's okay.Copy !req
786. My shrink says it's made me
less self-destructive.Copy !req
787. A little advice, Dave:Copy !req
788. you want to court
the conservative
vote, be my guest.Copy !req
789. But I'd find
another client.Copy !req
790. Roger Tate's no defender
of family values.Copy !req
791. He's just a killer.Copy !req
792. He was defending his son
from a rapist.Copy !req
793. Yeah, you know, that
might have workedCopy !req
794. before Ian Tate said
the sex was consensual.Copy !req
795. My client was mistaken,Copy !req
796. which, under the law,
is still justifiable homicide.Copy !req
797. Your Honor, my client
believed he saw a manCopy !req
798. raping his son.Copy !req
799. Article 35
of the Penal Code statesCopy !req
800. that one can use deadly force
to prevent forcible sodomy.Copy !req
801. Justification is not
a defense for stupidity.Copy !req
802. The test is, would a man
with the same backgroundCopy !req
803. and experiences as my client,
respond in the same manner?Copy !req
804. A reasonable man, Mr. Seaver.Copy !req
805. And no reasonable
person believesCopy !req
806. two men having sex
automatically constitutes rape.Copy !req
807. My client's
researchCopy !req
808. focused on aggression,
promiscuityCopy !req
809. and deviant behavior
in homosexual males.Copy !req
810. It's not just a crazy belief;
he's done the studiesCopy !req
811. to back it up.Copy !req
812. Your Daubert test
requires theories
to be acceptedCopy !req
813. by the scientific community.Copy !req
814. Dr. Tate's work was not.Copy !req
815. I'm not presentingCopy !req
816. my client's work as accepted
scientific theory,Copy !req
817. but as irrefutable proof
of his state of mind.Copy !req
818. Tate's own son is homosexual.Copy !req
819. And he didn't know that.Copy !req
820. Your Honor,Copy !req
821. did my client possessCopy !req
822. the culpable mental
state requiredCopy !req
823. to commit a crime?
The answer is no.Copy !req
824. This defense is an attemptCopy !req
825. to encourage and exploit bigotry
against homosexuals.Copy !req
826. He's going for jury
nullification.Copy !req
827. Ms. Novak, I'm not convincedCopy !req
828. that a defense
should be rejectedCopy !req
829. simply because a jury
might believe it.Copy !req
830. Defining reasonable
is a very difficult issue.Copy !req
831. And it's one that I believe
is better decidedCopy !req
832. by 12 of Dr. Tate's peers.Copy !req
833. The night James Reed
was killed,Copy !req
834. how did your father get
into your apartment?Copy !req
835. He has a key.Copy !req
836. He was bringing
over dinner.Copy !req
837. But you thought
he was out of town,Copy !req
838. and that's why you
invited your boyfriend
to spend the night.Copy !req
839. Yes.Copy !req
840. And he caught you in bed
with James Reed.Copy !req
841. What did he do?Copy !req
842. He pulled James
away from me.Copy !req
843. Then what?Copy !req
844. Then he pushed James into
the wall two or three times.Copy !req
845. I heard a crack.Copy !req
846. James stopped fighting;
he was dead.Copy !req
847. Your father
then attacked you.Copy !req
848. What did he say?Copy !req
849. He kept asking meCopy !req
850. how I could do this to him.Copy !req
851. Meaning, how could
you threaten his life's workCopy !req
852. by being homosexual?Copy !req
853. Objection. Calls
for speculation.Copy !req
854. Withdrawn.Copy !req
855. Nothing further.Copy !req
856. When did you tell your dad
you were homosexual?Copy !req
857. I didn't.Copy !req
858. And you've known for how long?Copy !req
859. Since I can remember.Copy !req
860. So, you've been a liar
your whole life?Copy !req
861. It must have
been difficultCopy !req
862. hiding that kind of lifestyle.Copy !req
863. You even made up a girlfriend,
didn't you?Copy !req
864. Sandy?Copy !req
865. That was high school.Copy !req
866. But you must have found
some other outletCopy !req
867. for your predilections?
Gay pornography.Copy !req
868. Objection, assuming facts
not in evidence.Copy !req
869. Tone down the rhetoric,
Mr. Seaver.Copy !req
870. Objection sustained.Copy !req
871. Your dad knock you around a lot?Copy !req
872. No. Never.Copy !req
873. Ever see him get into a physical
altercation with anybody?Copy !req
874. Once. This kid at school
beat me up.Copy !req
875. My dad got in a fight
with the kid's father.Copy !req
876. Broke his nose.Copy !req
877. So, he's only violent
when he's defending you?Copy !req
878. Ian, why did you confess
to James Reed's murder?Copy !req
879. What nobody gets...Copy !req
880. is this happened because of me.Copy !req
881. Because of what I am.Copy !req
882. If I weren't
so sick,Copy !req
883. I could've
controlled myself.Copy !req
884. It was my fault.Copy !req
885. I didn't want my dad
going to jail for my mistake.Copy !req
886. Dr. Cahill,Copy !req
887. what was the first study you
and Dr. Tate conducted?Copy !req
888. We analyzed over 10,000
questionnairesCopy !req
889. on male sexuality.Copy !req
890. And what conclusions did
you and Dr. Tate draw?Copy !req
891. That homosexuals
solicited sex from minors,Copy !req
892. engaged in high-risk behaviorsCopy !req
893. and had violent sexual relations
more than heterosexuals.Copy !req
894. Taking all of Dr.
Tate's researchCopy !req
895. on homosexual
behavior into
account,Copy !req
896. what do you believe
are the general conclusions?Copy !req
897. Homosexuals suffer a multitude
of psychological problems.Copy !req
898. They are more likely
to be depressed, alienatedCopy !req
899. and have issues with rage.Copy !req
900. Thank you.Copy !req
901. No further questions.Copy !req
902. Where have these studies
been published?Copy !req
903. Which one?Copy !req
904. Any of them?Copy !req
905. They're still
being consideredCopy !req
906. for publication.Copy !req
907. Oh.Copy !req
908. Well, good luck with that.Copy !req
909. So, you say gay people
have more sex with minorsCopy !req
910. then straight people?Copy !req
911. Why does almostCopy !req
912. every other
study sayCopy !req
913. pedophiles are far
more likely to be
heterosexual?Copy !req
914. That is evidence of the biasCopy !req
915. within the so-called
mainstream psychology.Copy !req
916. So, when the American
Psychiatric AssociationCopy !req
917. removed homosexualityCopy !req
918. from its list of mental
disorders in 1973,Copy !req
919. and every other major medical
association followed suit,Copy !req
920. you're saying it's all
a big conspiracy?Copy !req
921. Objection.Copy !req
922. Nothing further.Copy !req
923. I'm ashamed to say I...Copy !req
924. I never suspected Ian
was a homosexual.Copy !req
925. I wish I'd known.Copy !req
926. Why?Copy !req
927. Wouldn't you have disowned him,Copy !req
928. committed him
to a mental hospital?Copy !req
929. No.Copy !req
930. I loved my son.Copy !req
931. I would have done
anything to help him.Copy !req
932. No further
questions.Copy !req
933. You and Ian were close?Copy !req
934. Yes.Copy !req
935. But you claim
you didn't know he was gay,Copy !req
936. so not that close I guess.Copy !req
937. I love my son.Copy !req
938. And yet, you let him
take the fallCopy !req
939. for causing
James Reed's death.Copy !req
940. So, maybe
the truer statement would be,Copy !req
941. you love Ian, but not
as much as you love yourself.Copy !req
942. I'm on trialCopy !req
943. for protecting my son from a manCopy !req
944. I thought was raping him.Copy !req
945. Why dump the body?Copy !req
946. Why conceal the evidence?Copy !req
947. Why not call the policeCopy !req
948. and tell them
what a righteous guy you are?Copy !req
949. Objection.Copy !req
950. I love Ian.Copy !req
951. You keep saying
that, Dr. Tate.Copy !req
952. You can't
tell meCopy !req
953. how I feel about my son.Copy !req
954. How dare you presume to know
anything about our relationship?Copy !req
955. Because, he's been sitting
in this court roomCopy !req
956. while you mount a defenseCopy !req
957. that calls him
a deviant.Copy !req
958. Now you tell me again
how much you love him.Copy !req
959. Hey, how did it go with Tate?Copy !req
960. Jurors eight
and ten believe him.Copy !req
961. Enough to hang the jury?Copy !req
962. Maybe.Copy !req
963. In which case, all I've done
is out some poor kid,Copy !req
964. it's not exactly my
favorite legal strategy.Copy !req
965. You didn't
have a choice.Copy !req
966. You got kids, you ever
wonder if one's gay?Copy !req
967. I don't know, I haven't asked.Copy !req
968. Elliot,
you know your kids,Copy !req
969. you'd know
if one of them was gay.Copy !req
970. Exactly,Copy !req
971. and Tate's whole defense
is predicated on the factCopy !req
972. that he never suspected
his son was gay.Copy !req
973. You don't buy it?Copy !req
974. No, but I can't prove it.Copy !req
975. Ian had a girlfriend
all through high school.Copy !req
976. For all appearances,Copy !req
977. he was straight.Copy !req
978. We never found a girlfriend whenCopy !req
979. we were looking at Tate's past.Copy !req
980. 'Cause we were looking
for boyfriends.Copy !req
981. Well, if Ian knew all along
that he was gay,Copy !req
982. I bet you that
the girlfriend did too.Copy !req
983. Find out.Copy !req
984. I haven't talked to IanCopy !req
985. in a couple of years,Copy !req
986. I don't know how much help
I'm going to be.Copy !req
987. We appreciate anything
you would tell us.Copy !req
988. One of the
guidance counselorsCopy !req
989. said that you and Ian
dated all through high school?Copy !req
990. Um, we were good friends,
but I wouldn't say we dated.Copy !req
991. No? What would
you say?Copy !req
992. He just wasn't very interested
in the physical part,Copy !req
993. which was okay,Copy !req
994. I really loved him,
and he loved me.Copy !req
995. So, he wasn't really
attracted to women.Copy !req
996. Well,
he never likeCopy !req
997. came out to me or anything.Copy !req
998. I just knew.Copy !req
999. I was happy to be there for himCopy !req
1000. so people wouldn't harass him
like they did the other guys.Copy !req
1001. Did you ever
tell anybodyCopy !req
1002. that Ian was gay?Copy !req
1003. Like, his father maybe?Copy !req
1004. Oh God,
no, no way.Copy !req
1005. Ian would
have killed me.Copy !req
1006. I told him.Copy !req
1007. Mom, are you crazy?
Why?Copy !req
1008. He was such
a sweet boy.Copy !req
1009. He spent so much time
around here,Copy !req
1010. he was like a second child.Copy !req
1011. I could see
how much he was suffering,Copy !req
1012. and I thought Roger should know.Copy !req
1013. When did you tell him?Copy !req
1014. The kids'
senior year.Copy !req
1015. I called Roger and I told him,Copy !req
1016. "Roger, you should talk to Ian,
he's very depressed."Copy !req
1017. I just told him, I said,
"Roger, your son is gay,Copy !req
1018. "you're making an incredibly
difficult situation worse,Copy !req
1019. you need to be a father."Copy !req
1020. How did he respond to that?Copy !req
1021. He thanked me,Copy !req
1022. and he asked me
never to contact him again.Copy !req
1023. Ian, what are you
doing here?Copy !req
1024. Why don't you try
this brilliant manipulationCopy !req
1025. on some little legal aid
attorney, Ms. Novak,Copy !req
1026. and stop wasting my time.Copy !req
1027. Let's go.Copy !req
1028. A one-time offer,
gone as soonCopy !req
1029. as you walk out that door.Copy !req
1030. Murder Two, 20 to life,Copy !req
1031. I don't pursue
sentencing enhancementCopy !req
1032. under the Hate Crimes Act,Copy !req
1033. and Doctor Tate gets
the prison of his choice,Copy !req
1034. and might I suggest
the securityCopy !req
1035. of a federal prison.Copy !req
1036. 20 years?Copy !req
1037. With that jury,
he's lookingCopy !req
1038. at a man-two,
probation.Copy !req
1039. They haven't heard
my rebuttal witness.Copy !req
1040. Laura Klein.Copy !req
1041. Consider this
your notification.Copy !req
1042. You remember her,
don't you, Dr. Tate?Copy !req
1043. Sandy's mother.Copy !req
1044. You knew.Copy !req
1045. All this time.Copy !req
1046. All these years,Copy !req
1047. you knew.Copy !req
1048. Ian, it's not like that.Copy !req
1049. Yes, it is Dad.Copy !req
1050. You know how many times
I told myself,Copy !req
1051. "It's okay if he thinks
gays are sick.Copy !req
1052. "Freaks, evil.Copy !req
1053. "Because, if he knew
about me, if he knew me,Copy !req
1054. "he wouldn't say it.Copy !req
1055. He wouldn't think it."Copy !req
1056. I didn't do this to hurt you.Copy !req
1057. But, it did
hurt me, Dad.Copy !req
1058. Every day.Copy !req
1059. And I made myself take
everything you said,Copy !req
1060. all that crap,Copy !req
1061. because I really thought
you wouldn't tryCopy !req
1062. to hurt me on purpose.Copy !req
1063. I mean, who would do that toCopy !req
1064. somebody that they really love?Copy !req
1065. To their own son?Copy !req
1066. I can help you.Copy !req
1067. What makes you think
you can make meCopy !req
1068. any more straight than
what I've already triedCopy !req
1069. to do to myself?Copy !req
1070. All you've done...Copy !req
1071. is made me wish I was dead.Copy !req
1072. They took the plea.Copy !req
1073. It's so weird, you know?Copy !req
1074. I've been sitting
here for a while,Copy !req
1075. and everybody walks by,
I wonder, does he know?Copy !req
1076. Does she?Copy !req
1077. James used to always talkCopy !req
1078. about how happy he was
that he was gay.Copy !req
1079. He said guys
are so much more fun.Copy !req
1080. Yeah, I agree with James.Copy !req
1081. Everything's different
now, you know?Copy !req
1082. No matter what I do,Copy !req
1083. nothing will be
like it was before.Copy !req
1084. Ian, I had
my job to do,Copy !req
1085. and I made you deal
with somethingCopy !req
1086. you weren't ready for.Copy !req
1087. I'm sorry.Copy !req
1088. Yeah.Copy !req
1089. I'm not.Copy !req
