Law & Order 1x16

1. Joe Pilefsky, a soldier in the Masucci family.

2. Hired muscle.

3. So maybe I roughed up the Russian.

4. Mario Zalta, a capo in the Masucci family.

5. Currently running an untaxed cigarette scam.

6. This is New York.

7. Go figure.

8. Harv Beigel, the Don's brother-in-law.

9. The cigarettes go through his warehouse.

10. Look, you guys want to get something on Frank Masucci,

11. you got the wrong guy.

12. I'm in real estate, period.

13. Frank Masucci— the Don.

14. Head of the largest crime family in New York.

15. Hey, as far as I know, Harvey's in the real estate business,

16. although you never can tell about in-laws.

17. These four men conspired to set up Stone.

18. What do you know about a missing union president?

19. Frank told me he ordered the hit.

20. Stone brought Masucci to trial for the murder

21. of union president Russell Mackey

22. not knowing he had been set up by the Don.

23. I was at the restaurant.

24. Vinny called.

25. Asked if he could come in after I closed.

26. Then what happened?

27. Garrotting.

28. Would you explain to the jury

29. the meaning of garrotting.

30. That's a wire around the neck.

31. It's over... like that.

32. It appears that you were confined to a bed

33. at Manhattan Memorial Hospital for the entire month of May.

34. Isn't that correct?

35. Why are you perjuring yourself, Mr. Pilefsky?

36. What has Mr. Stone promised you?

37. I did not know Mr. Pilefsky was lying.

38. I made no deal

39. with Mr. Pilefsky, and I submit

40. that this entire thing was a set-up.

41. Great. Beigel walks, Masucci walks

42. and we got squat.

43. Masucci's not walking.

44. Do you know what the evidence might be?

45. Well, I have no idea.

46. Captioning sponsored by NBC/UNIVERSAL

47. Unable to retry Masucci for murder

48. Stone has had to settle for prosecuting

49. Pilefsky and Zalta for the assault

50. on the Russian candy store owner.

51. I've owned store 14 years.

52. I sell newspapers, cigarettes

53. candy and lottery tickets.

54. I'm interested in the cigarettes, Mr. Skolnik.

55. Who do you buy them from?

56. Suppliers come and go.

57. I've used, the last two or three years, Easton Supply.

58. And do any other suppliers

59. ever come offer their cigarettes?

60. Every week.

61. They give you better deals?

62. They say they can deliver faster.

63. And cheaper?

64. A penny here, a nickel there.

65. But did any supplier ever come to you

66. and offer you cigarettes at a greatly reduced price?

67. Three months ago, this man said

68. he would sell me as much as I want

69. at five bucks off every carton.

70. How is that possible, Mr. Skolnik?

71. You see this?

72. This stamp says tax to state was paid.

73. His cigarettes don't have stamp.

74. Is the man

75. who tried to sell you those untaxed cigarettes,

76. is he in this courtroom?

77. That man.

78. Let the record show

79. that Mr. Skolnik is pointing to the defendant, Mario Zalta.

80. He wears fancy suit, but he's a crook.

81. I tell him i want no part of it.

82. And what happened then?

83. His friend Pilefsky

84. came to see me.

85. Doctor says I will never walk again.

86. I got to tell you, getting convictions

87. on Zalta and Pilefsky

88. is like going to the prom and scoring bare wrist.

89. A freakin' consolation prize.

90. Beigel's the one who ran the operation.

91. We can't touch him.

92. Easy, Max.

93. Deal making's part of the system.

94. Yeah, it makes the wheels of justice turn faster.

95. Makes them turn, period

96. and with Maximum Mathews

97. handing out the sentence on Pilefsky and Zalta

98. they'll be sleeping on the state for most of the decade.

99. Yeah, meanwhile Beigel and Masucci

100. are hobnobbing at the opera.

101. Justice is blind, Detective.

102. Nobody said it was fair.

103. Explain that to them.

104. Detective, I don't think you understand

105. who we're talking about.

106. Do you know how Masucci

107. became a made man, how he made his bones?

108. He rents a police uniform and walks into a bar

109. and pumps three slugs into the skull

110. of a 73-year-old bookie.

111. That's just the first of seven murders

112. we know he personally committed,

113. and God knows how many he ordered.

114. And I'll do anything I can to nail the son of a bitch.

115. You ever hear of Don Quixote?

116. You ever hear about David and Goliath?

117. And we have God on our side.

118. I tell you, there's no way you could have predicted

119. that Pilefsky would lie on the stand

120. intending to get caught.

121. It's unbelievable— Beigel walks on the cigarette scam

122. and double jeopardy protects Masucci

123. from being retried for Mackey's murder.

124. Do you want a crying towel?

125. Where is it written that you have to win every case?

126. What do you want to do?

127. Full-court press—

128. 24-hour surveillance, wiretaps, the works—

129. on Masucci and Beigel.

130. We're gonna need probable cause to get wiretap warrants.

131. Go with kidnapping.

132. Beigel testified

133. that Mackey was detained

134. before Masucci had him killed.

135. Adam, even if we found the body

136. we couldn't get a kidnapping conviction.

137. You said you needed a warrant

138. not a conviction.

139. Paul, you've got to talk to Judge Fishbein.

140. That's a reach.

141. A very creative reach.

142. I want this bastard as much as you do.

143. Fishbein's no fool.

144. This is the way we play him.

145. You've already tried Masucci for Mackey's murder.

146. You lost, Mr. Robinette.

147. This is America.

148. One strike and you're out.

149. Masucci has never been tried for Mackey's kidnapping.

150. "Did he offer any colorful details?"

151. Answer, Beigel: "Frank said he was disgusted.

152. He wasted four hours trying to convince him."

153. That's an interesting approach.

154. All right, let's say for the sake of argument

155. that it's not double jeopardy

156. but you're still barred by C.P.L. 40.40.

157. You can't split jointly prosecutable offenses.

158. The testimony I just read to you was given on cross.

159. It was the first we heard of it.

160. We couldn't charge him for a crime we didn't know about.

161. Even so, Masucci's confession to Beigel isn't enough.

162. You still need corroboration to convict.

163. That's why we need a warrant.

164. ( chuckling ): Ah...

165. A warrant.

166. Sounds like a fishing license to me.

167. Masucci confessed to Beigel.

168. Beigel took the stand and swore to it.

169. The people aren't fishing, Your Honor.

170. The people are counting on the parties under surveillance

171. happening to mention unrelated criminal activities.

172. The people have great expectations, Your Honor.

173. It's a 30-day warrant to monitor Beigel and Masucci's telephones.

174. For what?

175. Mackey's kidnapping.

176. You're kidding.

177. And anything else you might hear.

178. All right!

179. How did you get Fishbein to sign this?

180. We led him to water and he actually drank.

181. What do you think? Fenton and Vitello?

182. They're on the Dworkin homicide.

183. Been eight weeks, they got squat.

184. In two weeks, Dworkin will be just as cold.

185. like this. Assignments

186. Makes me hotter than a firecracker.

187. Could you fill us in

188. on what caused all this vasco-congestion?

189. Beigel hasn't left his office, yet, but he ordered Chinese.

190. I bet on the orange beef.

191. Cost him ten bucks.

192. Son of a gun orders moo shoo at two to one.

193. No?

194. Guys with glasses, I can read them like a book.

195. Anything we can use against Mr. Beigel?

196. Dinner at 8:00 with the missus at Parioli.

197. That's expensive, not illegal.

198. Could get more expensive.

199. Lunch with Laurel at 1:00.

200. Very mysterious.

201. I got 20 says she's a brunette.

202. The guy wears glasses— we're talking blonde.

203. So it's about 3:00 a.m.

204. I wake up to the sound of barking.

205. This one has a dog?

206. I wish.

207. I ask her what's going on, she says "cockroaches."

208. Cockroaches that bark?

209. That's what I said.

210. She says the exterminator was a bust

211. so she bought a gecko.

212. It's a lizard.

213. Some kind of gila monster from Brazil or something.

214. And it eats roaches?

215. Down to the last drop.

216. Barks when it's hungry.

217. Blonde.

218. Vitello must be working on some kind of E.S.P.

219. So Beigel's got a number on the side, huh?

220. You really think that's enough to get him to roll on Masucci?

221. A wife scorned is a scary prospect.

222. Look at that.

223. Doesn't look like true love to me.

224. Business.

225. Let's see what kind of business Laurel's in.

226. Nice day.

227. You come here often?

228. Holster it, cowboy.

229. Leather bores me.

230. Nice line.

231. Bitch.

232. Hey, maybe he's not cheating.

233. Not on his wife anyway.

234. You know what?

235. I'm going to really enjoy this.

236. Let's not tip her.

237. No, we got to do some research.

238. Beigel's got six residential buildings

239. mostly in the village.

240. Four-story walk-ups. Rent controlled.

241. From '80 to '88

242. Beigel made the Post's 50 worst landlord list.

243. Last two years, he's spotless.

244. Maybe he got religion.

245. He got a building inspector.

246. Since '88

247. all inspections on Beigel's buildings

248. were done by one Laurel McGinty.

249. Are you saying he bought her?

250. Okay, have the buildings reinspected.

251. See what Ms. McGinty may have overlooked.

252. What's bribery of a public official?

253. A "D" felony. Two and third to seven.

254. You think it's heavy enough

255. to squeeze something out of Beigel?

256. Two and a third to seven in Attica?

257. Beigel's got to know he couldn't do three weeks hard time.

258. Look at that local law ten violation.

259. The facade, see?

260. Chipped bricks.

261. That's a quick two grand.

262. Buildings was here

263. two months ago.

264. Your guys passed with flying aces.

265. Inspector must have been dreaming.

266. Between me and you

267. Buildings is strictly amateur.

268. We beat 'em six years straight.

269. Beat them?

270. You're city, too. What the hell.

271. We have this wager going, you know?

272. Who can raise the most for the Apple.

273. Fire against Buildings.

274. Like I told you before,

275. Fire Department wins every year.

276. You guys actually bet on who can write the most violations?

277. Tell me you don't bet against parking tickets?

278. Hey, come on, it's for a good cause.

279. The city raises a bundle in fines.

280. Where do you think your last raise came from, anyway?

281. Do we have any more code violations here?

282. Are you kidding?

283. Look at that, will you?

284. Defective ladder.

285. That's another quick two grand.

286. I inspect five buildings a day

287. five days a week

288. 50 weeks a year.

289. So I missed a couple of violations.

290. I'm human.

291. You never lost a case, Mr. Stone?

292. One mistake is human,

293. and two is, perhaps, some lapse

294. in concentration, three is stupid.

295. But the same mistake consistently

296. over a period of two years indicates

297. another form of human fallibility here.

298. Such as what?

299. Greed.

300. I've done nothing improper.

301. You had lunch

302. with Harv Beigel.

303. It's what they mean

304. by the appearance of impropriety

305. Ms. McGinty, and I'll do worse than indict you.

306. You can't prove anything.

307. Don't count on that.

308. The D.A.'s subpoena is a powerful weapon.

309. If I have to, I will question every landlord

310. of every building you inspected over a decade

311. and one of them, I assure you,

312. will turn you in to protect his own good name.

313. We've had the buildings reinspected.

314. 43 glaring violations never made it into your reports.

315. We'd like to know why.

316. How much did Beigel pay you to look the other way?

317. Ms. McGinty, it's not you we're after, it's Beigel.

318. If you testify, you get immunity.

319. If you don't, you go to prison.

320. I'm sure the former is preferable

321. don't you think?

322. I got it.

323. Evening, Mr. Beigel.

324. Great. What now?

325. You're under arrest

326. for bribery of a public official.

327. $300,000 bail, Your Honor, is not only excessive

328. it's vindictive.

329. Mr. Beigel is charged with bribery of a city official

330. a crime that has allowed him to cloak his total disregard

331. for the safety and well being of his tenants.

332. The only thing that is being cloaked here, Your Honor,

333. is the district attorney's own malicious...

334. That's enough, Mr. Leclaire.

335. Bail is set at $100,000, cash or bond.

336. Do you know what you're doing, Mr. Stone?

337. Yes, Mrs. Beigel. I am attempting

338. to put your brother in prison.

339. By getting my husband killed?

340. Because that's what you're setting in motion.

341. Bribery in the second degree.

342. You'll never convict.

343. I'll take my chances.

344. Laurel McGinty is just some pissant

345. building inspector.

346. Okay, maybe Mr. Beigel bought her a cup of coffee

347. or a cheese danish every now and then, but no way

348. does that add up to seven years.

349. No judge is gonna take this seriously.

350. Anyone who offers any benefit—

351. whether it be a cheese danish or the Hope Diamond—

352. to a public official with the intention

353. of influencing his or her discretion

354. is guilty of bribery.

355. And you're wrong, Mr. Laclare.

356. Some people take that very seriously.

357. Mountains out of molehills.

358. Besides, you need evidence of illicit payments.

359. Ms. McGinty will prove, I think, a very credible witness.

360. Who will say anything to save her own skin.

361. Have you anything else

362. before we see each other in court?

363. Uh-huh.

364. A: bribery is a predicate act.

365. B: Mr. Beigel's company

366. Meridian Property Management

367. is an enterprise.

368. C: Mr. Beigel conducted the affairs of his enterprise

369. through a series of racketeering activities.

370. Do you know what that spells out, Mr. Beigel?

371. Rico— the current favorite federal felony

372. among publicity-starved

373. U.S. Attorneys.

374. Now, would you care for me to call him?

375. You can't swat flies with nuclear weapons.

376. Mike Milken got, what? Ten years?

377. Get me the southern district U.S. Attorney's office, please.

378. Spare me the theatrics, all right?

379. Cancel the call.

380. Thanks.

381. Nobody wants a trial, okay?

382. We'll plead to unlawful gratuities

383. and give you McGinty.

384. You don't get my point, do you?

385. I gave Ms. McGinty a walk.

386. I want Masucci.

387. Yeah, and I want to keep on breathing.

388. Let's go.

389. We're wasting our time.

390. Masucci's not dumb enough to do business over his phone.

391. Maybe we'll get lucky on the pay phones.

392. People make mistakes— even Dons.

393. Yeah, well, we don't even know what we're looking for

394. by the way.

395. We'll know when we see it.

396. ( yawning ): You ask me,

397. you'll never get Beigel to give up Masucci.

398. That's not what Stone thinks.

399. The hitter who supposedly killed Russell Mackey?

400. Ruffo?

401. Yeah, what's his first name?

402. Vincent. You got something?

403. Could be.

404. Dig out last Tuesday's tapes on Masucci's phone.

405. Hey, Frank, it's Vinny.

406. Here we go, this is Masucci.

407. When you getting in? Tomorrow.

408. Good. I might want you to talk to Beigel.

409. Really? Yeah. I'll let you know.

410. Vinny. If it is Ruffo

411. and Masucci tells him to talk to Beigel, that means that...

412. He's more than just a brother-in-law.

413. Yeah, I knew the guy was slime.

414. Pilefsky used to be buddies with Ruffo.

415. He could recognize Ruffo's voice.

416. Hey, stupid isn't suicidal.

417. Maybe we can scare him more than Masucci can.

418. If we can't, I know who can.

419. Three years ago we nailed a Masucci hitter.

420. D'Agastino?

421. He should still be in the slam.

422. What do you say we go rattle Pilefsky's cage?

423. Hey, Frank, it's Vinny.

424. When you getting in?

425. Tomorrow.

426. Good.

427. to talk to Beigel. I might want you

428. Really? Yeah. I'll let you know.

429. So?

430. So is that Ruffo?

431. Could be.

432. Could also be Dolly Parton. What do I know?

433. You're right, Max.

434. This guy is as stupid as he looks.

435. I got this friend over at the Post.

436. Hasn't had a hot story for months.

437. I bet it would be

438. a big boost to his career

439. if I gave him an exclusive on how Joe Pilefsky

440. ratted out Frank Masucci.

441. Yeah, what do you think, Max?

442. Old Joe here would be breathing another, what?

443. Five, maybe six days?

444. Nah. Three tops,

445. but if he told us about Beigel's role

446. in the Masucci family business

447. I'm sure he could live a long and prosperous life.

448. We got nothing to lose, Joe.

449. We figure we put the word out on you

450. tell Zalta we did it.

451. Sit back, wait, see what happens.

452. My bet?

453. He's going to be very cooperative.

454. This is illegal.

455. Sue us.

456. Let's go, Mike.

457. You're bluffing.

458. Yeah, you're right, we'd be real upset

459. if something happened to a piece of crap like you.

460. "An unnamed soldier in the Masucci family

461. "already in custody awaiting sentencing

462. "on an assault conviction has been cooperating

463. "with the district attorney's office

464. according to reliable police sources."

465. Did Pilefsky get the early edition?

466. All we got to do is turn up the heat.

467. Guess who's down from Attica for a court appearance?

468. D'Agastino.

469. We want to offer him a year off his sentence.

470. I'll get stone to get it from Judge Faddenhecht.

471. They still do that crap, huh?

472. Verified by three sources.

473. That's it?

474. That's it.

475. You'll put it in writing?

476. Signed, sealed and delivered.

477. Deal?

478. Take off another year, I'll do it naked.

479. There are three calls on my log from Pilefsky's lawyer

480. and it's not even 10:00.

481. You got it on tape?

482. Yes, the cameras are always on in the yard.

483. Here's our friend, Mr. D'Agastino.

484. Over to Pilefsky.

485. Bang. The Judas Kiss.

486. Brother.

487. And one scared, marked man.

488. Right on the mouth. Would you believe that?

489. Mr. D'Agastino should consider a career in theater.

490. It plays like opera

491. except they kill the singers.

492. Let's see what key Mr. Pilefsky sings in.

493. Right.

494. Yeah. I'll let you know.

495. Yeah. Yeah.

496. It's Ruffo.

497. Those sons of bitches!

498. Those cops!

499. They planted that story.

500. Not my department.

501. Your meeting.

502. Sure you don't want your attorney present?

503. Is he that stupid?

504. Oh, God, I'm a dead man.

505. Who the hell do you think

506. pays for my attorney?

507. You got to put me with the Feds.

508. New identity, witness protection.

509. See how easy that was?

510. You said the magic word.

511. What word?

512. Witness.

513. What do you want?

514. Is Beigel part of the Masucci organization?

515. Is the Pope Polish?

516. How high up is he?

517. Frank keeps himself aloof, you know what I mean?

518. That way nobody can say, "Frank said this."

519. Everybody knows, Beigel opens his mouth it's Frank talking.

520. That include hits?

521. That especially includes hits.

522. Is that always the way it's done?

523. Ever since Beigel married Frank's sister.

524. He said that's always the way it's done—

525. From Masucci to Beigel to the hitter.

526. So Beigel must have given the order on Mackey.

527. We can't retry Masucci, but Beigel's fair game.

528. Yeah, well, Pilefsky's a convicted perjurer.

529. Not strong enough to go to court.

530. Strong enough to twist Beigel.

531. How far can I go?

532. Well, you can deal him down, but not out.

533. Prison, not jail.

534. Figure it out.

535. Turn on your brights, Stone.

536. My client has nothing to do with Mackey's murder.

537. We don't even know if he's dead, for God's sake.

538. True or false, Mr. Beigel—

539. Frank Masucci told you that Ruffo

540. took care of Russell Mackey for good.

541. Now, before you answer,

542. remember that you testified to that fact in court.

543. If you want to change your mind now, we can tack perjury

544. on to your bribery charge.

545. He talked, I listened.

546. No crime in that.

547. Depends on what you hear.

548. What I hear is that it was you

549. who gave the Mackey contract to Ruffo.

550. I hear conspiracy to murder,

551. and what you hear is 25 to life.

552. Without evidence, I hear "not guilty."

553. We've got Joe Pilefsky.

554. He's willing to testify to Masucci's entire organization.

555. Your boat has sprung a leak, Mr. Biegel.

556. You're knee-deep.

557. Pilefsky is a convicted perjurer.

558. We've got tapes on Masucci and on Ruffo.

559. And guess who's name keeps coming up over and over again?

560. The water's rising, gentlemen.

561. Illegal tap.

562. Warrant, signed, sealed and delivered.

563. It's up to your neck.

564. There's no way, Stone.

565. There is no way I give up Frank.

566. All right, give me Ruffo.

567. What do you give me?

568. Man one.

569. If I testify against Ruffo

570. then I won't live six months.

571. I'll guarantee you protection.

572. That's a joke.

573. You see me laughing?

574. I'll take my chances.

575. Then tell me where to find Ruffo.

576. Man two, with a sentencing recommendation.

577. If I find him, you got your deal.

578. How does it work?

579. He calls me.

580. Sends a car to pick me up.

581. I don't know where I'm going till I get there.

582. When do you know who he's in town to hit?

583. Frank doesn't let me know till the last minute.

584. He calls me on the car phone, he gives me a name.

585. Ruffo meets the car

586. I give him the name.

587. There is no way

588. I am going to say this in court.

589. Two teams have been on Beigel since he left your office.

590. Ruffo call?

591. Not yet.

592. You don't approve.

593. Beigel as much as confessed

594. he was involved in Russell Mackey's murder.

595. I dealt Beigel down to man two

596. because through Beigel, we get Ruffo,

597. through Ruffo we get Masucci.

598. You trusted Beigel before.

599. It backfired.

600. It's not about me.

601. No? No, it's about

602. getting Masucci, that's the game

603. we're playing here.

604. What's being played here is you.

605. You let Masucci get under your skin.

606. Now he's controlling the agenda.

607. I wasn't aware that tenacity in pursuit of a criminal

608. was a character flaw.

609. You can dress it up any way you want to, Ben.

610. It still looks like payback time to me.

611. The Russians say that revenge is the sweetest passion.

612. Yeah, and the Sicilians say it's a meal best served cold.

613. Ruffo just picked up Beigel.

614. Headed south on Irving Place.

615. We got 'em

616. What do you think— linguine at Elio's?

617. Twenty bucks says osso bucco at Primavera.

618. They got a white wine and mushroom sauce

619. that dances on your tongue.

620. We should all eat as well as they do.

621. Crime pays, Max.

622. For lunch, anyway.

623. Change of course.

624. Left on Sixteenth.

625. We got 'em.

626. We'll cruise Fourteenth.

627. I guess that knocks it for Primavera.

628. I'm keeping my 20 on the table right now.

629. We're gonna lose 'em.

630. We got a problem here.

631. Take over now.

632. Where is he?

633. towards Third. They're heading

634. Damn!

635. We checked his office; we checked his house.

636. You talk to the wife?

637. She wasn't in.

638. Damn it! We look like jerks here.

639. There's nothing else we can do tonight.

640. We'll talk to the limo driver in the morning.

641. Damn it.

642. I get this call—

643. pick up Mr. Harvey Beigel, drive him to the Plaza.

644. After that, it's as directed.

645. And?

646. I drove him to the Plaza.

647. I let him out. I waited.

648. And then what?

649. He comes out about three hours later,

650. around 11:00, and says I can pack it in.

651. He didn't want to be taken home?

652. No. He said he was in the Oak Room, went back inside.

653. I got the car in around 11:18.

654. Nice tip, no mess in the back seat—

655. the best kind of night.

656. Sorry, I can't help you.

657. Better ask one of the waiters.

658. We already did.

659. He was wearing a fedora.

660. Latest yuppie affectation.

661. They all want to look like their fathers.

662. I still can't help you.

663. Are you sure?

664. I mean, the place was busy last night.

665. Listen, if somebody spends three hours at one of my tables

666. I'm gonna remember him, hat or no hat.

667. Count on it. He wasn't here.

668. My husband owns property in Connecticut.

669. It's likely that's where he is.

670. Well, uh, he wouldn't have called you?

671. Harv's a big boy

672. and I'm not a possessive woman.

673. You have a very trusting relationship.

674. We respect each other's privacy.

675. Isn't that the way it's supposed to be?

676. Whatever works.

677. The point is, Mrs. Beigel

678. your husband had a meeting yesterday with Vincent Ruffo

679. and he's been M.I.A. ever since.

680. You heard of Vincent Ruffo?

681. He's an associate of your brother's.

682. Sergeant, we have nothing more to talk about.

683. If you don't mind

684. I promised to take my daughter shopping.

685. Hey, come here.

686. What's the big deal, huh?

687. So maybe I pad the bill by half an hour.

688. Is that a federal crime?

689. Your passenger never came home.

690. Maybe he got lucky.

691. Hey, listen- you don't come clean with us

692. you're going to be cracking your nuts

693. inside a cage.

694. Just between us, right?

695. I could lose my chauffeur's license.

696. Half an hour after he goes into the Plaza

697. Beigel comes out with this guy, face like a fist.

698. They want to borrow my car.

699. What for?

700. I'm not dumb enough to ask.

701. He gives me a couple of hundreds

702. and tells me I can pick up the car three hours, pier 26.

703. You always give your car up that easy?

704. Some people you don't say "no" to.

705. I got out.

706. Guy takes the wheel.

707. Beigel gets in beside.

708. When you got the car back?

709. Clean as when it left, except couple more hundred on the seat

710. and 50 more miles on the odometer.

711. Your car's got a phone, right?

712. Yeah, and a TV.

713. Can you tell if the phone's been used?

714. Sure. The customer gets charged for incoming and outgoing calls.

715. And last night?

716. Nobody touched it.

717. You think Beigel fled the jurisdiction?

718. I think he's dead.

719. And I got a feeling so does Katherine Beigel.

720. Masucci had Beigel Ruffoed.

721. The way we see it is he set up a meeting

722. with Beigel and Ruffo.

723. That much we got on tape.

724. But Masucci never called the car

725. to give Beigel the name of the hit.

726. Which means that the name was Beigel.

727. Stone's right. His own brother-in-law?

728. This guy's a mad dog.

729. Beigel might have been family

730. but he wasn't family with a Sicilian "F."

731. That explains why Mrs. Beigel

732. has been calling her brother all afternoon.

733. Five calls in the last three hours.

734. Masucci's ducking her.

735. Probably doesn't want to hear

736. how much she enoys being a widow.

737. Great— now we got to keep the tail on the sister.

738. Nail Masucci through his sister?

739. Feels like a reach.

740. Well, I don't like it either.

741. You got any better ideas, I'll be glad to take them.

742. What?

743. Yeah. Yeah, yeah.

744. They'll be there in 15 minutes.

745. Mrs. Beigel is at La Stanza in the Village.

746. So is Masucci.

747. It's been an hour.

748. My guess, he isn't just lingering over dessert.

749. You're jerking me around.

750. My husband has been missing for two days, Frank.

751. Listen, you're supposed to know what's better!

752. I like that woman.

753. Yeah, you would.

754. What Frank and I talked about

755. is our business.

756. When it involves your husband's disappearance

757. it becomes our business.

758. I understand that you're caught between conflicting loyalties.

759. You don't understand anything about my loyalties.

760. You know what happened to your husband.

761. So do we, we can't prove it, though.

762. What exactly does Mrs. Beigel know?

763. That Frank Masucci found her husband to be a liability

764. ordered him killed.

765. And this evidence

766. might help you see the truth of what I'm saying.

767. This is a recording of a telephone call

768. Vincent Ruffo placed to Frank Masucci

769. two days before your husband's disappearance.

770. Frank, it's Vinny.

771. When did you get in?

772. Late yesterday.

773. you talk to. Howard's the guy

774. But, Frank...

775. I said talk to Beigel.

776. Give him a buzz.

777. Now, what does "give him a buzz" mean?

778. What do you think it means?

779. That your brother told Vinny Ruffo to kill your husband.

780. Even if we accept your interpretation

781. what Frank Masucci does...

782. Michael.

783. What do you want from me, Mr. Stone?

784. Answers. Evidence.

785. I want to find out where your husband is.

786. It's only rumor.

787. Hearsay at best.

788. Mrs. Beigel is not involved

789. with her brother's affairs

790. and will not, under any circumstances

791. testify against him.

792. Remember, this is purely speculation.

793. Speculate, Mrs. Beigel.

794. There's a place...

795. in New Jersey.

796. What do we got so far?

797. Masucci's greatest hits.

798. A double there, a single there.

799. This one's folded in half.

800. Anyone recent?

801. Just bones and hair.

802. The Garden State.

803. Only to the mob.

804. I'm still not sure about the jurisdiction.

805. Let the D.A. worry about it.

806. Sergeant, we got a fresh one!

807. Harv Beigel.

808. Your witness, Counselor.

809. and conspiracy to commit murder in the second degree.

810. How do you plead?

811. Not guilty, Your Honor.

812. Motions?

813. Defense moves that this court

814. lacks jurisdiction in this matter, Your Honor.

815. A body was found in New Jersey.

816. There is nothing to link that body to New York City.

817. People contend that the murder

818. was committed in New York, and the body transported.

819. I'll hear motions in two weeks.

820. Papers to be submitted Monday next.

821. Until that time, Your Honor, the state requests

822. that the defendant be held without bail.

823. Your Honor...

824. Save it, Counselor.

825. This is murder two.

826. No bail.

827. Request a hearing.

828. It's your prerogative.

829. We have Beigel's body.

830. We have a positive I.D. on Mackey's remains.

831. I have means and motive.

832. What you don't have is one irrefutable piece of evidence

833. that ties masucci to either one of those bodies.

834. Without that, I'm not gonna let you go to trial.

835. What kind of evidence would satisfy you?

836. A witness would be nice.

837. You're not giving me much running room here.

838. The last time...

839. This isn't the last time.

840. Everyone has an agenda, my boy,

841. but I won't let yours take presidence.

842. I can't have this office dragged through the mud again.

843. No smoking gun, no trial.

844. I've already told you, under no circumstances

845. will Katherine testify against her own brother.

846. Do you actually think I'm privy

847. to any aspect of Frank's life?

848. I'm a woman, Mr. Stone.

849. Some traditions never die.

850. You heard the tape.

851. I'm only asking you to testify as to its meaning—

852. that Frank Masucci ordered your husband's killing.

853. Thanks to you, my husband is dead.

854. You want me dead, too?

855. Would Frank Masucci kill his own sister?

856. What the hell do you think I was telling you that day in court?

857. You got more than a dozen bodies, for God sake.

858. What more do you need to make a case against him?

859. Please, don't play dumb with me, Counselor.

860. We have bodies, we have tapes

861. we have Harv Beigel's...

862. In other words they have nothing.

863. You can't make your prima facie case.

864. I grew up in courtrooms, Mr. Stone

865. on my father's knee.

866. Well, then you're right.

867. Without your testimony, we're on thin ice.

868. So, I'll just put you on the stand,

869. with or without your permission,

870. and treat you as a hostile witness.

871. You can subpeona her, but you can't force her to testify.

872. You might want to remind Mr. Leclaire

873. what the penalties are for contempt and perjury.

874. Please, Mr. Stone

875. don't put me in this position.

876. I have small children.

877. And I have no choice.

878. Sorry.

879. I have my witness, Adam.

880. I'm ready to go to trial.

881. Her lawyer's right—

882. you can't compel her to tell the truth.

883. Once she's on the stand, she will tell the truth.

884. I see— now you're psychic, huh?

885. You realize she'd have to violate every rule

886. she ever grew up with.

887. Her brother threw the rule book out

888. when he killed her husband.

889. All right, you met the woman.

890. You want to put your faith in her character,

891. I won't second-guess you.

892. We have a problem.

893. Masucci's just been bailed out.

894. Just been... What? By who?

895. You sure he's here?

896. He's doing arraignments.

897. Lonner!

898. Don't move!

899. Sure, I knew Masucci's bail hearing

900. wasn't scheduled until Thursday

901. but his attorney brought it by order to show cause.

902. You should have called me.

903. I tried

904. but Judge Overmeyer gave me ten minutes.

905. He said no adjournments.

906. So Masucci's out on bail, what's the big deal?

907. Where's he gonna go?

908. Look, his sister was standing there

909. with a check for a million bucks...

910. Katherine Beigel posted his bail?

911. Yeah.

912. Overmeyer.

913. Connected?

914. The largest contributor to his campaign fund

915. is New York Cement. You figure it out.

916. Why would Katherine Beigel..?

917. I don't want to speculate. Find her.

918. Call Cragen and tell them to pick up Masucci.

919. On what?

920. I don't give a damn.

921. For spitting on the sidewalk.

922. Ben... Now, Paul.

923. for your husband's arrest.

924. Again?

925. He just got out.

926. What could he have done in five hours?

927. David, take your brother to his room right now!

928. Cute kids.

929. When they're asleep.

930. Let's see, Frank said something about...

931. some meetings...

932. Try the social club downtown.

933. That's where he keeps his office

934. but I suppose you already know that.

935. When does he usually come home?

936. 8:00, unless he has a business dinner.

937. He likes to kiss the boys good night.

938. Can I ask you something?

939. What exactly does your husband do for a living?

940. Investments.

941. Oh. I thought so.

942. One and a half more kids

943. they'd be on the cover of Life magazine.

944. Perfect American family.

945. Masucci had another kid, a boy.

946. Jumped a red light in his convertible

947. ran square into a pickup.

948. D.O.A.

949. Funny, the driver of the pickup

950. walked away without a scratch.

951. What's funny about that?

952. He died two months later.

953. Drowned at Atlantic beach.

954. Couldn't swim?

955. Couldn't get out of his truck.

956. Perfect.

957. Frank Masucci.

958. This is a private club.

959. You just went public.

960. Mind if we take a look?

961. Take it easy, fellas. I haven't seen Frank all day.

962. Pardon me if I think you're full of it.

963. I thought youse arrested him.

964. Did he beat youse already?

965. We miss his company.

966. Where's the office?

967. Listen, guys, I don't know what youse talking about.

968. You can show us now

969. or we arrest you for obstruction

970. and then you show us.

971. All right.

972. Now, now, Max.

973. Be social.

974. What are you looking at, huh?

975. Like I said, he ain't here.

976. You got something more than an arrest warrant, or what?

977. What are you, a lawyer now?

978. Where are we likely to find Big Frank?

979. Why don't you try the Met.

980. Hey, try this! Take it easy, take it easy.

981. It's dinnertime.

982. And?

983. Try La Stanza.

984. Mike.

985. You know what kills me?

986. These guys, they ride around in their limos...

987. they eat lobster...

988. they wear vicuna coats...

989. Should we let him eat first?

990. While we freeze our asses off out here?

991. Frankie?

992. We got a shooting on Barrow and Commerce.

993. Two white males

994. in a gray Cadillac heading west.

995. 14 shots from under ten feet.

996. Somebody wanted to make sure.

997. Who do you think that somebody was?

998. Katherine Beigel posted his bail

999. then hopped a plane to Miami two hours ago.

1000. She posted a million bucks just to waste him?

1001. It was no waste, it was bail.

1002. With Masucci dead

1003. she gets every penny back.

1004. Yeah, well, she did in ten seconds

1005. what we couldn't do in ten years.

1006. What's that?

1007. Put Masucci out of business...

1008. permanently.

1009. Any civilians hurt?

1010. Only the bad guys.

1011. Two in critical.

1012. You know what this means.

1013. Bodies will fall.

1014. It's a Gambino war of succession all over again.

1015. Between whoever is stupid enough to want Masucci's job.

1016. Who do we go after first?

1017. Let's see who's left standing in a month.

1018. Adam, this is not what I wanted.

1019. I got no complaints.

1020. Let's go tell the mayor.
