Law & Order 1x22

1. by two separate yet equally important groups:

2. the police, who investigate crime

3. and the district attorneys, who prosecute the offenders.

4. These are their stories.

5. On the first count of the indictment,

6. criminal facilitation in the first degree,

7. how does the jury find?

8. Not guilty.

9. On the second count of the indictment,

10. money laundering in the first degree,

11. how does the jury find?

12. Not guilty.

13. On the third count of the indictment,

14. conspiracy in the fifth degree, how does the jury find?

15. Not guilty.

16. Thank you.

17. Court is adjourned.

18. The arrest was insulting, the indictment was ludicrous,

19. and the result was predictable.

20. The district attorney

21. wanted to look tough on white collar crime,

22. so they smeared three innocent men,

23. but they couldn't bamboozle a jury of 12 honest New Yorkers.

24. Thank you.

25. Mr. Stone?

26. Yes?

27. The defense says this was malicious prosecution.

28. If the law had allowed it,

29. I'd have indicted those defendants for murder.

30. Wall Street bankers for murder?

31. Bankers who helped drug dealers clean their money

32. are as guilty as the drug dealers themselves.

33. What about that missing evidence?

34. I can't comment on the investigation,

35. but I do know someone

36. in the New York City Police Department

37. altered evidence by erasing bank transactions on computer disks,

38. and that is a felony, ladies and gentlemen,

39. and there will be indictments.

40. This case is not over.

41. It's just beginning.

42. Captioning sponsored by NBC/UNIVERSAL

43. Page nine, first column on the bottom.

44. How long they been in there?

45. About an hour.

46. Internal Affairs?

47. Yeah.

48. What gives?

49. These guys taking a run at the whole precinct?

50. No, just me.

51. You gave the D.A. three dealers and their bankers

52. on a silver platter.

53. Now they're going after you?

54. Well, if I was Internal Affairs, I'd be looking at me, too.

55. O'Farrell is in charge of the property clerk's office.

56. We go back a long way.

57. He's given me every one one of my promotions.

58. He passes out captain's bars.

59. So the chief took care of you for 20 years, so what?

60. That means you two tampered with the evidence?

61. Well, they got to go after somebody.

62. Oh, so you're guilty by association

63. because O'Farrell runs the evidence department?

64. What do they say happened to the evidence?

65. Manhattan Mercantile Bank.

66. Computer disks got erased.

67. All the illegal transactions just vanished.

68. Look, I.A.D., they didn't tell me who, what or why,

69. but am I at the top of their list? Yeah.

70. How's your appointment book?

71. Just the Boorman murder.

72. Getting ready for trial.

73. What?

74. I'm in a corner here.

75. It's an I.A.D. case.

76. We'll see what we can find out.

77. Yeah.

78. Whose collar was it?

79. Cassidy and Manetti's.

80. D.A. loses a case, who gets the shaft?

81. Cops.

82. I'm telling you— we did it by the book.

83. Ain't no bestseller.

84. What happened?

85. Round-the-clock stakeout.

86. Colombians doing maybe a million a year.

87. Not big dealers.

88. They live in tenements, right?

89. One day, we get a break.

90. They take their money to Manhattan mercantile.

91. Four briefcases, cash.

92. I want to bust in, get the dealers and the bankers.

93. Cragen says no.

94. You got to wait for the money trail.

95. Prove they laundered it.

96. They get some diode heads downtown

97. to track the money by computer.

98. So when Stone goes to trial, the computer disks are erased.

99. Right, but only the incriminating files.

100. Whoever did it knew what he was doing.

101. So to the jury, it looks like the evidence was never there.

102. What about the computer jock, the one who traced the money?

103. What's his name?

104. An I.A.D. case.

105. You're turning over rocks here.

106. Turn over a rock, you might find a rattlesnake.

107. They way the D.A.'s screaming

108. you'd think it was the first case they ever lost.

109. Every time's a first time.

110. So what happened with these computer disks?

111. The drug dealers, the Colombians?

112. They leave the bank.

113. We wait three days, then bust in.

114. I take two disks.

115. It shows the drug money was wired offshore.

116. The Cayman Islands.

117. All right, so you saw the files, the evidence was there.

118. Yeah, I saw the files right on my computer screen.

119. You didn't make a printout?

120. I'm leaving for my honeymoon— Bermuda.

121. They say cancel. I say go to hell.

122. Send the disk to the property clerk.

123. I'll do the trial work when I get back.

124. And when you get back, the disks are changed.

125. You got it.

126. This captain, what's his name, um, Cragen?

127. What's his story?

128. You hear stuff, you know.

129. What do you hear?

130. Everything I heard,

131. I already told three times.

132. Don't you guys at I.A.D. talk to each other?

133. I.A.D.?

134. Real smooth, Sergeant.

135. I.A.D. swears me in blood not to talk about this case.

136. You don't tell them, we don't tell them.

137. Wow.

138. This is freaking amazing.

139. I don't know a computer disk from a slipped disk.

140. Well, your name's getting tossed around.

141. It's the same song everywhere.

142. People are saying O'Farrell's your rabbi.

143. He's in charge of the property clerk,

144. so your detectives knew when the evidence was there.

145. And what do you say?

146. He's reporting, not accusing.

147. I.A.D. tells you you're under investigation.

148. They mention why they think you'd help these three bankers?

149. One thing they lean on over and over,

150. they keep saying that I talked to the chief

151. every couple of days while this case is running.

152. What did we talk about?

153. You talk to him lately?

154. With I.A.D. probably listening in on my phone line?

155. No.

156. Doesn't mean we can't.

157. So this young D.A., maybe two years on the force—

158. this D.A., three weeks out of Harvard, mind you,

159. he says to me, "Officer, can you tell me the difference

160. between suspicion and probable cause?"

161. So I look him in the eye and I say,

162. "Can you tell me what is in section 129 of the penal law?"

163. And he says,

164. "I'll look it up."

165. What is in section 129?

166. There is no section 129.

167. He was a good cop.

168. Listen, we know we're out of our league here.

169. We really appreciate you talking to us.

170. That's all right.

171. So why they after you and Cragen?

172. All right, you're Schiff, you got an election coming up.

173. You've just blown the bankers case.

174. What do you do? You go after some Irish cops.

175. But the evidence.

176. Ethnic politics.

177. It never dies.

178. Something did happen to it.

179. Don Cragen and me.

180. Now you just ask yourself:

181. Does it make any sense for us to risk what we've got?

182. My guess, some kid

183. in the D.A.'s office checked out the disks,

184. and he louses them up.

185. I.A.D.'s after cops.

186. If there is a cop involved in this,

187. I will buy the whole department dinner.

188. From what this steak cost,

189. you'll have to take out a second mortgage.

190. Only if I'm wrong.

191. The Boorman case.

192. Pretty thorough, you guys.

193. Yeah, well, we always check our evidence twice

194. before we testify.

195. Right.

196. And my diet's working, too.

197. You were Cragen's partner.

198. Forget it.

199. I.A.D.'s got a bullet with his name on it.

200. They're after a good cop.

201. We're all good cops.

202. Even the dirty ones.

203. I.A.D., those jerk shooflies—

204. tweedle dum and tweedle dumber—

205. they come in and they pop the file cabinets

206. they copy every piece of paper.

207. Like?

208. Like the sign-in logs.

209. Like who was here, when.

210. Mind if we take a look?

211. Page 57

212. column three.

213. What?

214. The week the evidence was messed with.

215. Lots of cops through here, but your pal, Cragen...

216. that week twice. He was here

217. Two days in a row.

218. Like he was taking something out

219. and bringing it back.

220. For the rest of my life, I sign nothing.

221. I'm going to burn my dry-cleaning stubs.

222. So, you gentlemen would like to know

223. why I was at the property clerk.

224. Joey Buscalera, sergeant from the fraud squad. You remember him?

225. Yeah. He was with us for what, two months?

226. Yeah.

227. I had him on a case— auto parts. Chop shop?

228. Buscalera was testifying on another case.

229. No time to do his evidence summary,

230. so I drove to the property clerk

231. and did it for him.

232. Do a guy a favor and look what happens.

233. What, Max?

234. What is it?

235. Property clerk supervisor says

236. you-you were there two days in a row.

237. Now, you drive a hundred blocks back and forth

238. two days in a row to help some detective on loan?

239. When headquarters is on my tail,

240. when they're shoving productivity reports

241. down my throat? Yes, Max, I do.

242. Two days in a row.

243. That's a lot of favor.

244. Max, you know the procedure.

245. I did his evidence summary.

246. I brought it back here. He signed it.

247. I took it back, logged it and left a copy with the D.A.

248. Joey, this evidence summary,

249. the one that Cragen helped you get ready.

250. I like Cragen.

251. He did you a favor?

252. Would I finger a cop?

253. I don't cross the blue wall.

254. Nobody's accusing you.

255. You know how it is.

256. You've got to testify in two trials.

257. You can't get downtown.

258. So you asked Cragen.

259. Not exactly. Cragen asked if I'm ready.

260. I'm in a bind. He volunteers

261. to go to the property clerk, do my evidence.

262. He volunteers?

263. He's a good cop.

264. Yeah, yeah, good cop.

265. Thanks, Joey.

266. What am I talking, Swahili?

267. I.A.D.'s all over this case.

268. Come on, you were here.

269. I thought maybe you could tell me a little something.

270. Tonight, I go home at 6:00.

271. In the garage, a '65 Malibu.

272. Best big six they ever made.

273. And when I'm finished with it, mint condition.

274. If I.A.D. comes after me because I'm talking to you,

275. I will be fixing cars every day instead of nights and weekends.

276. 24 Years, that's what Cragen's got in.

277. I don't know the man.

278. Look, supposedly Cragen's the only cop in here

279. two days in a row.

280. So, you're saying if somebody fiddled with the evidence...

281. Then it must be Cragen. Yeah.

282. Or an inside job.

283. Or both.

284. You son of a bitch.

285. If you're ever in trouble,

286. I sure as hell hope someone treats you like this.

287. Hey.

288. All right.

289. Upstairs, the men's room.

290. Five minutes.

291. Henderson? He's already divorced.

292. Lives in a hell-hole one bedroom way down on Avenue C.

293. Avenue C.

294. You can get killed in the cross fire

295. on a good night.

296. And with his alimony, he wishes he was dead.

297. Let's go.

298. You got a quarter?

299. Give it a whack.

300. Cragen volunteered.

301. Buscalera didn't ask.

302. Maybe Cragen was just doing his job.

303. I gotta keep saying this. I know he's not dirty,

304. but now I know why I.A.D. is going six ways through Sunday

305. to prove that he is, because it looks like he wanted to be

306. at the property clerk's office.

307. Yeah. Maybe someone else did, too.

308. Look at this.

309. Property clerk's duty roster

310. headquarters' master roll call.

311. Now, the week the evidence was tampered with,

312. there were 28 cops and 13 civilians working there.

313. Any of them know Chief O'Farrell?

314. Assuming it was O'Farrell's party.

315. Assuming.

316. Listen, you want me to dig up their service records?

317. ( sighs ) Forget reprimand from I.A.D.

318. That will rate a full-scale hearing.

319. Wait a second.

320. The master roll call and the duty roster

321. ought to be identical.

322. But what's-his-name from the property clerk's gave you both.

323. There's got to be a reason, right?

324. Yeah.

325. Master roll call comes from headquarters

326. at the beginning of the month.

327. Duty roster comes out every Tuesday.

328. If it's an inside job, when do they do it?

329. When there's no traffic.

330. Give me the names of everybody

331. on the duty roster's third shifts.

332. Okay.

333. 4:00 to midnight— Webster.

334. Mm-hmm.

335. Dumoze.

336. Mm-hmm.

337. McCrory.

338. No.

339. He's on the duty roster,

340. but headquarters doesn't show him as working

341. on the master roll call.

342. Hah.

343. Headquarters says Officer Al McCrory retired

344. two weeks earlier.

345. He was retired, but he worked two weeks later?

346. Maybe he loved working at the property clerk.

347. Yeah, he loved it so much, he couldn't leave.

348. Let's get an address.

349. Think he'll talk to us?

350. Yeah. Maybe he'll tell us how he affords this house.

351. Al McCrory?

352. Yeah.

353. Sergeant Greevey.

354. Detective Logan.

355. Do I know you fellas? We ever worked together?

356. No. We just want to ask you:

357. When you were going to retire,

358. you worked the property clerk's office

359. an extra couple of days.

360. What's this about?

361. Well, there's a discrepancy.

362. It says you were retired but still working.

363. Some problem with my pension?

364. Wait a minute.

365. You guys work for Cragen?

366. What am I wearing, a sign on my forehead says stupid?

367. Your captain's in trouble, don't come to me.

368. Wait a minute.

369. You touch me, I'll have you up for assault.

370. I think you'd better get out of my house and out of my yard.

371. Now, there's a guy with nothing to hide.

372. Max.

373. What a nice surprise.

374. We never see you anymore.

375. How's Marie? How are the kids?

376. Fine. Everybody's good.

377. Good. Ah, you're lucky.

378. You don't have to drink his coffee today.

379. It's already made.

380. I've got an 8:00 flight, so give my best to Marie.

381. Sure. Okay. Thanks, honey.

382. Bye-bye.

383. Bye.

384. Just happen to be in the neighborhood?

385. No.

386. You want to come in?

387. Putting in a pool?

388. Yeah.

389. Oh.

390. You know a cop named Al McCrory?

391. Property clerk's duty roster

392. says he worked the same days you were there.

393. Master roll call says he retired two weeks earlier.

394. Friend of yours?

395. He used to drive for the chief a oouple years.

396. You know him?

397. Just to say hello.

398. And you haven't seen him in years?

399. That's right.

400. But you know him, O'Farrell knows him,

401. and he worked after he retired.

402. You think you'll come in for a few days after you retire?

403. So McCrory knows the chief.

404. Does that make him guilty?

405. Any more than my being there makes me guilty?

406. McCrory, we saw him. He knew who we were.

407. Somehow, put our names together with yours.

408. Forget about him for a second.

409. What about Chief O'Farrell?

410. You just don't like politicians, Max. Never did.

411. Not when they're crooked,

412. and especially not when they try

413. to bring my friends down with them.

414. I had nothing to do with it,

415. and I'm sure Pete O'Farrell didn't, either.

416. Oh, that's great.

417. Donny, what are you doing?

418. See no evil, hear no evil?

419. How could you even think that I would tamper with evidence?

420. I don't, but something isn't kosher!

421. I don't know what it is,

422. and I sure as hell hope you don't know, either!

423. You do me a favor, huh, Max?

424. Forget I ever asked you to help me.

425. You'd better run yourself a little reality check.

426. The sharks are out, and there's blood in the water.

427. The property clerk.

428. It's off-limits to you.

429. Just keep out of this investigation.

430. What are you pulling, good cop, bad cop on me?

431. Like I'm some kind of a perp?

432. For all I know, you are.

433. Hey, you listen to me. No, you listen to me!

434. You and Greevey keep your noses out of this!

435. You talk to one more cop— one more—

436. and don't think reprimand.

437. It's going to be a hearing for a suspension.

438. It's better for you, really.

439. You stay away from the property clerk,

440. from the computer people, from Buscalera,

441. from the F.E.C. and from Chief O'Farrell.

442. Am I making myself clear?

443. Listen, the I.A.D. mentioned the F.E.C.

444. What's the deal?

445. Federal Elections Commission.

446. What's that got to do with an I.A.D. case?

447. Oh, no.

448. What?

449. Billy Wilson.

450. My congressman?

451. You're 15 years too young to remember.

452. Before he was a congressman, Billy Wilson was a cop.

453. And?

454. What have we been missing? Motive.

455. Why would anybody help those bankers?

456. I'm waiting, Max.

457. Chief O'Farrell was Billy Wilson's

458. handpicked successor.

459. Who would O'Farrell do a favor for?

460. Give me some quarters.

461. This isn't a call to make inside the precinct.

462. The House Banking Committee.

463. Billy Wilson's been there since he was elected.

464. Those three bankers that got off,

465. they gave his campaign a lot of money.

466. The legal limit. At least that's all that's on the books.

467. You give money to your congressman,

468. it's automatically payoff?

469. Gee, I thought this was a democracy.

470. Look, O'Farrell was your rabbi

471. the same way that Wilson was O'Farrell's.

472. You need a motive for him to tamper with evidence,

473. I think you've got one.

474. I said help me out.

475. Did I ask you to nail Pete O'Farrell?

476. I think you're taking loyalty too far.

477. O'Farrell is no more corrupt than you are.

478. You think that, you're going to go down with him.

479. Is that right, Max?

480. I'm going down?

481. For what?

482. You guys got a trial coming up?

483. Boorman case?

484. Why don't you get to work.

485. You think this doesn't play?

486. If I were conducting an orchestra,

487. I'd say the violins were missing.

488. Oh, come on. The congressman is the conductor.

489. The bankers called Congressman Wilson.

490. They've been paying his bills ever since he got elected.

491. My guess, the contributions

492. go way beyond federal campaign limits.

493. And now they want a payback.

494. "Fix this evidence, Congressman

495. or you're going down with us."

496. the congressman's behind this.

497. Can't prove it.

498. nothing concrete ties Chief O'Farrell or Cragen.

499. Just a minute. Just a minute.

500. the disks.

501. We have no idea who altered them.

502. We asked O'Farrell to conduct an investigation.

503. He took his own sweet time.

504. We have six detectives who are willing to testify

505. that he went slow.

506. Slow, fast, I don't care if he was building a clock.

507. Without physical evidence, the testimony's meaningless.

508. He's chief of Operations.

509. Cragen, a career officer with an unblemished record.

510. We need a clear-cut motive.

511. You know how badly I want this case.

512. They tampered with evidence. The bankers walk.

513. But I can't move on supposition.

514. It's easy.

515. It's conspiracy.

516. The last time conspiracy was easy to prove

517. was Judas and the Romans.

518. Thank you, gentlemen.

519. We lose this one after the bankers,

520. we look like idiots.

521. I.A.D. doesn't have enough.

522. O'Farrell survives this,

523. any cop that talks to us is finished.

524. As for Congressman Wilson...

525. he makes ABSCAM look like "Hello, Dolly."

526. Investigated for campaign fraud a dozen times.

527. Draw the pyramid, or you get no conviction.

528. Congressman Wilson, Chief O'Farrell, Captain Cragen.

529. Yank a piece out, pyramid falls... maybe.

530. We appreciate your coming over, Mr. Stone.

531. Anything to avoid embarrassing the congressman.

532. You're besmirching my reputation.

533. Oh, I think you're giving me a lot of help there, sir.

534. And what will the jury think?

535. Chief O'Farrell owes you his job.

536. Those bankers

537. gave you more than $100,000 in campaign contribution.

538. You know what that's called?

539. The greatness of American politics.

540. No, sir, it's called a road map,

541. and I think a jury can find its way from A to B.

542. If you're convicted, you lose your congressional seat

543. and your pension.

544. If you resign first and then plead...

545. Let's suppose

546. and we're only just supposing here.

547. The congressman mentioned his constituents' problem

548. to Chief O'Farrell.

549. Without suggesting anything be done,

550. we'll plead to rewarding official misconduct,

551. second degree.

552. Consider bribery three.

553. You think I'd plead to a "D" felony?

554. That's our offer.

555. Consider it rejected.

556. Paul.

557. Max.

558. We ordered them to stay out of this.

559. It's on our days off. It's our time.

560. I warned you.

561. Lieutenant Kennedy, sit down.

562. Department's time or yours, it's an I.A.D. Investigation.

563. If you can call it investigating. Max

564. I'm going to have you up

565. on departmental charges, friend.

566. Back off, Kennedy.

567. The only departmental charge here is gross incompetence.

568. Gentlemen, please.

569. Sit down.

570. Have you got anything specific?

571. Cop named McCrory, retired.

572. Who worked the property clerk's office

573. after he retired.

574. Wrong.

575. We have the master roll call.

576. You know why cops hate I.A.D.?

577. Because you idiots couldn't convict a ten-year-old

578. of selling watered-down lemonade.

579. Mccrory's on the duty roster,

580. which you forgot to copy.

581. Is that important?

582. The master roll call is made up at headquarters.

583. It shows everybody that's supposed to be working.

584. Mccrory's not on it.

585. The duty roster is a record of everybody who was there.

586. That's the one McCrory was on two weeks after he retired.

587. And his house looks like it cost six times my salary.

588. Mortgage on McCrory's house a point and a half below market.

589. Sounds like a good deal.

590. Real estate agent says McCrory

591. got a $300,000 house

592. for 40 cents on the dollar.

593. Sounds like a better deal.

594. Previous owner: Parker, Evelyn.

595. Her maiden name; married to a congressman.

596. Congressman named Wilson.

597. And that's not a good deal, that's a bribe.

598. Albert McCrory.

599. The charges are bribe receiving in the second degree.

600. Conspiracy in the third degree

601. and tampering with physical evidence.

602. How does the defendant plead?

603. Not guilty.

604. Peter O'Farrell

605. and the honorable William Wilson.

606. Charges of bribery in the second degree,

607. conspiracy in the third degree.

608. How do the defendants plead?

609. Congressman Wilson?

610. Not guilty, Your Honor.

611. Chief O'Farrell?

612. Not guilty.

613. Your Honor, as lead counsel,

614. we ask the defendants be released R.O.R.

615. Mr. Robinette?

616. Your Honor, this is a case about obstruction of justice

617. and public officials selling the benefit of their office.

618. The people feel bail is essential.

619. Your Honor, the district attorney's record

620. on white-collar criminal charges

621. does not make one sanguine about their motives.

622. Interesting, Mr. Quinn.

623. But I don't recall

624. a section in the C.P.L. on prosecutorial motive.

625. Bail is set at $50,000 each.

626. Taking a bribe, evidence tampering.

627. We're not talking hand in the cookie jar.

628. Don't be foolish. You were a pawn.

629. That house put you at the heart of this conspiracy.

630. Soft market.

631. I got a good deal.

632. Here's a better deal.

633. Four to 15 years if you don't testify.

634. You think you can convict?

635. Where's the conspiracy?

636. Your client worked the property clerk's office

637. after he retired.

638. The jury is going to wonder why.

639. A jury needs a clear line from that to the tampered evidence.

640. You haven't got it.

641. When we do, we won't be making any deals.

642. You're taking this personally.

643. You bet I am.

644. You know it's impossible to get a conviction

645. on a white collar criminal with evidence.

646. What he did was worse than a crime.

647. Your client doesn't cooperate?

648. I'm taking him down, too.

649. Criminal facilitation.

650. He does no time.

651. This case, everybody does time.

652. Bribe receiving, third degree, does 18 months.

653. He does zero months after he's acquitted.

654. McCrory is not a computer expert.

655. Neither is Cragen.

656. How hard is it?

657. Cragen could have done it in the precinct.

658. Yeah, that computer guy at Forensic says a 12-year-old

659. could have changed those disks.

660. Hold on.

661. Shearer, the one who went to Bermuda.

662. Yeah. What about him?

663. Why didn't he do the trial work

664. before he went on his honeymoon?

665. They got to him, offered him a bribe.

666. Are you crazy?

667. Shearer was the one who told us how the disks were changed.

668. Right.

669. Ever hear about the art expert?

670. Forged a matisse.

671. The museum hireshim to see if it's a forgery.

672. 'Coures he says it's a matisse.

673. He authenticates his own forgery.

674. Shearer takes the disks, changes them,

675. tells I.A.D. how it's done, looks like a hero.

676. Paul...

677. find out what time Shearer's plane landed here.

678. The exact hour.

679. And see if McCrory was at the property clerk's office

680. at the same time.

681. Internal Affairs cleared Detective Shearer.

682. Cleared?

683. I.A.D. never suspected Detective Shearer.

684. When did he get back from the honeymoon, Paul?

685. Plane lands 2:45.

686. Doorman says Detective Shearer and his wife

687. got home at 4:00.

688. He went upstairs, dropped his bags,

689. left again ten minutes later.

690. To get the dry cleaning.

691. After your honeymoon?

692. That's very romantic.

693. Paul.

694. According to the doorman,

695. Detective Shearer was gone for three hours.

696. Your dry cleaner in Philadelphia?

697. You're riding the wrong horse.

698. Do you know what happens

699. when someone pleads in the middle of a trial like Officer McCrory?

700. I'll take a deal from anyone to get your client.

701. You know, Stone, you're wasting your talents.

702. You don't write indictments.

703. You write fairy tales.

704. Let's get out of here.

705. You really think McCrory will make a deal?

706. Not a prayer,

707. but Shearer doesn't know that.

708. The tap in place?

709. We'll see who he calls.

710. Is Cragen involved?

711. I don't want to indict him if I'm not sure.

712. What if we feed him part of the picture?

713. McCrory getting his house on the cheap.

714. See how he reacts.

715. If he's in on the conspiracy,

716. anything you say goes directly to O'Farrell.

717. Give away your case before you get to court.

718. It's a gamble.

719. So is the lottery.

720. Yeah?

721. Thanks.

722. Cragen.

723. Like we told you, we have nothing for you.

724. You still want to be a sacrificial lamb?

725. What do you want?

726. We need O'Farrell.

727. If you're not part of this,

728. wear a wire on the chief.

729. And no cop ever trusts me again.

730. No crooked cop ever trusts you again.

731. We're talking about a cop who's involved in evidence tampering

732. in a felony investigation.

733. That's a felony.

734. I don't want to indict you.

735. My God.

736. Well, that house had been empty

737. for... 15, 16 months.

738. The house wasn't on the market. Do you know why?

739. What, these days?

740. Some people don't even try.

741. When did it go on the market?

742. Well, out of the blue, one afternoon, she calls me—

743. the congressman's wife, Mrs. Wilson—

744. and she says, "Try to sell it."

745. So, I put a sign in the yard

746. and an ad in the county paper.

747. And when did Albert McCrory make an offer on the house?

748. Oh, now I don't remember exactly when...

749. Two, three days later.

750. And did he say how he knew the house was available?

751. He was driving by in his car.

752. Saw the sign.

753. What did you tell the congressman's wife

754. when the offer was made?

755. Well, I am not like some agents.

756. I don't hold back offers, but I said, "This is crazy."

757. He is offering you half of what it's worth.

758. Did she agree with you?

759. Well, she said, "Sell it."

760. Very firm.

761. Didn't want any argument. Just sell it.

762. You're reading the jury?

763. They don't like people who buy houses at half price.

764. Mr. Stone last night's tape from the Shearer tap?

765. You're going to want to hear it.

766. They say you're going to make a deal.

767. I don't know you. Good-bye.

768. Don't leave me swinging in the wind.

769. You stupid, get off the damn phone.

770. This was your idea.

771. Don't hang up on me... ( click )

772. Why did you do it?

773. You needed money for the honeymoon?

774. Behind in the credit cards?

775. That tape proves nothing.

776. Sounds like a confession to me.

777. You're finished as a cop.

778. The only question is, do you want to work on computers

779. or do you want to make license plates?

780. Bribery receiving third degree,

781. full restitution.

782. We recommend probation.

783. I don't want to go to jail.

784. And when did Al McCrory approach you?

785. The day after I took the disks

786. from the bank.

787. Did he offer you a bribe?

788. He asked me what I wanted.

789. There's some judge I read in the paper.

790. He fixed a case for 20 grand.

791. I figure I'm worth 20 grand, too. He agreed.

792. When you returned from your honeymoon, what did you do?

793. I got in a cab, went down to the property clerk,

794. called McCrory from a pay phone.

795. He came out in a couple minutes with the disks.

796. And then what did you do?

797. Uh, went to Computer Heaven— 16th street.

798. Used their display model, my own utility disks,

799. wiped a few tracks clean.

800. When you first brought the evidence to the property clerk,

801. Officer McCrory wasn't working there, was he?

802. No.

803. And no one outside that office

804. knew that you were working on this case?

805. No.

806. So how did Al McCrory find his way to you?

807. I don't know.

808. Somebody must have told him, right?

809. Objection.

810. Withdrawn.

811. No further questions.

812. Detective Shearer, in a conspiracy,

813. people engage in illegal activity with other people.

814. So, let me ask you.

815. Have you ever met Peter O'Farrell?

816. No...

817. but Al McCrory used to...

818. Yes or no, please.

819. Have you ever met Congressman William Wilson?

820. No.

821. Never talked to either one of them

822. on the phone, did you?

823. No.

824. Thank you.

825. No further questions.

826. Mccrory's going down, no question there.

827. The congressman?

828. When the jury looks at the bankers' campaign contributions,

829. they'll make the connection.

830. O'Farrell's still out of the game.

831. The jury hasn't seem him in a huddle,

832. let alone calling a play.

833. But the chief was Wilson's protege.

834. The jury can make that leap of faith.

835. Yeah, well, I wouldn't,

836. and if I wouldn't, they won't.

837. O'Farrell's a better politician than I am.

838. If he wasn't a cop, he'd be president.

839. Indict Cragen.

840. You don't mean that?

841. Don't I?

842. As a Catholic, you know that sins of omission

843. are just as bad as sins of commission.

844. He knows something.

845. I don't think so.

846. He looks guilty.

847. Shake the tree, see what falls out.

848. Come on!

849. That's blackmail, Stone.

850. That's one word for it.

851. a bill of indictment. The grand jury calls it

852. He's been my friend for 20 years.

853. Suppose the chief is innocent.

854. You're going to the ceremony. Wear a wire.

855. Prove us wrong.

856. Cheer up! You looked like your dog died.

857. It's hard to be cheerful when the D.A.'S on your ass.

858. Hey, Larry, how you doing?

859. Look at this. I can't even wear my uniform.

860. I'm indicted. I got to wear a suit.

861. D.A. says I'm next.

862. You?

863. You didn't do anything.

864. Stone says McCrory's scared.

865. To buy himself a plea, he'll name me.

866. That's crap.

867. Stone's jerking you around.

868. Mccrory's a good cop.

869. Who took a payoff to do those disks.

870. It looks that way, doesn't it?

871. Whatever happened, Don, nobody touches you.

872. Whatever happened?

873. You mean this investigation going slow. You?

874. Me, I got nothing to worry about.

875. You do Billy Wilson a favor?

876. Don, you don't happen to be wearing a wire, do you?

877. Come on. Why would I do that?

878. I don't know.

879. But you know I'd never do anything to hurt you.

880. Look, You did a favor for Wilson, I understand.

881. Billy I owe a lot, but not my career.

882. Look, none of us walks on water.

883. The way I've been smelling lately,

884. we shouldn't even be talking.

885. I'll buy you dinner after the trial, okay, kid?

886. Got it.

887. This mean I don't get indicted?

888. You did your best.

889. I had to push you. I had no choice.

890. It's not your fault, he didn't say anything incriminating.

891. Tomorrow, can you put the word out

892. that you're going to indict me?

893. I'm going to get O'Farrell for you.

894. Wait a minute. He didn't say...

895. I know what he said.

896. But I looked in his eyes.

897. So they indict you.

898. It's not the end of the world.

899. No, getting convicted—

900. that would be the end of the world.

901. Yeah.

902. I.A.D. cleaned out my office this morning,

903. but not everything.

904. Hey, they convict you, I go down, too.

905. So what didn't they get?

906. A couple of memos.

907. Originals, no copies.

908. My detectives were complaining

909. that your investigation of the erased disks

910. was going a little too slow on purpose.

911. They wanted to take it to I.A.D. during the trial.

912. And you took those memos home?

913. I guess I could burn them.

914. Even you.

915. I always said you were straight.

916. Well, I got one foot in bed with you already.

917. That was loyalty.

918. I'd like a little taste

919. if I'm going to put the other one under the covers.

920. After all, I do have a swimming pool to pay for.

921. Yeah.

922. 20 grand we give that computer cop.

923. We would have given him 200.

924. Now, for these memos, you want a piece, huh?

925. Yeah.

926. All right, me and Billy Wilson

927. split 300 grand.

928. Now, three ways, that's 100 apiece even.

929. Is that fair?

930. Oh, that's more than fair.

931. Yeah.

932. You're my best cop.

933. I never would have figured.

934. Ben Stone, please.

935. Tell him it's Don Cragen.

936. And during this conversation,

937. did the defendant, Peter O'Farrell

938. admit to accepting a bribe?

939. Objection. Hearsay.

940. Statement against interest, Your Honor.

941. Overruled.

942. Witness will answer.

943. Chief O'Farrell told me that he and Congressman Wilson

944. received $300,000 from the three bankers

945. to destroy evidence.

946. And did Chief O'Farrell tell you he had offered to bribe anyone?

947. He said he told McCrory to pay Detective Shearer $20,000.

948. Did he offer you a bribe?

949. $100,000 to destroy evidence.

950. Thank you. No further questions.

951. No questions.

952. Concerning defendant Albert McCrory

953. on the charge of bribe receiving in the second degree,

954. how does the jury find?

955. Guilty.

956. On the charge of conspiracy in the third degree?

957. Guilty.

958. On the charge of tampering with physical evidence?

959. Guilty.

960. Concerning defendant

961. William Wilson

962. on the charge of bribery in the second degree,

963. how does the jury find?

964. Guilty.

965. On the charge of conspiracy in the third degree?

966. Guilty.

967. Concerning defendant Peter O'Farrell

968. on the charge of bribery in the second degree,

969. how does the jury find?

970. Guilty.

971. On the charge of conspiracy in the third degree?

972. Guilty.

973. Before this court adjourns,

974. I want to note for the record that I am appalled.

975. We often say that public officials

976. are not above the law, but that's not enough.

977. They serve the law.

978. If they don't respect it,

979. who will?

980. Court is adjourned.

981. Mr. Cragen, could you give us a statement please?

982. Any comments at all?

983. O'Farrell was not a cop.

984. He was always a politician.

985. Whatever you're feeling, don't.

986. The swimming pool, Max—

987. you were wondering about it?

988. Marge paid for it.
