560. What about their finances?

561. Had this woman, right? Smart-looking broad.

562. She come in here five, six, seven times a day,

563. each time with a different guy.

564. Turns out she's using the booth over there to turn tricks.

565. And when we caught her, she said

566. "Hey, it's a hell of a lot cheaper than a hotel."

567. Find what you're looking for?

568. There are standards

569. but it's up to the individual insurance agent.

570. Just tell me about the standards.

571. Before the new policy was issued,

572. the Ralstons already had $2 million

573. in life insurance, all on him.

574. $2 million?

575. Most couples, now, they also insure the wife.

576. Her role costs money to replace— child care,

577. housekeeping... Not the Ralstons.

578. What about the new policy?

579. An additional $3 million?

580. Well, let's say that's borderline excessive.

581. So, the agent shouldn't have written it?

582. The agent should have wondered what was going on.

583. On top of the personal,

584. $4 million more paid for by the business.

585. Is that unusual?

586. Not if the partners are collecting.

587. Alan Ralston's beneficiary?

588. His wife.

589. This wasn't life insurance.

590. It was the lottery.

591. Mrs. Ralston hits the right number.

592. She collects $9 million.

593. What does it look like to you?

594. Like to me like Himes is interested

595. in seeing Ralston overinsured.

596. After Janet broke his heart, cut off the affair?

597. That guy is a positive humanitarian.

598. Candidate for best friend of the year.

599. What if she didn't break off the affair?

600. No, got nothing on the girl.

601. The gun?

602. We got word from Kentucky, Tennessee,

603. Delaware and North Carolina. No luck.

604. And that leaves...? We'd better get lucky with Virginia.

605. A year ago, right after Janet was mugged.

606. Richmond, Virginia.

607. Tracy's Field and Sport Shop.

608. A sporting gun?

609. If you're hunting people.

610. Beretta, model 94, blowback semi-automatic nine millimeter.

611. Sold to Himes, Gilbert?

612. And not to Ralston, Janet, either.

613. Ralston, Alan?

614. And they stick to their stories

615. the worst we get him for is maybe man two.

616. She still gets a walk.

617. She's already set up

618. a diminished capacity defense for him.

619. Said he looked crazy.

620. You used Alan's gun, didn't you, Mr. Himes?

621. I love Janet Ralston.

622. You want to talk a deal?

623. I want to talk guns.

624. How did you get the Beretta?

625. Did she give it to you before the party?

626. No more questions, Stone,

627. till you put a proposal on the table.

628. He rolls on Mrs. Ralston, comes up with some evidence— manslaughter one.

629. That's not a proposal.

630. It's an insult.

631. Come on, Gil.

632. Himes really does love her.

633. Maybe he loves manslaughter two more.

634. We don't find out how it went down,

635. we may have to offer it to him..

636. Well, then let's find out how it went down.

637. Let's start over, Willie.

638. How many times I got to tell you?

639. The lights go out. Then what?

640. Look, I hear a scream, then a shot.

641. Righ after the lights went out?

642. Same time.

643. Run that past me again.

644. The lights went off.

645. I hear a shot.

646. The door opens, a couple seconds later,

647. I hear two more shots, I get the hell out of there.

648. If the light was off,

649. how do you know the door opened?

650. Light came in from the garage.

651. After the first shot.

652. Am I talking too fast? That's what I said.

653. You know, lights off, then bang.

654. Door opens. Bang, bang.

655. Willie fires up a rock.

656. The light goes out.

657. The first shot came before the door opened?

658. Then the door opens, then there's two more shots.

659. But if it's Himes coming down the stairs, and it is,

660. he goes to the light...

661. He unscrews it...

662. the door yet. He hasn't opened

663. A gun goes off.

664. So, who shot Alan Ralston?

665. Is Willie a good enough witness?

666. Good enough for me.

667. Pick her up.

668. Janet Ralston?

669. You're under arrest

670. for the murder of Alan Ralston.

671. You have the right to remain silent

672. and refuse to answer questions.

673. Anything you do say may be used against you in a court of law.

674. So you're saying the first shot came

675. before the door opened.

676. Lights out. Bang.

677. Then the door opens.

678. But after the lights went out, couple of seconds later,

679. another two shots.

680. Bang, bang.

681. Thank you.

682. No further questions, Your Honor.

683. Mr. Tivnan,

684. what were you doing on the stairs of the garage?

685. Smoking crack.

686. Uh-huh.

687. Your habit?

688. How much does it cost?

689. $200 a day.

690. Oh.

691. Do you have a job, Mr. Tivnan?

692. Objection, Your Honor.

693. His employment has nothing to do with his testimony.

694. Mr. Tivnan's state of mind is at issue here.

695. Overruled.

696. The witness will answer.

697. I sell books, magazines on the streets.

698. Does that pay for your crack habit?

699. People do a lot of reading.

700. Thank you, Mr. Tivnan.

701. In your autopsy, you examined the entrance wound

702. on Mr. Ralston's body?

703. Yes, I did.

704. What were your findings?

705. Light powder burns on Mr. Ralston's tux

706. indicated that the gun had fired

707. at a distance of approximately three feet.

708. The bullet entered Mr. Ralston at the bottom of the thorax.

709. It traveled upward.

710. It pierced his right lung and then entered his heart.

711. From that description, Mr. Borak,

712. can you tell the height of the person who fired the gun?

713. Yes, I could.

714. From the, uh, the angle of the bullet's entry,

715. the person who shot him

716. would have to be no taller than five foot six.

717. In other words, someone shorter than Mr. Ralston.

718. Yes, that's right.

719. Nothing further, Your Honor.

720. If I told you the floor of that garage slopes,

721. would that affect your estimation

722. of the height of the gunman you described?

723. Oh, yes, yes, it would.

724. Good. It slopes.

725. So it's possible that Mr. Ralston was shot by a six-foot man

726. standing at the bottom of a sloping floor.

727. Yes, that is possible...

728. Thank you.

729. Nothing further, Your Honor.

730. Mrs. Stark, this was some months ago.

731. Do you remember the Ralstons?

732. Yes. They were a nice-looking couple on vacation.

733. Just come from the mountains.

734. Did Mr. Ralston know what kind of gun

735. he wanted to buy?

736. Well, he didn't know anything about guns,

737. so I showed him some nice personal weapons.

738. And he picked one out?

739. she kept telling him Well, the missus,

740. that they had to have it,

741. and he told her he did not want the gun in the house,

742. that one of the kids might get his head blown off.

743. And she kept reminding him that she had been mugged

744. on the street.

745. So, Mr. Ralston didn't want to buy a gun.

746. No, it was Mrs. Ralston who was all steamed up.

747. She insisted that he buy the Beretta.

748. Thank you.

749. No further questions.

750. It's your meeting.

751. Himes battered

752. Mrs. Ralston emotionally,

753. but she never believed him when he said

754. he'd kill her and her husband.

755. After he shot you, Mrs. Ralston,

756. you didn't go to the police.

757. I told you.

758. I was frightened.

759. The only thing Mrs. Ralston

760. might have done wrong

761. was to mention where Mr. Ralston kept his gun.

762. Nevertheless, we will plead

763. criminal facilitation four, conspiracy five,

764. and she'll testify against Mr. Himes.

765. You've got to be kidding.

766. It's like he's on trial for murder.

767. You're offering us two misdemeanors?

768. I don't joke about plea bargains, Mr. Stone.

769. If you want to think about manslaughter one,

770. we might have something to talk about.

771. Well, I guess we have nothing to talk about.

772. They're not biting. She doesn't think we can convince a jury.

773. Then plea it out at man two.

774. Slap on the wrist?

775. Since when's two acquittals better than one?

776. Take one more run at them.

777. Don't blow this.

778. I'll take man two.

779. Mr. Himes,

780. she's getting ready to burn you.

781. That testimony about how tall the gunman was?

782. Your lover's lawyer is trying

783. to make it look like you pulled the trigger.

784. Janet's lawyer was trying to prove

785. neither of us did it.

786. Listen to this.

787. This is a transcript

788. from one of the interviews with Mrs. Ralston

789. after you were arrested.

790. "I loved Gil Himes,

791. "but he turned out to be weak and pathetic.

792. "The only solution he found to his unhappiness

793. was to get a gun."

794. That's how she depicts you.

795. You're playing a bad hand, Mr. Himes,

796. and the dealer's crooked.

797. Suppose the murder weapon should... happen to turn up.

798. Mr. Himes, you are now skirting obstruction of justice.

799. Don't push it, Stone.

800. He said "suppose,"

801. and he's on trial for murder.

802. Suppose we add obstruction.

803. Suppose you never get the gun.

804. Manslaughter one.

805. You'll lose.

806. That jury will never convict.

807. ( sarcastically ): True love.

808. They'd sell each other for a nickel.

809. Give victor Norris a call.

810. You said you have something we want to hear?

811. A rumor Mr. Himes is thinking of producing

812. a murder weapon.

813. Auction block.

814. Going, going...

815. Two misdemeanors

816. and she'll take a year in jail.

817. Manslaughter one.

818. Going, going...

819. No way.

820. Gone.

821. You don't scare me, Mr. Stone.

822. Oh, yes, I do, Mrs. Ralston.

823. I scare you a great deal.

824. And I should.

825. There's another offer on the table from Mrs. Ralston.

826. This is an idiotic game.

827. She's up from two misdemeanors to jail time.

828. We'll take manslaughter two.

829. Oh, you'll have to do better than that.

830. Manslaughter one he produces the weapon,

831. and he tells the jury how he planned it.

832. Whoever gets to my door first.

833. You know why we're here.

834. You can't do this, Stone.

835. Last chance, ladies and gentlemen.

836. You've got nothing.

837. Manslaughter one.

838. Sold.

839. You damn fool!

840. We would have been acquitted.

841. They've got nothing.

842. God, you are a pathetic, limp...

843. Oh, God!

844. You are such a gutless...

845. She came to me with the plan.

846. And what did Mrs. Ralston suggest?

847. She would tell Alan she had been mugged.

848. Would force him to buy a gun.

849. Was there more to the plan?

850. Yes.

851. She told me I would have to shoot her, too.

852. I said, "What?"

853. She said I would shoot her

854. after she shot him.

855. On the night of the shootings,

856. did the plan go awry?

857. I was supposed to be there before she shot Alan,

858. but, uh, he saw the gun in her hand,

859. so she had to shoot him

860. before he came into the stairwell.

861. Who shot Mrs. Ralston?

862. I did.

863. Is this gun, marked "People's Exhibit 26"

864. the one you used the night of the shootings?

865. Yes.

866. Now, Mr. Himes,

867. please tell the jury what happened

868. after Mrs. Ralston talked to the police

869. at the Hamstead Hotel.

870. She called me— Janet called me from a pay phone.

871. Told me I was going to be arrested

872. and I should go along with it.

873. I said she was going to hang us both.

874. What were her exact words?

875. She said, "You dumb son of a bitch.

876. "You'll get manslaughter two.

877. "Minimum sentence.

878. "Out in a third.

879. Less than two years."

880. "We'll have each other," she said.

881. "And the money."

882. Has the jury reached a verdict?

883. We have, Your Honor.

884. Will the defendant please rise?

885. On the first count of the indictment,

886. the charge of murder in the second degree,

887. how does the jury find?

888. We find the defendant guilty.

889. On the second count of the indictment,

890. conspiracy in the first degree, how does the jury find?

891. We find the defendant guilty.

892. Janet Ralston's planning to sue her lawyer.

893. She doesn't quit.

894. Reach any conclusions?

895. I'm trying to forget her.

896. Two men in love with her.

897. Kills one, ready to sell out the other.

898. What is it? Greed? Power? Evil.

899. I thought you didn't believe in evil.

900. Never met Janet Ralston before.

901. She's either evil or she's two years old.

902. She wants what she wants when she wants it.

903. That's cute.
