of pledge class?Copy !req
439. Ty didn't like pledges
who spoke their minds.Copy !req
440. Best thing
that ever happened anyway.Copy !req
441. Alicia hated the fraternity.Copy !req
442. So, that's why you killed him?Copy !req
443. Alicia put you up to it?Copy !req
444. You've got
to be kidding me.Copy !req
445. Ty was a pig, but that's
no reason to kill him.Copy !req
446. So, who dumped his bodyCopy !req
447. at the water
treatment plant
last Saturday night?Copy !req
448. How should I know?Copy !req
449. We were at the movies.Copy !req
450. That's just
a coincidenceCopy !req
451. that Tyler ended up
at the same facilityCopy !req
452. you'd been researching.Copy !req
453. I don't know.
I can't explain it.Copy !req
454. How do you explain that?Copy !req
455. What's that?Copy !req
456. Fibers we found inside Tyler.Copy !req
457. They match
your violin bow.Copy !req
458. You shoved that bowCopy !req
459. so far up your buddy's backside,Copy !req
460. you left wood and horsehairCopy !req
461. up there.Copy !req
462. That is sick.Copy !req
463. And it wasn't me.Copy !req
464. My bow's in its case.Copy !req
465. Your fancy
one's missing.Copy !req
466. The cheap replacement
was in the case.Copy !req
467. Okay, so I-I-I stepped
on the old one,Copy !req
468. so I threw it out.Copy !req
469. I wasn't going to spend
three grand to replace it.Copy !req
470. You should've replaced
your violin strings, too.Copy !req
471. Your bow left hair residue
on them.Copy !req
472. It matches the hairs
we found inside Tyler.Copy !req
473. I didn't kill Tyler.Copy !req
474. But Nathan did,
didn't he?Copy !req
475. Now you better
start telling us
what happenedCopy !req
476. or you're both
going to jail.Copy !req
477. Do you hear me?Copy !req
478. It was Will.Copy !req
479. Nathan's roommate?Copy !req
480. He called my place
around midnight.Copy !req
481. He was freaking outCopy !req
482. and said he needed to talk
to Nathan.Copy !req
483. How did Will know Tyler?Copy !req
484. He pledged with Nathan,
but quit last month.Copy !req
485. Nathan's still not giving us
anything.Copy !req
486. You get a hold of Will?Copy !req
487. Nobody on campus
has seen WillCopy !req
488. for the last couple
of hours.Copy !req
489. He's not in his room,
not in class,
not in the library.Copy !req
490. What about Nathan
and Alicia's alibi?Copy !req
491. It checks out.Copy !req
492. The concessions manager
at the theaterCopy !req
493. remembers the pink hair.Copy !req
494. The LUDS also confirm
a phone callCopy !req
495. from Will's cell phone
to Alicia's room.Copy !req
496. 12:55 A.M.Copy !req
497. So, Will's our guy.Copy !req
498. This is ER at Bellevue.Copy !req
499. Will gave Nathan
as his emergency contact.Copy !req
500. He just drove his car
into a wall.Copy !req
501. Police.Copy !req
502. Hey, excuse me—
where are you taking him?Copy !req
503. To surgery.Copy !req
504. He's ruptured
his spleen.Copy !req
505. Give me one second
with him. Will?Copy !req
506. Will...
can you hear me?Copy !req
507. Hey...
it's the violin cops.Copy !req
508. Will, did you
kill Tyler?Copy !req
509. Look, we knowCopy !req
510. you called Nathan.Copy !req
511. We know he went
to help you.Copy !req
512. Did you kill Tyler?Copy !req
513. Yeah.Copy !req
514. I'm sorry.Copy !req
515. Docket number 101771,
People v. William Caray.Copy !req
516. One count murder
in the second degree.Copy !req
517. Let the record showCopy !req
518. that we are at the Bellevue
Hospital Prison WardCopy !req
519. where the defendant
is recoveringCopy !req
520. from
life-threatening injuries.Copy !req
521. How do you plead,
Mr. Caray?Copy !req
522. Not guilty.Copy !req
523. The defendant seems
to have forgottenCopy !req
524. he confessed to the crime,
Your Honor.Copy !req
525. His parents
are extremely wealthy.Copy !req
526. He's a significant flight risk.Copy !req
527. The People request remand.Copy !req
528. He's looking at six month's
physical therapyCopy !req
529. in a rehabilitation center.Copy !req
530. He's not going anywhere.Copy !req
531. Let's make sure of that.Copy !req
532. Mr. Caray will surrender
his passportCopy !req
533. and wear a monitoring device
at all times.Copy !req
534. Bail is set at $200,000Copy !req
535. and if there's nothing else,Copy !req
536. I'd like to get back
to my courtroom.Copy !req
537. Man One, he serves
five to seven.Copy !req
538. I have a confession
and a pile of evidence.Copy !req
539. No deal.Copy !req
540. There are mitigating
circumstances.Copy !req
541. My client just tried
to kill himself.Copy !req
542. Doesn't make him any less
of a murderer.Copy !req
543. Will Caray
is the victim here.Copy !req
544. He just attempted suicide
because he was sufferingCopy !req
545. from rape trauma
syndrome.Copy !req
546. Since when
was Will Caray raped?Copy !req
547. Tyler Henry
sexually assaulted WillCopy !req
548. when he was making
his pledge for Tau Omega.Copy !req
549. Why didn't Will
go to the police?Copy !req
550. Because he was ashamed
and embarrassed.Copy !req
551. Like most
rape victims.Copy !req
552. How lucky for your defenseCopy !req
553. that he finally decided
to talk about his ordeal.Copy !req
554. Do you know
what teabagging is?Copy !req
555. Do I want to?Copy !req
556. Tyler Henry
made his pledgesCopy !req
557. get on their knees
so he could rub
his testiclesCopy !req
558. across their faces.Copy !req
559. Disgusting, but not rape.Copy !req
560. He sodomized WillCopy !req
561. with a pledge paddle.Copy !req
562. That is rape.Copy !req
563. Can you prove it?Copy !req
564. Of course not.Copy !req
565. Because, conveniently,Copy !req
566. your client killed
his alleged rapist.Copy !req
567. You don't believe me?Copy !req
568. Have your shrink
talk to him.Copy !req
569. Why do we have to do this?Copy !req
570. My lawyer already told you
what happened.Copy !req
571. Yeah, he said you
and TylerCopy !req
572. went down to the basement
of the frat house,Copy !req
573. where Tyler
sodomized you.Copy !req
574. Did he force you
to go down there?Copy !req
575. No, he just grabbed
his paddleCopy !req
576. and said it was time
to make me a man.Copy !req
577. He ordered you
to take your pants downCopy !req
578. and quote,
"Assume the position."Copy !req
579. And you did.Copy !req
580. Why?Copy !req
581. Pledgemaster says "Jump,"
you say, "How high?"Copy !req
582. So you wereCopy !req
583. just going to take whateverCopy !req
584. punishment he dished out
even if it meantCopy !req
585. being sodomized
with a paddle?Copy !req
586. Did you tell him
to stop?Copy !req
587. No.Copy !req
588. Why not?Copy !req
589. I was afraid he'd hurt me worse
if I complained.Copy !req
590. Why didn't
you quit?Copy !req
591. I didn't want to be a wuss.Copy !req
592. But you quit later.Copy !req
593. I was sick and tired
of his crap.Copy !req
594. I didn't want to take it
anymore.Copy !req
595. Is that why you killed him?Copy !req
596. I didn't mean to.Copy !req
597. He came overCopy !req
598. to my place, he started yelling,Copy !req
599. calling me a quitter,
pushing me around.Copy !req
600. I thought he was going to rape
me again,Copy !req
601. so... I grabbed a blender
and I hit him.Copy !req
602. Will, he was just lying there.Copy !req
603. Why did you sodomize him
with the violin bow?Copy !req
604. I wanted to do to him
what he did to me.Copy !req
605. Because you were
still angry.Copy !req
606. Yes.Copy !req
607. You let him rape you,
didn't you, Will?Copy !req
608. Yes.Copy !req
609. He's a text book example
of rape trauma syndrome.Copy !req
610. He was raped,
but like most victims,Copy !req
611. he blames himself
for not trying harderCopy !req
612. to stop the attack.Copy !req
613. Except Will
didn't fight back.Copy !req
614. All he had to do
to stop the alleged rape
was quit pledging.Copy !req
615. And make himself
a social outcast.Copy !req
616. None of his
frat rat buddiesCopy !req
617. would have gone
anywhere near him.Copy !req
618. Doesn't get worse
for a scared freshman.Copy !req
619. Initiation
is all aboutCopy !req
620. making the pledges
prove themselves as men.Copy !req
621. If you fail, you're not a man.Copy !req
622. How does shovingCopy !req
623. a paddle up anyone's
tailpipe prove anything?Copy !req
624. It's about dominance.Copy !req
625. Like a rapist wanting
to feel power over a woman.Copy !req
626. Same reason they give
the pledges girls' names.Copy !req
627. Okay, say Tyler
did sodomize Will.Copy !req
628. Where's the paddle?Copy !req
629. I'm not considering a plea
without proof.Copy !req
630. We're going to need warrants.Copy !req
631. Search orders, phone records.Copy !req
632. You'll have them.Copy !req
633. But find the paddle
or a corroborating witness.Copy !req
634. Otherwise, I'm indicting Will
for Murder Two.Copy !req
635. No way Tyler raped Will.Copy !req
636. He went a little
medieval sometimes,Copy !req
637. especially during
encounter sessions,Copy !req
638. but he'd never do
something like that.Copy !req
639. What's an encounter
session?Copy !req
640. Um, Ty and one
of the brothersCopy !req
641. would take a pledge
down to the basement.Copy !req
642. They'd smack you around,Copy !req
643. see how much
you'd put up with,Copy !req
644. but someone always
went with TyCopy !req
645. to make sure it wouldn't
get too out of hand.Copy !req
646. Someone like who?Copy !req
647. I-I don't know.Copy !req
648. They keep
the basement dark,Copy !req
649. there's, um,
there's loud music.Copy !req
650. I'm sorry,
I got a midterm.Copy !req
651. He doesn't want to get
the brothers in trouble.Copy !req
652. If he keeps lying about what
happened in that frat house,Copy !req
653. he's the one who's
going to be in trouble.Copy !req
654. I'll talk to him.Copy !req
655. You do whatever
you have to do,Copy !req
656. but I'm telling you,Copy !req
657. if he doesn't start
cooperating with us,Copy !req
658. Nathan's going
to wind up in jail.Copy !req
659. Well, that was Fin.Copy !req
660. The lab found nothingCopy !req
661. on the paddles that
were seized from the frat.Copy !req
662. They've searched
Xander Henry's apartment.Copy !req
663. Tyler spent a lot of
time there with his dad.Copy !req
664. There's nothing there,
either.Copy !req
665. And both the alleged victim
and his best friendCopy !req
666. say there was no rape.Copy !req
667. Nathan's
covering.Copy !req
668. He's still trying
to show his frat buddiesCopy !req
669. what a standup
guy he is.Copy !req
670. There is no case here.Copy !req
671. Why are we even
debating this?Copy !req
672. We're waiting on the LUDS
from both places.Copy !req
673. Elliot.Copy !req
674. Everything okay?Copy !req
675. I got what you wanted.Copy !req
676. What's this?Copy !req
677. The Tau Omega
initiation ledger.Copy !req
678. They keep a journal of what
they do to the pledges.Copy !req
679. This one goes back
to the '70s.Copy !req
680. Did you steal this?Copy !req
681. Is has everything you
need to nail the Taus.Copy !req
682. I can't accept it.Copy !req
683. It's all here.Copy !req
684. Not just pledging
stuff, either.Copy !req
685. It's like an
instruction manual.Copy !req
686. "Spike a girl's beer
with grain alcoholCopy !req
687. "and watch her eyes
roll over.Copy !req
688. "Tell her she can
sleep it off upstairsCopy !req
689. "and let the games begin.Copy !req
690. Just make sure you dress
her again when you're done."Copy !req
691. Please,
just read it.Copy !req
692. We've made cases before
with stolen evidence?Copy !req
693. Okay.Copy !req
694. Let's roll the dice.Copy !req
695. "I think we cracked Pledge
Susie's skull tonightCopy !req
696. "playing hammer ball.Copy !req
697. "We couldn't
wake him up,Copy !req
698. so we dumped him
outside the ER."Copy !req
699. Where'd this come from?Copy !req
700. An informant.Copy !req
701. And every entry is
worse than the last.Copy !req
702. It's like
each pledge classCopy !req
703. wanted to outdo
the one before it.Copy !req
704. "Pledge Kathy was being
a weenie tonight,Copy !req
705. "so we showed him
what we do to weenies.Copy !req
706. "He'll crap
blood tomorrow,Copy !req
707. but we'll make a man
out of him yet."Copy !req
708. That entry is dated the day
Will Caray says he was raped.Copy !req
709. This wasn't an initiation,
this is pure sadism.Copy !req
710. We should
close these idiots down.Copy !req
711. Does the ledger
give any names?Copy !req
712. Just frat pseudonyms.Copy !req
713. What's Tyler's?Copy !req
714. The pledge masterCopy !req
715. is referred
to as Brother Dahmer.Copy !req
716. Oh, that's cute.Copy !req
717. What do you want to do,
counselor?Copy !req
718. Well, I was wrong about
Will's rape trauma defense.Copy !req
719. I'll plead him out.
Man Two.Copy !req
720. With this evidence,Copy !req
721. he'll probably get
five years probation.Copy !req
722. That's getting off
pretty easy for murder.Copy !req
723. If Will Caray was a woman
who killed her rapist,Copy !req
724. would it be an issue?Copy !req
725. The question is, what do
we do about the frat?Copy !req
726. I mean, Tyler Henry's
already been punished,Copy !req
727. he's dead.Copy !req
728. But I bet
he didn't act alone.Copy !req
729. You're right.Copy !req
730. The day of Will's rape,Copy !req
731. two frat boys
ran the initiation.Copy !req
732. Brother Dahmer
and Brother Kong.Copy !req
733. Who's Brother Kong?Copy !req
734. The guy who's been writing
in the ledger this year.Copy !req
735. Let's get him.Copy !req
736. Even if he just
guarded the door,Copy !req
737. he's still
an accessory to rape.Copy !req
738. Will should be able
to give us his real name.Copy !req
739. So should Nathan Angeli.Copy !req
740. I told you, I don't know
anything about Will being raped.Copy !req
741. Nathan, do you
know anythingCopy !req
742. about pledges being dragged
unconscious to the hospital?Copy !req
743. No.Copy !req
744. A copy of the Tau Omega
Initiation Ledger.Copy !req
745. "We dumped Pledge Susie
by the ER doors.Copy !req
746. "Pledge Nancy
dropped his legs twice,Copy !req
747. so I had to take
a hockey stick to his knuckles."Copy !req
748. You were Pledge Nancy.Copy !req
749. We're not discussing
a dealCopy !req
750. until I've had a chance
to look through that.Copy !req
751. Well, knock
yourself out.Copy !req
752. Your client knows
exactly what it says.Copy !req
753. You're already on the hookCopy !req
754. for helping Will dump
Tyler Henry's body.Copy !req
755. That's hindering
prosecution.Copy !req
756. Two and a third to seven.Copy !req
757. With this, I've got
a shot at assault,Copy !req
758. depraved
indifference,Copy !req
759. maybe even conspiracy
to commit rape.Copy !req
760. You got to help me out.Copy !req
761. What are you offering?Copy !req
762. Suspended
sentence.Copy !req
763. No jail time,Copy !req
764. in exchange
for Nathan's testimonyCopy !req
765. against the fraternity.Copy !req
766. You've got a deal.Copy !req
767. Good.Copy !req
768. Who is Brother Kong?Copy !req
769. Rob.Copy !req
770. Rob Sweeney.Copy !req
771. Drink! Drink!
Drink! Drink!Copy !req
772. Faster, faster,
faster, Pledge Patsy.Copy !req
773. Detectives,
you want a beer?Copy !req
774. Anybody who doesn't
want to be arrestedCopy !req
775. for underage drinking,
I suggest you leave now.Copy !req
776. Rob Sweeney,
you're under arrestCopy !req
777. for aggravated
sexual abuse.Copy !req
778. I didn't abuse anybody.Copy !req
779. What do you call
beating up a pledgeCopy !req
780. with a hockey stick?Copy !req
781. Pledge hockey.Copy !req
782. You have the right
to remain silent, smartass.Copy !req
783. You give up that right,
anything you say can and willCopy !req
784. be used against you
in the court of law.Copy !req
785. You have the right
to an attorney.Copy !req
786. In the unlikely eventCopy !req
787. that daddy can't
afford one for you,Copy !req
788. the court will
appoint one to you.Copy !req
789. Weren't you peopleCopy !req
790. ever young?Copy !req
791. Don't you know the differenceCopy !req
792. between a harmless prank
and assault?Copy !req
793. Why don't you
explain it to me.Copy !req
794. But speak up, 'cause I'm
starting to lose my hearing.Copy !req
795. Not another word, Rob.Copy !req
796. I want to see
your arrest warrant.Copy !req
797. Mr. Henry, you can't
represent this client.Copy !req
798. Why? Because I might
expose the factCopy !req
799. that you cut a sweetheart
deal with a murdererCopy !req
800. and now you've decided
to prosecute an innocent kid?Copy !req
801. No.Copy !req
802. Because Mr. Sweeney's
abuse of Will CarayCopy !req
803. led directly to
your son's death.Copy !req
804. That's a clear
conflict of interest.Copy !req
805. She's letting
my son's killer go.Copy !req
806. Mr. Henry can't be
an objective advocate.Copy !req
807. He has a personal
stake in this.Copy !req
808. He's the murder
victim's father.Copy !req
809. He's representing
the interests of his son.Copy !req
810. That's incentive,
not conflict.Copy !req
811. My son would want
his best friend acquittedCopy !req
812. and his killer's ludicrous
defense discredited.Copy !req
813. There is no diverging interest.Copy !req
814. He's right.Copy !req
815. But it's your call, Mr. Sweeney.Copy !req
816. The court will grant you
a continuanceCopy !req
817. if you want
to find a new attorney.Copy !req
818. I don't, Your Honor.Copy !req
819. The record
will showCopy !req
820. Mr. Sweeney waived his right
to an alternate counsel.Copy !req
821. Is there anything else?Copy !req
822. Motion to suppress
the Tau Omega ledgerCopy !req
823. as an illegal seizure,
Your Honor.Copy !req
824. Detective StablerCopy !req
825. received the ledger
from an informant.Copy !req
826. Alicia Morley,
who broke into the Tau HouseCopy !req
827. and vandalized it to the tuneCopy !req
828. of $4,000 and
stole the ledger.Copy !req
829. Even if the ledger
had been stolen,Copy !req
830. that doesn't automatically
make it inadmissible.Copy !req
831. It's inadmissibleCopy !req
832. if she was acting
as an agent of the police.Copy !req
833. Alicia came
to the police on her own.Copy !req
834. After Detective Stabler told her
to do whatever she had toCopy !req
835. to help the police
make their case.Copy !req
836. Which means she was acting
under his direction,Copy !req
837. which means
the ledger's inadmissible.Copy !req
838. I agree.Copy !req
839. Motion to suppress granted.Copy !req
840. Tyler's dad came to see me.Copy !req
841. He said I was going
to get arrestedCopy !req
842. for stealing the ledger.Copy !req
843. I freaked.Copy !req
844. I told him I was just
doing what you told me.Copy !req
845. I didn't tell youCopy !req
846. to steal anything.Copy !req
847. And I sure as hell
didn't tell youCopy !req
848. to vandalize
the fraternity.Copy !req
849. I swear,Copy !req
850. I didn't wreck the place.Copy !req
851. Then who did?
I don't know.Copy !req
852. Tyler's dad saidCopy !req
853. I was going to go to jail.Copy !req
854. I'm sorry.Copy !req
855. I was just trying to help.Copy !req
856. I think the brothers
vandalizedCopy !req
857. their own house and
made it look like a break-in.Copy !req
858. Yeah, criminal trespass
is just a slap on the wrist.Copy !req
859. Felony vandalism,
on the other hand,Copy !req
860. buys you three
years in jail.Copy !req
861. And Tyler's father
scares Alicia into sayingCopy !req
862. I told her
to steal that ledger.Copy !req
863. Makes the ledger disappear.Copy !req
864. You've got to challenge
her statement.Copy !req
865. Tell the court you never told
Alicia to steal anything.Copy !req
866. Olivia will back you up.Copy !req
867. And Alicia goes to jail
for trying to help us out.Copy !req
868. I don't think so.Copy !req
869. Without the ledger,Copy !req
870. all we have are the testimonies
of Nathan and Will.Copy !req
871. And they've seen
Sweeney in action.Copy !req
872. Let them just paint
the picture for the jury.Copy !req
873. Whoa, whoa, whoa, the word
of two fallen pledgesCopy !req
874. against the all-American
fraternity.Copy !req
875. Xander Henry
will say they're lying.Copy !req
876. I can't prove otherwise.
I lose.Copy !req
877. Casey, Rob Sweeney
enjoys causing pain.Copy !req
878. This is a bad guy
who needs to be put away.Copy !req
879. All right,
I'll do what I can.Copy !req
880. But in the meantime, you and
Olivia keep looking, all right?Copy !req
881. Find me something I can
use to nail the bastard.Copy !req
882. Rob would make us stand naked
in the snow.Copy !req
883. He'd hit us with
hockey sticks,Copy !req
884. kick us sometimes.Copy !req
885. A couple of guys
wound up in the ER.Copy !req
886. How was Tyler
Henry involved?Copy !req
887. Tyler was pledge master.Copy !req
888. He made sure he did everything
Rob told us to do.Copy !req
889. Tell the juryCopy !req
890. what happened on
the night of December 5.Copy !req
891. Rob and Tyler took
me to the basement.Copy !req
892. Rob said they wantedCopy !req
893. to see if I was man enough
to take a good paddling.Copy !req
894. So, I took my pants downCopy !req
895. and Ty paddled me.Copy !req
896. What did
the defendant do?Copy !req
897. He kicked me,Copy !req
898. he flicked lit
cigarettes at me.Copy !req
899. Said, "Hit him harder,
hit him harder,"Copy !req
900. and when Tyler wouldn't,Copy !req
901. he grabbed the paddle...Copy !req
902. and he called me a queer.Copy !req
903. What did he do then?Copy !req
904. He grabbed the paddleCopy !req
905. and he turned it around
and he stuck the handle in me.Copy !req
906. He was like, "Are you going
to quit now, fag?Copy !req
907. Are you going
to quit now?"Copy !req
908. When he
was finished,Copy !req
909. I heard Ty tell him
that I was bleeding.Copy !req
910. What did Mr. Sweeney
have to say about that?Copy !req
911. He said, "What do you expect
from a woman?"Copy !req
912. Thank you.Copy !req
913. Nothing further.Copy !req
914. Why did you kill Tyler?Copy !req
915. I was afraid he was
going to rape me again.Copy !req
916. But you just said
that it was RobCopy !req
917. who raped you.
Why be afraid of Tyler?Copy !req
918. Because he was
a part of it.Copy !req
919. He did whatever
Rob told him to.Copy !req
920. Well, if Tyler didn't rape you,Copy !req
921. then why did you tell
your lawyer that he did?Copy !req
922. Because I didn't want
to get Rob in trouble.Copy !req
923. So you lied.Copy !req
924. Yes.Copy !req
925. And you told
the same lieCopy !req
926. to the police psychiatrist,
Dr. Huang.Copy !req
927. Yes.Copy !req
928. And now you're lying
to the jury.Copy !req
929. No, I'm telling the truth.Copy !req
930. The truth is,
you cut a dealCopy !req
931. with the police
and you will tellCopy !req
932. any lie, blame anyone,
just to save your own skin.Copy !req
933. Objection.Copy !req
934. Withdrawn.Copy !req
935. Nothing further.Copy !req
936. While you were pledging
Tau Omega,Copy !req
937. please describe what the
defendant would make you do.Copy !req
938. Push-ups, jumping jacks,
stuff like that.Copy !req
939. Push-ups, jumping jacks,
what else?Copy !req
940. That-That was basically it.Copy !req
941. You were never paddledCopy !req
942. or forced to stand
in the snowCopy !req
943. or made to drink
until you threw up?Copy !req
944. I wasn't forced.Copy !req
945. I did it because
I wanted to.Copy !req
946. Your grand jury
testimony—Copy !req
947. "We had to stand
in the snow so longCopy !req
948. "I thought
I'd freeze to death.Copy !req
949. "Rob made us
drink so muchCopy !req
950. I puked
for three days."Copy !req
951. You were forced
to do these things?Copy !req
952. Or are you changing
your testimony?Copy !req
953. No, no, we had to, but...Copy !req
954. it was, it was fun.Copy !req
955. Rob didn't make us
do anythingCopy !req
956. we weren't okay with.Copy !req
957. What's that
on your jacket, Nathan?Copy !req
958. It's my pledge pin.Copy !req
959. You were invited
back to Tau Omega?Copy !req
960. Yes.Copy !req
961. As long as you didn't
testify against Rob Sweeney.Copy !req
962. Objection.Copy !req
963. Sustained.Copy !req
964. Nothing further.Copy !req
965. So Nathan changes his storyCopy !req
966. and you're
going to let him walk?Copy !req
967. He violated
the terms of the deal.Copy !req
968. No, he didn't lie,Copy !req
969. he just gave a different
interpretation of events.Copy !req
970. We can't arrest him.Copy !req
971. Okay, so we still
got the weekend.Copy !req
972. What can we do?Copy !req
973. I have to convince
the juryCopy !req
974. that Will Caray was raped
and that Rob Sweeney did it,Copy !req
975. but without
another witnessCopy !req
976. or some physical evidence,
I'm sunk.Copy !req
977. I called every single member
of that pledge class.Copy !req
978. Nobody will talk.Copy !req
979. Checked out
the LUDS.Copy !req
980. Tau Omega's, Will and Henry's,
Tyler's home.Copy !req
981. The only thing
that doesn't add upCopy !req
982. is a bunch of calls
from the mortuaryCopy !req
983. to Xander Henry's home.Copy !req
984. Six of them
in the last 48 hours.Copy !req
985. Three weeks after the funeral?Copy !req
986. Check it out.Copy !req
987. I kept calling and calling.Copy !req
988. This jerk Henry wouldn't
return my messages.Copy !req
989. What was so important?Copy !req
990. We always double-check
with the familyCopy !req
991. before incinerating
any personals.Copy !req
992. Thanks.Copy !req
993. Personals?Copy !req
994. Mementos people
put in the coffin—Copy !req
995. photos, letters,
that kind of thing.Copy !req
996. Guy finally calls back
yesterday,Copy !req
997. says he doesn't have
time to come down.Copy !req
998. Just burn everything.Copy !req
999. Have you done it yet?Copy !req
1000. It's waiting in line.
Be my guest.Copy !req
1001. Letterman jacket,Copy !req
1002. high school yearbook...Copy !req
1003. condoms for
the after party.Copy !req
1004. Someone tried
to bleach it clean,Copy !req
1005. but it's your paddle,
all right.Copy !req
1006. I found traces of blood
and fecal matterCopy !req
1007. deep in the grain
of the wood.Copy !req
1008. Does it match Will Caray?Copy !req
1009. It's definitely his DNA.Copy !req
1010. That's my property.
You had no right to seize it.Copy !req
1011. You told the funeral home
to burn it.Copy !req
1012. That makes it
discarded property.Copy !req
1013. We can do whatever
we want with that.Copy !req
1014. Have those lab results
faxed over to my office.Copy !req
1015. Thanks.Copy !req
1016. Spin it any way you want,
counselor.Copy !req
1017. You know
Rob Sweeney's guilty.Copy !req
1018. I've Rob since
he was a freshman.Copy !req
1019. He's a good kid.Copy !req
1020. He's a rapist.Copy !req
1021. That's some nice
ink on your arm.Copy !req
1022. How many men
in your platoonCopy !req
1023. got heat stroke or broken bones
trying to earn that tattoo?Copy !req
1024. You were pushed as far
as you could goCopy !req
1025. so you would bond as a unit.Copy !req
1026. That's what a fraternity
is all about.Copy !req
1027. Rob Sweeney doesn't give
a damn about bonding.Copy !req
1028. You've read the ledger.Copy !req
1029. That's just talk.Copy !req
1030. He wrote down exactlyCopy !req
1031. what he did and that paddle
proves he raped Will CarayCopy !req
1032. and sent your son over
to his apartmentCopy !req
1033. to beat on him some more.Copy !req
1034. Or was it you who told Tyler
to go over there?Copy !req
1035. Why would I do that?Copy !req
1036. You tell me.Copy !req
1037. It's your phone records
that showCopy !req
1038. you spoke to your son twice
on the day he was murdered.Copy !req
1039. Did you call to give him your
little pep talk on bonding?Copy !req
1040. What we talked about's
none of your business.Copy !req
1041. Pledge master whose pledge
quits on him.Copy !req
1042. That's got to be
the ultimate failure, huh?Copy !req
1043. So, you tell Tyler
to bring Will CarayCopy !req
1044. back in the fold
any way he has to.Copy !req
1045. But Tyler didn't want to,
did he?Copy !req
1046. He knew SweeneyCopy !req
1047. had gone too far.Copy !req
1048. I didn't believe what
Ty was telling me.Copy !req
1049. Because you didn't know
what Sweeney was doing.Copy !req
1050. Now you do.Copy !req
1051. Sweeney caused all of this.Copy !req
1052. Your son's death.Copy !req
1053. How can you defend him?Copy !req
1054. It's my job.Copy !req
1055. Mr. Sweeney...Copy !req
1056. have you
seen this before?Copy !req
1057. That's Tyler Henry's
fraternity paddle.Copy !req
1058. Why was Will Caray's
blood found on the handle?Copy !req
1059. Ty shoved the paddle
into Will.Copy !req
1060. Will Caray saidCopy !req
1061. you sodomized him
with the paddle.Copy !req
1062. No. I tried to stop Ty.Copy !req
1063. Will was drunk.Copy !req
1064. He was confused.Copy !req
1065. Why did you put the paddle
in Tyler Henry's casket?Copy !req
1066. Ty loved his fraternity.Copy !req
1067. He would've wanted to been
buried with his paddle.Copy !req
1068. The police searched Tau Omega
for the paddle.Copy !req
1069. Why didn't you tell them
where it was?Copy !req
1070. I didn't want them
calling Ty a rapistCopy !req
1071. on top of everything else.Copy !req
1072. So you put the paddle
in his casketCopy !req
1073. to keep the police
from finding it?
Yes.Copy !req
1074. Because you knew
it implicated youCopy !req
1075. in the rape of Will Caray.Copy !req
1076. No. I was trying to protect Ty.Copy !req
1077. Of course you were.Copy !req
1078. Nothing further.Copy !req
1079. Did Tyler Henry rape Will Caray?Copy !req
1080. Yes.Copy !req
1081. As president
of the fraternity,Copy !req
1082. have you ever intentionally
hurt one of your pledges?Copy !req
1083. No.Copy !req
1084. You've never made a pledge stand
for hours in the snowCopy !req
1085. or hit them with a hockey stick.Copy !req
1086. No, never.Copy !req
1087. And you never instructed
one of the other brothers
to physically hurt a pledge?Copy !req
1088. Sidebar, Your Honor.Copy !req
1089. The witness just denied beating
pledges with a hockey stick,Copy !req
1090. but in the Tau Omega ledger
he said, and I quote,Copy !req
1091. "Pledge Nancy dropped
his legs twice,Copy !req
1092. so I had to take
a hockey stick
to his knuckles."Copy !req
1093. The People moveCopy !req
1094. to re-admit
the ledger in rebuttal.Copy !req
1095. The ledger was
illegally seized.
It's inadmissible.Copy !req
1096. It was until you
opened the door.Copy !req
1097. Then I'll withdraw
the question.Copy !req
1098. Strike the witness' response.Copy !req
1099. You can't un-ring
the bell, Mr. Henry.Copy !req
1100. The ledger's back in.Copy !req
1101. Mr. Sweeney, you've stated
under oathCopy !req
1102. that it was Tyler Henry who
raped Will Caray, is that right?Copy !req
1103. Yes.Copy !req
1104. Please read
the highlighted passage.Copy !req
1105. Go ahead.Copy !req
1106. "Pledge Kathy was being
a weenie tonight."Copy !req
1107. Louder, please,
so the jury can hear you.Copy !req
1108. "Pledge Kathy was being
a weenie tonight,Copy !req
1109. "so we showed him
what we do to weenies.Copy !req
1110. "He'll crap blood tomorrow,Copy !req
1111. but we'll make a man
out of him yet."Copy !req
1112. Who was Pledge Kathy?Copy !req
1113. Will Caray.Copy !req
1114. Please continue.Copy !req
1115. "Pledge master Dahmer
paddled Pledge KathyCopy !req
1116. for about
20 minutes."Copy !req
1117. Pledge master Dahmer
being Tyler Henry?Copy !req
1118. Yes.Copy !req
1119. "I kicked the pledge
and I burnt him with my smoke,Copy !req
1120. "but he still wouldn't break.Copy !req
1121. "So I took the paddle...Copy !req
1122. "... and I jammed it into him.Copy !req
1123. "Dahmer said to stop,
but I kept goingCopy !req
1124. "until Pledge Kathy
cried like a girl.Copy !req
1125. "Dahmer saw the kid was bleeding
and he stopped me.Copy !req
1126. Just like a bitch to be
on the rag during initiation."Copy !req
1127. You wrote that entry,
didn't you?Copy !req
1128. Mr. Sweeney?Copy !req
1129. You raped Will Caray,
didn't you?Copy !req
1130. Yes.Copy !req
1131. You did it on purpose.Copy !req
1132. Did what?Copy !req
1133. Let the ledger back in.Copy !req
1134. That would be
a breach of ethics.Copy !req
1135. Was it because he called
your son a rapist,Copy !req
1136. or because
he caused his death?Copy !req
1137. I defended my client to
the best of my abilities.Copy !req
1138. For what it's worth,Copy !req
1139. you did the right thing.Copy !req
1140. It really used
to be about brotherhood.Copy !req
