8. What do we got?Copy !req
9. Six-year-old male.Copy !req
10. Stopped breathing
at a church service.Copy !req
11. No pulse. Gave him epi
and atropine.Copy !req
12. Oh, please.
The boy's dad.Copy !req
13. You wait here.Copy !req
14. Still no pulse.
Pupils fixed and dilated.Copy !req
15. Asystole.Copy !req
16. Push vasopressin and
atropine. Scalpel.Copy !req
17. Oh, my God,Copy !req
18. what are you doing?
We're trying to
start his heart.Copy !req
19. Sir, you need
to wait outside.
No, no, no, no.Copy !req
20. Please let me stay
with him.Copy !req
21. Did he ingest anything:
poisons,Copy !req
22. detergents, drugs?
There was just-justCopy !req
23. a glass of
milk before bed.Copy !req
24. Vasopressin
and atropineCopy !req
25. on board—
still no pulse.Copy !req
26. How long's he been down?Copy !req
27. Nearly 30 minutes.Copy !req
28. You have to help him.Copy !req
29. I'm sorry.Copy !req
30. There's nothing more we can do.Copy !req
31. Paramedics were calledCopy !req
32. to a service at the Church
of Divine BlessingCopy !req
33. just before midnight.Copy !req
34. A parishioner said
the kid had stopped breathing.Copy !req
35. We did everything we could
to resuscitate him,Copy !req
36. but he was DOA.Copy !req
37. His name's Jamie Semple.Copy !req
38. Did you notify the parents?
Yeah. Dad came inCopy !req
39. with the paramedics.
And what's the
cause of death?Copy !req
40. I have my suspicions,
but you'd better wait
for the autopsy.Copy !req
41. Why us?
Because I think
he was physically abused.Copy !req
42. There's these
indentations.Copy !req
43. Do you mind if
I take a look?Copy !req
44. Partial finger
impressions, and...Copy !req
45. is that a ring mark?Copy !req
46. Somebody really
squeezed this kid.Copy !req
47. Or crushed him.
Hold on. The
ring might haveCopy !req
48. partial initials— can
we use your camera?Copy !req
49. From the positioning
of the imprint,Copy !req
50. the ring...
is on the right ring finger.Copy !req
51. Where are the parents?Copy !req
52. They're in the waiting area.
They tell you
why they tookCopy !req
53. their kid to church
in the middle of the night?Copy !req
54. Yeah.Copy !req
55. They were praying over him.Copy !req

60. We are so sorry
about your loss.Copy !req
61. We need to ask you
a few questions.Copy !req
62. Can you tell us what happened?Copy !req
63. Um, I'm-I'm afraid
I don't know a lot.Copy !req
64. I-I was... I work late.Copy !req
65. Um, I run a bodega
up on 121st.Copy !req
66. Sam was home with Jamie.Copy !req
67. Well, he'd been wild,
real wild, all day,Copy !req
68. uh, just... throwing fits
like he was possessed.Copy !req
69. When he finally quieted down,
I took him to the church.Copy !req
70. I-I thought it might helpCopy !req
71. if Father Hendry
prayed over him.Copy !req
72. What time was it?Copy !req
73. 11:15, 11:30.Copy !req
74. And you were okay with this,
Mrs. Dufoy?Copy !req
75. Well, um... we're-we're
Jamie's foster parents.Copy !req
76. His birth mother
wanted church to be
part of his life,Copy !req
77. so... we-we try
to respect that.Copy !req
78. So, what went on last night?Copy !req
79. We were praying
with Father Hendry,Copy !req
80. and this lady
was holding Jamie's hand,Copy !req
81. and... suddenly,
she couldn't find a pulse.Copy !req
82. Jamie stopped breathing.Copy !req
83. We tried to wake him,
but we couldn't...Copy !req
84. May I please see
both of your right hands?Copy !req
85. Why?Copy !req
86. Please.Copy !req
87. Thank you.Copy !req
88. Where's the church?Copy !req
89. Um, 126th,Copy !req
90. off Lennox.Copy !req
91. Okay.Copy !req
92. If you think of anything else,Copy !req
93. please call us, okay?Copy !req
94. God, it's 4:45.Copy !req
95. I've got to be in
court in five hours.Copy !req
96. Okay, you go ahead.Copy !req
97. About time Munch got
his bony ass out of bedCopy !req
98. for some religion.Copy !req
99. Thanks.Copy !req
100. Jamie and his father
found comfortCopy !req
101. and healing here
on many occasions.Copy !req
102. Ask my brothers
and sisters.Copy !req
103. Why'd Jamie need healing?
He had demons.Copy !req
104. He'd have fits:Copy !req
105. hurl himself to the ground,Copy !req
106. froth at the mouth,Copy !req
107. shout, swear,Copy !req
108. bang his head.Copy !req
109. And this was
the devil's work?Copy !req
110. Medicine couldn't heal Jamie.
Our prayers could.Copy !req
111. Then why is he dead?Copy !req
112. Excuse me, ma'am,
and you are...?Copy !req
113. Mariel Plummer, ACS;
Jamie's case worker.Copy !req
114. I just came
from the hospital.Copy !req
115. I spoke to Lori-Ann
and Sam.Copy !req
116. I just can't believe
this has happened.Copy !req
117. Jamie's in a
better place now.
The only better placeCopy !req
118. Jamie could be is at home
with his parents!Copy !req
119. I'm... sorry.
This is just really upsetting.Copy !req
120. Ms. Plummer,
in your professional opinion,Copy !req
121. was Jamie possessed
by the devil?Copy !req
122. Jamie had ADHD with conduct
disorder and epilepsy.Copy !req
123. You don't believe me,
speak to his doctor.Copy !req
124. I worked with Jamie
for nearly a year.Copy !req
125. He could be a
real handful.Copy !req
126. When a child has
both a behavioralCopy !req
127. and an organic
disorder,Copy !req
128. one exacerbates
the other.
What did you do for Jamie?Copy !req
129. Gave him medication
for epilepsyCopy !req
130. and therapy for the ADHD.Copy !req
131. He was steadily improving.Copy !req
132. He could be
a sweet kid:Copy !req
133. funny, loving,
inventive...Copy !req
134. I can't believe he's dead.Copy !req
135. Isn't that Mariel Plummer?Copy !req
136. Yes. Jamie's
case worker.Copy !req
137. She's great with kids.Copy !req
138. He was quite
fond of her.Copy !req
139. I felt we had
the behavioral problemsCopy !req
140. under control,
but there was always a chanceCopy !req
141. that he could have
another seizure.Copy !req
142. Could he die
from that?Copy !req
143. There is a rare syndromeCopy !req
144. called Sudden Unexpected Death
in Epilepsy.Copy !req
145. How does that happen?Copy !req
146. Not taking one's meds
or mixing them.Copy !req
147. Do Jamie's foster parents
know how to medicate him?Copy !req
148. Yes, and how to care for him
during a seizure...Copy !req
149. but in the last few months,Copy !req
150. they'd started looking
for answers elsewhere.Copy !req
151. Like at the Church
of Divine Blessing.
Yeah.Copy !req
152. Sam Dufoy insisted
that it was good for Jamie.Copy !req
153. A month ago, I told them either
leave the church or leave me,Copy !req
154. because I couldn't take
responsibilityCopy !req
155. for Jamie's health.Copy !req
156. They chose the church.Copy !req
157. According to Doc Engels,
cause of deathCopy !req
158. could be an epileptic seizure.Copy !req
159. You ask me,
that kid is deadCopy !req
160. because his parents
didn't give him his meds,Copy !req
161. and then dragged him off
to a faith healer.Copy !req
162. That's the lure
of faith healing.Copy !req
163. Medicine doesn't give them
the answer they want,Copy !req
164. so they turn to God.Copy !req
165. Doc said Jamie
was getting better.Copy !req
166. He's got epilepsy—
he'll always be epileptic.Copy !req
167. Medicine can only
treat the condition.Copy !req
168. Father Hendry can
promise them a cure.Copy !req
169. But he can't deliver.Copy !req
170. Then he says
it's the Lord's will.Copy !req
171. Yeah, or maybe Sam and
Lori-Ann didn't pray
hard enough.Copy !req
172. I got the feeling that Lori-Ann
didn't approve of it.Copy !req
173. She doesn't belong
to that church.Copy !req
174. Even if Jamie was having
a seizure,Copy !req
175. and his dad took him
for a prayer session,Copy !req
176. it doesn't account for
the mark on Jamie's chest.Copy !req
177. Depends on what kind
of prayer session
you're talking about.Copy !req
178. That autistic kid
who died in the
Milwaukee church—Copy !req
179. the parishioners
held him down.Copy !req
180. They were laying on
top of him to cure him.Copy !req
181. That would explain
the ring mark.Copy !req
182. Right? Somebody holds
onto Jamie, he struggles,Copy !req
183. and they hold
onto him tighter.Copy !req
184. Until he stops breathing.Copy !req
185. Thank you. I enjoyed that.Copy !req
186. Now, have we tracked down
his birth mother yet?Copy !req
187. Social worker saysCopy !req
188. she moved to Long Island.Copy !req
189. I made a call.
The phone's disconnected.Copy !req
190. I also did a little homework
on Father Hendry.Copy !req
191. He used to be minister
of the Sacred Spirit Church,Copy !req
192. but left over
"religious
differences."Copy !req
193. Okay. Liv, Elliot,
you got trial prep.Copy !req
194. John, Fin, pay a visitCopy !req
195. to Sacred Spirit Church—
let's see howCopy !req
196. "different"
Father Hendry's religion was.Copy !req
197. Lucas Hendry was with us
for many years.Copy !req
198. He was a popular preacher.Copy !req
199. Why'd he leave?Copy !req
200. He was drawn to a more
charismatic form of worship.Copy !req
201. He felt people needed
more drama in their faith.Copy !req
202. Have you heard of
the Toronto Blessing?Copy !req
203. Nope.Copy !req
204. It started in the '90s,Copy !req
205. in a church near
Toronto Airport.Copy !req
206. Practitioners claimedCopy !req
207. they could cast out demons,
heal the sick,Copy !req
208. speak in tongues.Copy !req
209. Hendry and some of our members
were seduced by it.Copy !req
210. Like Sam and
Lori-Ann Dufoy?Copy !req
211. Sam was.
He and Lori-AnnCopy !req
212. are good people.
We were sorry to see them go.Copy !req
213. You think
Father Hendry'sCopy !req
214. a fraud?Copy !req
215. He doesn't hold rattlesnakes
in one handCopy !req
216. and the collection box
in the other,Copy !req
217. if that's what you mean.Copy !req
218. He may be deluded,
but he's sincere.Copy !req
219. Does Reverend Hendry
always wear this ring?Copy !req
220. Yes. It was
his grandfather's.Copy !req
221. This mark
was on Jamie's body.Copy !req
222. See the partial initials:
J.O.?Copy !req
223. Well, my initials are L.H.Copy !req
224. But it's your ring.Copy !req
225. The initials belong
to your grandaddy,Copy !req
226. Jackson Ormond.Copy !req
227. Where's the
ring, Father?Copy !req
228. I don't wear it anymore.Copy !req
229. We talked to the people
that prayed forCopy !req
230. Jamie that night— they said
you were calling to the Lord,Copy !req
231. battling with Satan.Copy !req
232. His demons were powerful.
I had to fight them.Copy !req
233. You held him
so tightCopy !req
234. that the ring left
an impression on his flesh.Copy !req
235. I was healing him!Copy !req
236. You crushed the life
out of him!
No!Copy !req
237. You killed him!Copy !req
238. God forgive me.Copy !req
239. I was only trying to help
the boy.Copy !req
240. I-I-I must've held him
too tight.Copy !req
241. I... I saw the mark
my ring had made—Copy !req
242. I took it off.Copy !req
243. I'm so sorry.Copy !req
244. About to take himCopy !req
245. to Booking.
Put him in the cage.Copy !req
246. I think you better
talk to Warner first.Copy !req
247. We've got microscopic
cotton fibers.Copy !req
248. I found them
in Jamie's lungs and stomach.Copy !req
249. Along with these—Copy !req
250. traces of toluene
diisocyanate polyolCopy !req
251. and pentabromodiphenyl oxide.Copy !req
252. Your basic foam rubber
and fire retardant.Copy !req
253. So he was smothered
with a cushion?Copy !req
254. Or a cheap pillow.Copy !req
255. Okay, somebody holds
a pillow over Jamie's face.Copy !req
256. The kid fights and bites
right through the caseCopy !req
257. into the foam.Copy !req
258. Yeah, but the parishioners
didn't say anythingCopy !req
259. about a pillow.Copy !req
260. That's because Jamie wasn't
smothered at the church.Copy !req
261. How do you know that?Copy !req
262. See how clear and deep
the impression is?Copy !req
263. That wouldn't have happened
with living skin.Copy !req
264. His flesh had started
to swell and become waxy.Copy !req
265. Jamie was already dead.Copy !req
266. At least an hour
before this mark was made.Copy !req
267. You know, I don't know
what you thinkCopy !req
268. you're going to find here.Copy !req
269. We'll let you knowCopy !req
270. as soon as we find it.Copy !req
271. Pillowcase is clean,
no tears.Copy !req
272. When's your husband
coming back?Copy !req
273. Soon.Copy !req
274. He's out making
Jamie's funeral arrangements.Copy !req
275. Look like teeth marks.Copy !req
276. Mm-hmm. Check this out.Copy !req
277. Blood?Copy !req
278. No, it couldn't be.Copy !req
279. Jamie must've spilled
his chocolate milk or something.Copy !req
280. Look, do you really think
we would hurt him?Copy !req
281. He was like
our own son.Copy !req
282. We need to get this
to the lab.Copy !req
283. See if they can ID it.Copy !req
284. Pillowcase.
Found it in the trash.Copy !req
285. Tear marks.Copy !req
286. Check it against
the bite marks on that.Copy !req
287. What's going on?Copy !req
288. Perfect match.Copy !req
289. We just found
your murder weapon.Copy !req
290. Jamie was sleeping
when I took him to the church.Copy !req
291. He was already dead
when he got there, Sam.Copy !req
292. No, no. After one of his fits,Copy !req
293. it's like he's in a coma,
but he always wakes up.Copy !req
294. He couldn't wake up.Copy !req
295. He'd been suffocated
with a pillow.Copy !req
296. That's impossible.Copy !req
297. I'd never hurt Jamie.Copy !req
298. Then why are there bite marks
on his pillow and pillowcase?Copy !req
299. Because Jamie is an epileptic.Copy !req
300. When he's having a seizure,
he goes crazy.Copy !req
301. He'll bite anything
within reach.Copy !req
302. That doesn't explainCopy !req
303. the fragments
of foam and fiber
in his lungs.Copy !req
304. I don't believe you.Copy !req
305. What do you think
these are?Copy !req
306. That pillow
was pressed so hard
against Jamie's faceCopy !req
307. he inhaled this stuff.Copy !req
308. No!Copy !req
309. Come on, Sam.
The kid was running wild,Copy !req
310. you were at the end
of your rope.Copy !req
311. You put that pillow
over his face,Copy !req
312. and you held it there
till he stopped moving.Copy !req
313. Stop!Copy !req
314. I loved Jamie.Copy !req
315. No, you killed him.Copy !req
316. Then you took him
to the church to cover it up.Copy !req
317. No. I know my husband.Copy !req
318. He would never do anything
like this.Copy !req
319. We dumped your phone.Copy !req
320. Sam called you at your store
at 11:00. Why?Copy !req
321. He said Jamie
was out of control.Copy !req
322. Did you go home?Copy !req
323. I couldn't.Copy !req
324. I had customers.Copy !req
325. I told Sam to stay calm.Copy !req
326. That I would be there
as soon as I could.Copy !req
327. Let it out, Sam.Copy !req
328. You'll feel better.Copy !req
329. ( sobbing ):
I just wanted him to sleep.Copy !req
330. Just be still for a while.Copy !req
331. But then he stopped moving!Copy !req
332. So you took him
to the priest.Copy !req
333. Father Hendry woke him up
before.Copy !req
334. I thought
he could do it again.Copy !req
335. Sam, don't say anything else.Copy !req
336. We're getting a lawyer.Copy !req
337. Baby...Copy !req
338. I tried so hard
not to hurt him.Copy !req
339. I'm sorry!Copy !req
340. Oh, God, I'm sorry!Copy !req
341. Father Hendry didn't knowCopy !req
342. Jamie was already dead?Copy !req
343. Sam lied.
Told himCopy !req
344. the kid had a fit
and was all wrung out.Copy !req
345. After a grand mal seizureCopy !req
346. epileptics can go
into a semi-comatose state.Copy !req
347. It's called
postictal shock.Copy !req
348. Sam's brought Jamie
to the churchCopy !req
349. like that before.Copy !req
350. Father Hendry thinks
he can wake him up again.Copy !req
351. Jamie's birth-mother
just arrived.Copy !req
352. This woman is
going to blow.Copy !req
353. Anything I can tell her?Copy !req
354. Yeah. You caught
her son's killerCopy !req
355. and I'm arraigning him
for murder.Copy !req
356. Why didn't anybody tell meCopy !req
357. what those monsters did
to my son?Copy !req
358. We tried calling you.Copy !req
359. Then why'd I have
to find out about itCopy !req
360. over the television?Copy !req
361. My own little son...Copy !req
362. Didn't ACS contact you?Copy !req
363. How do you think
this all got started?Copy !req
364. Who the hell do you think
took Jamie from meCopy !req
365. and put him with those freaks?Copy !req
366. If you have any information
about the Dufoys,Copy !req
367. we'd like to hear it.Copy !req
368. He said they hurt him.Copy !req
369. He begged me
to let him come home.Copy !req
370. Did you report that to ACS?Copy !req
371. Yes, I did.Copy !req
372. But do you think that bitch
did anything about it?Copy !req
373. You mean Mariel Plummer.Copy !req
374. Yeah, her.Copy !req
375. My son's poor dead
little body is at her door.Copy !req
376. She's going to pay for it,Copy !req
377. and ACS is
going to pay for it,Copy !req
378. the city's going to pay for it.Copy !req
379. That's not goingCopy !req
380. to bring Jamie back.Copy !req
381. Have you ever lost a child?Copy !req
382. You thinkCopy !req
383. this is about money?Copy !req
384. Unfortunately,Copy !req
385. it does seem to be about money.Copy !req
386. Tamara Semple's got convictionsCopy !req
387. for credit card fraud
and shoplifting.Copy !req
388. Doesn't take away her right
to be angry.Copy !req
389. She loses custody of Jamie
and he ends up dead.Copy !req
390. Kid might not have been much
safer with his real mama.Copy !req
391. ACS removed JamieCopy !req
392. after his little
sister drowned
in the bathtub.Copy !req
393. Where was Tamara?Copy !req
394. Talking on the phone.Copy !req
395. Courts ruled it was
an accidental death,Copy !req
396. but ACS did a
precautionary
removal of Jamie.Copy !req
397. This woman's kid dies
in foster care,Copy !req
398. the first thing she sees
is a big fat settlement.Copy !req
399. What about her allegations
the Dufoys hurt Jamie?Copy !req
400. If they did,Copy !req
401. ACS could be
found liable,Copy !req
402. which would weaken our case
against Sam Dufoy.Copy !req
403. We should check it out.Copy !req
404. Wouldn't be the first lawsuitCopy !req
405. that Tamara Semple brought
against ACS.Copy !req
406. Of course,
none of them succeeded.Copy !req
407. She told us Jamie complainedCopy !req
408. the Dufoys
physically abused him.Copy !req
409. He never said a word
to me about abuse.Copy !req
410. Sam and Lori-Ann
were good parents.Copy !req
411. Good parents
don't kill their kids.Copy !req
412. You have to understandCopy !req
413. how difficult a child
like Jamie could be.Copy !req
414. Sam probably snapped.Copy !req
415. Did you ever see any evidence
that Sam was unstable?Copy !req
416. No. On my home visits,Copy !req
417. Jamie was happy, clean,Copy !req
418. and very fond of bothCopy !req
419. Lori-Ann and Sam.Copy !req
420. Sam work?Copy !req
421. He stays home,Copy !req
422. looks after Jamie.Copy !req
423. Lori-Ann brought in the money.Copy !req
424. Sam and Lori-Ann
were married young.Copy !req
425. He was a college
basketball star,Copy !req
426. about to be drafted
into the NBA,Copy !req
427. when a knee injury
put an end to the dreams.Copy !req
428. Excuse me. Tutuola.Copy !req
429. Lori-Ann stuck by him.Copy !req
430. I make it my businessCopy !req
431. to know about
my foster families.Copy !req
432. This is Jamie's file.Copy !req
433. You can take it.Copy !req
434. I'm afraid I can't take itCopy !req
435. without getting
a subpoena first.Copy !req
436. Sure. It's here
when you need it.Copy !req
437. Thank you.Copy !req
438. Thanks.Copy !req
439. Crime lab.Copy !req
440. They said they got
something they want
us to hear.Copy !req
441. I checked Sam's LUDS.Copy !req
442. A half hour before
he called Lori-Ann
at the store,Copy !req
443. he also called
the Child Abuse Hotline.Copy !req
444. And all the Hotline calls
are recorded.Copy !req
445. That's right.Copy !req
446. Hello? Hello!Copy !req
447. Child Abuse Hotline.
Can I help you?Copy !req
448. Yeah, it's my foster kid,Copy !req
449. I can't deal with him
anymore. He's...Copy !req
450. Jamie, cut that out!Copy !req
451. You've got to help me here!Copy !req
452. Sir, are you reporting
an incidentCopy !req
453. of child abuse?Copy !req
454. No, no, nothing like that.Copy !req
455. Is the child in danger
at this moment?Copy !req
456. No! He's just
out of control!Copy !req
457. Sir, if it's an
emergency, call 911.Copy !req
458. Otherwise you should call
your ACS caseworker.Copy !req
459. I have called!
She never answers.Copy !req
460. I want help, you hear?Copy !req
461. I want him out
of my house!Copy !req
462. Sir, I'll take
your informationCopy !req
463. and pass it to Child
Protective Services.Copy !req
464. They'll contact you
within 24 hours.Copy !req
465. 24 hours? Oh, man!Copy !req
466. Had he called his caseworker?Copy !req
467. Well, LUDS show four calls
to Mariel Plummer's ACS officeCopy !req
468. the day Jamie died.Copy !req
469. Did she talk to him?Copy !req
470. I can't say.Copy !req
471. No call was shorter
than 20 seconds,Copy !req
472. which means Sam either
had a conversation with herCopy !req
473. or left a message.Copy !req
474. It's funny how Mariel
didn't tell us any of this.Copy !req
475. I'll put a rush on the subpoena.Copy !req
476. You get a hold
of all Mariel's case files.Copy !req
477. We'll see what else
she forgot to tell us.Copy !req
478. Mariel's records seem to show
she was doing her job.Copy !req
479. Visited Jamie every month,
but see those dates?Copy !req
480. They're the same.Copy !req
481. Yeah.Copy !req
482. which means all the records
were wither generatedCopy !req
483. or altered on the same date;
which happens to be yesterday.Copy !req
484. What are you doing?Copy !req
485. I gave you everything you need.Copy !req
486. We were just admiring
you writing upCopy !req
487. six-months worth of records
in only one day.Copy !req
488. I was checking them
because of the subpoena.Copy !req
489. I didn't alter a thing.Copy !req
490. I'm afraid the log dateCopy !req
491. only changes
if an alteration is made.Copy !req
492. I was probably
tidying things up.Copy !req
493. It's impossible to keep track
of all the paperwork.Copy !req
494. Mariel Plummer,Copy !req
495. you are under arrestCopy !req
496. for tampering
with public records.Copy !req
497. You're arresting me
for paperwork?Copy !req
498. And for reckless
endangermentCopy !req
499. in the death
of Jamie Semple.Copy !req
500. You have the right
to remain silent.Copy !req
501. Anything you do say...Copy !req
502. You've got
a problem, Counselor.Copy !req
503. Arresting Jamie's social
worker makes it harderCopy !req
504. to convict Sam Dufoy.Copy !req
505. He can claim it
was her fault:Copy !req
506. he asked for help
and didn't get it.Copy !req
507. And if a jury buys it,
Sam could walk.Copy !req
508. What are you going
to do, plead him out?Copy !req
509. No way.Copy !req
510. He killed that kid.Copy !req
511. Question is—
who do I try first?Copy !req
512. If I go with Sam and I put
Mariel on the stand,Copy !req
513. she can't testify without
incriminating herself.Copy !req
514. But I don't want
to give her immunity.Copy !req
515. What does your gut tell you?Copy !req
516. Get the facts
on the record...Copy !req
517. catch the little fish
before I go for the big one.Copy !req
518. I'll go schedule
Mariel's court date.Copy !req
519. Casey...Copy !req
520. Carolyn. What are
you doing here?Copy !req
521. Representing
Mariel Plummer.Copy !req
522. I trust you've had second
thoughts about persecuting her.Copy !req
523. No.Copy !req
524. You seriously intend
to clog up the courts,Copy !req
525. to try someone on a couple
of clerical errors?Copy !req
526. Not errors.Copy !req
527. Deliberate falsifications
designed to conceal the factCopy !req
528. she recklessly
endangered a child.Copy !req
529. My client was deceivedCopy !req
530. by a nut case,
who murdered a kidCopy !req
531. and then asked a voodoo priest
to bring him back to life.Copy !req
532. But let's deal.Copy !req
533. A year's probationCopy !req
534. for falsifying
the official record—Copy !req
535. you drop
all other charges.Copy !req
536. No thanks.Copy !req
537. She takes a felony plea—Copy !req
538. guilty of reckless
endangerment.Copy !req
539. Motion to dismiss
the endangerment chargeCopy !req
540. on constitutional
grounds.Copy !req
541. What are you talking about?Copy !req
542. You're forgetting your
14th Amendment, Casey.Copy !req
543. See you at the hearing.Copy !req
544. The Due Process Clause
in the 14th AmendmentCopy !req
545. does not require a state agency
to protect its citizensCopy !req
546. from private violence.Copy !req
547. Therefore there's no case
against my client.Copy !req
548. That ruling also says
that a state agencyCopy !req
549. isn't required to protect
its citizensCopy !req
550. against violence
and other mishapsCopy !req
551. that are, I quote,Copy !req
552. "not attributableCopy !req
553. to the conducts
of its employees."Copy !req
554. Jamie Semple's death is at least
partly attributableCopy !req
555. to Mariel Plummer's
negligence.Copy !req
556. Ms. Maddox,
your own case lawCopy !req
557. seems to help Ms. Novak.Copy !req
558. She's misreading
what the justicesCopy !req
559. had in mind.Copy !req
560. If a criminal court finds
my client culpableCopy !req
561. for Jamie's death,
then who's next?Copy !req
562. Police officers who failCopy !req
563. to prevent a homicide?Copy !req
564. Firefighters who don't save
someone from being burned?Copy !req
565. Your Honor,
that's a reach.Copy !req
566. Many courts
have ruledCopy !req
567. that a child in foster care
is analogousCopy !req
568. to a prisoner in state custody,Copy !req
569. and that state officials,
like Ms. Plummer,Copy !req
570. are not only liable
for harm the child suffers,Copy !req
571. but also
for failing to actCopy !req
572. where there is potential
for harm.Copy !req
573. I'm sorry, Ms. Maddox,Copy !req
574. I agree with Ms. Novak's reading
of the law.Copy !req
575. Your client must
stand trial.Copy !req
576. When you called
the Child Abuse HotlineCopy !req
577. the night Jamie died,Copy !req
578. you said you tried to contactCopy !req
579. your case worker,
Mariel Plummer.Copy !req
580. How many times?Copy !req
581. Four times that day.Copy !req
582. Another three times
the week before.Copy !req
583. Did she ever return
any of those calls?Copy !req
584. No.Copy !req
585. Why were you calling her?Copy !req
586. Because I was
having a hard timeCopy !req
587. coping with Jamie.Copy !req
588. What could Mariel have done?Copy !req
589. If she had called back
or visited,Copy !req
590. she would have seen that Jamie
was out of control,Copy !req
591. and how I was struggling.Copy !req
592. Then none of this
would have happened.Copy !req
593. Thank you.Copy !req
594. Why not call 911?Copy !req
595. What do you mean?Copy !req
596. You said you were scared you
couldn't cope with Jamie.Copy !req
597. Why not call 911Copy !req
598. as the operator suggested?Copy !req
599. I don't know.Copy !req
600. Or take Jamie
to the emergency room,Copy !req
601. or call a neighbor,
or do anything?Copy !req
602. I thought I could handle him.Copy !req
603. How, by smothering him
with a pillow?Copy !req
604. Objection!Copy !req
605. It goes to credibility,
Your Honor.Copy !req
606. The jury has a right to know
that this witnessCopy !req
607. is facing criminal charges in
the death of his foster sonCopy !req
608. and therefore has
an excellent motive to lie.Copy !req
609. I'll allow it.Copy !req
610. The witness will respond.Copy !req
611. Did you suffocate JamieCopy !req
612. with a pillow?Copy !req
613. I assert my Fifth Amendment
rightsCopy !req
614. against
self-incrimination.Copy !req
615. Nothing further.Copy !req
616. How long have you been
a social worker?Copy !req
617. About 18 years.Copy !req
618. And why did you become one?Copy !req
619. I wanted to help people—Copy !req
620. make a difference
in a small way.Copy !req
621. I'm sure there are
many peopleCopy !req
622. who are very grateful to you.Copy !req
623. Frankly,
I doubt that.Copy !req
624. I usually show upCopy !req
625. when a family is in crisis.Copy !req
626. I'm the one who has to say
to the mom,Copy !req
627. "Why are your kids'
clothes dirty?Copy !req
628. Why did your kids
miss school?"Copy !req
629. Worse than that,
I'm the oneCopy !req
630. that has to remove the kidsCopy !req
631. if there's any suspicion
of abuse or neglect.Copy !req
632. Have you ever been threatened?Copy !req
633. Usually just
verbal abuse.Copy !req
634. I've been mugged three times,Copy !req
635. chased out of apartments
with knives.Copy !req
636. I work in pretty rough areas.Copy !req
637. And you keep
coming back?Copy !req
638. Someone has to look out
for the kids.Copy !req
639. Then what went wrong with Jamie?Copy !req
640. I made a mistake.Copy !req
641. I thought that Lori-Ann and Sam
were good foster parentsCopy !req
642. and that Jamie was safe.Copy !req
643. And you never thoughtCopy !req
644. he was in danger?Copy !req
645. No.Copy !req
646. And I had what
I thoughtCopy !req
647. were more urgent cases—Copy !req
648. and I was giving all my
attention to them.Copy !req
649. I was wrong.Copy !req
650. I'll never be able
to forgive myself.Copy !req
651. Thank you.Copy !req
652. You say you didn't think
Jamie was in danger...Copy !req
653. but Sam Dufoy had called,
left messages.Copy !req
654. Didn't that warn you?Copy !req
655. The messages said that
Jamie was acting upCopy !req
656. and that Sam wanted to talk.Copy !req
657. It didn't sound urgent.Copy !req
658. He called four timesCopy !req
659. the day Jamie died.Copy !req
660. How much more urgent can it get?Copy !req
661. I thought Jaime was safe.Copy !req
662. You had no ideaCopy !req
663. what was going on
in the Dufoy house.Copy !req
664. You'd hadn't
visited in months.Copy !req
665. You'd forgotten
all about Jamie.Copy !req
666. No, I cared about him.Copy !req
667. Then why not return Sam's calls?Copy !req
668. Because I was out of the officeCopy !req
669. till late working
on another case.Copy !req
670. But you cared about Jamie.Copy !req
671. Why was that other case
so much more important?Copy !req
672. A father returned home
from prison.Copy !req
673. He beat his wife to death
with a hammer,Copy !req
674. then he killed himself
in front of his two children.Copy !req
675. That's what I was working on.Copy !req
676. That's why I didn't
return Sam's calls.Copy !req
677. I made a terrible mistake,Copy !req
678. but don't accuse me
of not caring.Copy !req
679. No further questions.Copy !req
680. A social worker's job—
poorly paid, usually thankless.Copy !req
681. They work in the most
deprivedCopy !req
682. and violent parts
of our cities,Copy !req
683. where they can be assaulted,
raped even murdered.Copy !req
684. Burnout's common.Copy !req
685. Many don't last five years.Copy !req
686. Mariel Plummer has worked
for 18.Copy !req
687. When Jamie died,
she had nearly 20 cases.Copy !req
688. The recommended caseload
is 12.Copy !req
689. This tragedy isn't
Mariel's fault,Copy !req
690. it's the fault of an
overburdened system:Copy !req
691. too few case workers,
too few dollars,Copy !req
692. too many children in need.Copy !req
693. Out of grief and panic
after Jamie's death,Copy !req
694. Mariel altered
her official records.Copy !req
695. She admits it,
she is sorry for it.Copy !req
696. Find her guilty on that charge,Copy !req
697. not on the charge of endangering
Jamie's life.Copy !req
698. Jamie slipped through
a crack in the system.Copy !req
699. Blame the system,Copy !req
700. blame the man who killed Jamie,Copy !req
701. but don't blame
the social worker.Copy !req
702. Mariel Plummer was the crack
in the system.Copy !req
703. She was the one person whose job
it was to look out for Jamie,Copy !req
704. and she failed to do her job.Copy !req
705. If she'd made any one
of the visitsCopy !req
706. she fraudulently claimedCopy !req
707. to have made, or returned any
one of the phone calls,Copy !req
708. Jamie would be alive.Copy !req
709. She turned her back on him.Copy !req
710. That is child endangerment.Copy !req
711. This time you must blame
the social worker.Copy !req
712. Find Mariel guilty and send
a message to her,Copy !req
713. to her supervisors
and to the cityCopy !req
714. and to the state,Copy !req
715. that the death of even one child
is unacceptable.Copy !req
716. Verdict in already?Copy !req
717. Guilty
on the record tampering,Copy !req
718. not guilty on
child endangerment.Copy !req
719. Why not?Copy !req
720. Maddox played the jury
like a violin.Copy !req
721. Mariel was under intolerable
pressure,Copy !req
722. she made an understandable
mistake.Copy !req
723. They bought it.Copy !req
724. At least when
you try Sam Dufoy,Copy !req
725. he won't be able
to blame Mariel.Copy !req
726. Unless I blow that trial, too.Copy !req
727. Someone's got to be accountable
for that poor kid's death.Copy !req
728. I may have something.Copy !req
729. Clear evidence of abuse
from the Dufoy apartment.Copy !req
730. Why'd it take so long?Copy !req
731. Sample had to work its way from
Criminalistics to Serology.Copy !req
732. Remember the stain
on Jamie's bed?Copy !req
733. It's blood.Copy !req
734. Lab finally ID'd the object
that made it:Copy !req
735. a cheese grater.Copy !req
736. Serology found skin cells
and cheese fragments.Copy !req
737. Someone dragged a cheese grater
across the kid's skin?Copy !req
738. How old is the blood stain?Copy !req
739. At most a few days.Copy !req
740. Otherwise the blood would
have oxidized completely.Copy !req
741. But Jamie didn't haveCopy !req
742. any other marks on him.Copy !req
743. That's because it wasn't
Jamie's blood.Copy !req
744. It's from a female.Copy !req
745. Mom?Copy !req
746. Wrong blood group.Copy !req
747. And from the low levels
of the hormonesCopy !req
748. FSH and LH in her blood,Copy !req
749. this female is in early puberty.Copy !req
750. The Dufoys had a girl
in that apartment?Copy !req
751. Then where the hell is she?Copy !req
752. Go talk to Mariel.Copy !req
753. See if she made another
understandable mistake.Copy !req
754. What do you want?Copy !req
755. Aren't you done
harassing me?Copy !req
756. Don't kid yourself, lady,
you got off light.Copy !req
757. I lost my job, my pension,Copy !req
758. I've been crucified
by the press.Copy !req
759. I get threatening
phone calls...Copy !req
760. I don't have time for
your self-pity.Copy !req
761. Where's the other foster kid
that was stayingCopy !req
762. in the Dufoys' apartment?Copy !req
763. What are you talking about?Copy !req
764. Jamie was their only child.Copy !req
765. You saw my records.Copy !req
766. Your records don't mean
a damn thing.Copy !req
767. Forensics says there was
another girl there.Copy !req
768. What forensics?Copy !req
769. The girl's blood.Copy !req
770. Sam Dufoy sliced her up
with a cheese grater.Copy !req
771. Oh, my God, I... I had no idea.Copy !req
772. Why didn't I go
to the apartment?Copy !req
773. I'm so sorry.Copy !req
774. Yeah, I bet you are.Copy !req
775. Just tell me where she is
and how I can find her.Copy !req
776. I don't know...Copy !req
777. Hello.Copy !req
778. Just leave me alone!Copy !req
779. Give me this.Copy !req
780. Yeah, who the hell
you calling a bitch?Copy !req
781. This is the police.Copy !req
782. Ring this number again
we're going to comeCopy !req
783. busting in your damn door.Copy !req
784. Believe that.Copy !req
785. Mariel...Copy !req
786. Okay, okay, okay.Copy !req
787. Put the gun down.
Come on.Copy !req
788. Please put down the gun.Copy !req
789. I saved thousands of children
and I'll only be rememberedCopy !req
790. for one.Copy !req
791. No...
( gunshot )Copy !req
792. You didn't have to do this.Copy !req
793. Single shot to the
chest, point blank.Copy !req
794. This should be a
quick job for you.Copy !req
795. Thanks.Copy !req
796. Are you okay?Copy !req
797. I'm cool.Copy !req
798. I know.Copy !req
799. But are you okay?Copy !req
800. Yeah.Copy !req
801. You come to shrink me, too?
Nope. You need me,
you'll holler.Copy !req
802. Yeah, I do.Copy !req
803. Would you get over to ACS,
see what you can findCopy !req
804. on a foster kid— a girl—
staying with the Dufoys.Copy !req
805. Mariel Plummer didn't
know who she was?Copy !req
806. If she had have checked
on Jamie, she would've,Copy !req
807. but, uh, I told her
about the blood stain.Copy !req
808. That's when
she shot herself.Copy !req
809. Where you going?Copy !req
810. I'm going to go
get cleaned up.Copy !req
811. Then I'm going to pay
Sam Dufoy a visit.Copy !req
812. I don't know
what you're talking about.Copy !req
813. People who say that
usually mean they do.Copy !req
814. There was no girl
living with us.
!
You're a liar.Copy !req
815. You cut her
and left her bloodCopy !req
816. and skin on the bed—
what's her name?Copy !req
817. He told you:
he doesn't know.Copy !req
818. You kill her too?Copy !req
819. Like you killed Jamie?Copy !req
820. Guard, we're through here.Copy !req
821. Is she alive?Copy !req
822. What did you do with her?Copy !req
823. Where the hell is she?Copy !req
824. That bastard
didn't give me a thing.Copy !req
825. What about Lori-Ann?Copy !req
826. She'll just come out with
that "Sam's a good man" crap.Copy !req
827. You got anything?Copy !req
828. Yep. ACS have no recordCopy !req
829. of any other kids
placed with Sam Dufoy.Copy !req
830. So I got them to check under
Lori-Ann's maiden name.Copy !req
831. Four kids were placed
with Lori-Ann Watkins
in the last two years—Copy !req
832. all from Freshfields
private foster home.Copy !req
833. Is one of them our girl?Copy !req
834. Last kid was placed with
Lori-Ann six months ago,Copy !req
835. but ran away a
couple weeks later.Copy !req
836. Her name is Megan Rose.Copy !req
837. Why the hell did ACSCopy !req
838. only hear about this now?
ACS saysCopy !req
839. they never got the report
Megan was missing.Copy !req
840. Freshfields insists
they sent it.Copy !req
841. While they're playing pass
the buck, Megan could be dead.Copy !req
842. John, find out why
this foster agencyCopy !req
843. went on sending
kids to a womanCopy !req
844. who kept on
losing them— Fin!Copy !req
845. I'm hauling her ass in.Copy !req
846. Yeah, of course
I know Megan.Copy !req
847. She ran away a week after
being placed with us.Copy !req
848. I'm afraid she
was incorrigible.Copy !req
849. And that just
slipped your mind.Copy !req
850. It was six months ago.Copy !req
851. I'm sorry, it didn't
seem relevant.Copy !req
852. What about Stacey Dean,
Isiah Simpson, Nyal Iwa?Copy !req
853. They incorrigible too?Copy !req
854. Yes.Copy !req
855. They've been in the foster care
system their entire lives.Copy !req
856. Sam is a great dad, and even
he couldn't cope with them.Copy !req
857. He "take care of them"
the same way he did Jamie?Copy !req
858. They ran away.Copy !req
859. We tried to help these kids,Copy !req
